Fighting Cambodia’s Goliath: Mu Sochua (MSW ’81)

“Between 1975-79, over 1.7 million Cambodian women, men and children were killed by the Khmer Rouge, among them my parents. The world community knew about it but watched from afar. Cambodia has come out of genocide and on the road to reconstruction but this stage of reconstruction is stuck and in many ways quickly falling back to point zero. 30 years after the genocide of the Khmer Rouge, Cambodia has made some progress but too small:

Over 2,000 innocent Cambodian women die every year of childbirth,
At least one million Cambodian children go to bed hungry every night,
Hundreds of thousands Cambodian children and female youth are ruined in brothels,
Over 200,000 families have been brutally forced of their land and homes, and
Over 75% of Cambodia’s forests have now been destroyed.
Innocent lives of my people could be saved if justice were served, if top leaders of my broken nation were less greedy, if development were meant for all.

Let no Cambodian children go to bed hungry anymore. Let no Cambodian woman be sold anymore.

We must walk tall despite being people bent from the trauma of the Khmer Rouge, which is still a part of us. Let us not let our leaders and the world-community use this trauma to give us justice by the teaspoon.

Let there be real justice.

While working with Cambodian refugees in San Francisco as part of her MSW degree in the early 1980s, Mu Sochua never imagined herself a key political figure in the country of her birth. But now the activist turned politician is in the midst of a political standoff with Cambodian Prime Minister Hun Sen in a case that has attracted the attention of Human Rights Watch and the UN High Commission on Human Rights.

Sochua (pronounced Soc-Hua) fled from the growing violence in Cambodia in 1973 when her parents put her and her sister on a plane headed for France. She then came to the U.S. to attend San Francisco State, and enrolled in the MSW program at Berkeley in 1979. As a student she did field work working with the Cambodian refugee community – first with Alameda County Health Care Services, later with the Cambodian Project at the YMCA.

“It is a very Cambodian way of thinking not to be egotistic,” Ms. Mu told the SF Chronicle in an article about Cambodian refugees in 1979. “Once you are safe, you have to think of the people who suffer…It is a common feeling that we all share.”

Sochua intended to use her newly learned social work values to help Cambodians, and in 1989 she returned home. With her social work background she founded Khemara, an NGO dedicated to fighting for women’s rights, and later became the nation’s first female Minister of Women’s Affairs in 1998. After witnessing government corruption, she joined the opposition party, and in 2002 Sochua helped organize 25,000 women to run for election throughout the country, with over 900 women elected. Today she serves as an MP with the Sam Rainsy Party in the National Assembly.

In a series of events that began last year, Mu Sochua took a stand against Prime Minister Sen, a man who has held power in Cambodia since the overthrow of the Khmer Rouge in 1979. Sochua sued the Prime Minister for defamation after he made remark in a televised speech given in her district. In retaliation, Sen countersued, claiming MP Mu and her lawyer, Kong Sam Onn, were in fact the ones responsible for defamation.

Mu Sochua’s case against the Prime Minister was thrown out by the courts, while the Prime Minister’s counter suit against her and her lawyer has now gained momentum. A legislative vote stripped Sochua of her parliamentary immunity, a right, Hun Sen recently told a gathering, Sochua might never regain. “Lifting is possible, and restoring is – in many cases – impossible,” Sen is reported saying in the Phenom Phen Post. Sen also warned NGOs and foreign governments not to meddle in Cambodia’s affairs, saying that NGOs talking “nonsense” would also be brought to trial.

“The strong warning against foreign involvement by the Prime Minister, sounds more like Burma or Iran to me – a dictatorship,” says Sochua in a recent phone interview. “Cambodia receives over $1 billion in foreign aid each year. But where is the monitoring? Where are the reforms that are supposed to be part of receiving aid?”

The Cambodian Government is increasingly using the courts to silence opposition leaders, journalists and human rights groups, says a recent Asian Human Rights Commission report, citing six similar cases currently filed in the Cambodian courts. In 2008 Cambodia was ranked among the nations with the highest corruption in the world according to Transparency International; USAID stated in a 2004 report that corruption in Cambodia has “reached “pandemic” proportions.” The case of Sochua’s lawyer, Onn, also has international implications. Over the past four years the American Bar Association (ABA) has been working closely with the Cambodian legal system to promote democratic ideals and receives USAID funding for the program. Onn’s case brings up questions of how and why money is being spent for legal training in Cambodia. Sochua hopes the ABA will be vocal in speaking out in the case of her lawyer. On June 19th he was found guilty of violating Bar Association rules and could be disbarred for his involvement in her case.

Mu Sochua has been in touch with the School of Social Welfare throughout the months of her legal ordeal and requests interested parties send letters to the Cambodian National Assembly and to the U.S. Ambassador to the Cambodia, Carol Rodley. Vital Voices (vitalvoices.org) will also be helping with Sochua’s case and will keep updates on their web site. She also plans to visit UC Berkeley in September to speak about politics in Cambodia and the ways in which social work values inform her work as a politician.

Mu Sochua anticipates the defamation trial against her is scheduled to begin July 24th. If found guilty, Sochua faces imprisonment, but says that she will appeal the decision to the highest court “to put the Cambodian Judicial System on trial.”

    So how is she gonna let there be no hunger in Cambodia while all she does is talking? People can't eat her words to live. The only people eat up her shit is the full stomached ones. The empty stomached Khmer are left hungry as she talks how caring she is of them. I'd like to see her go up to those hungry people and preach her self-righteous lessons to them. What will she do when they ask her for rice and food? She probably tells them to wait and shit and gets in her car and comes back home to her air conditioned rooms in Phnom Penh eat a steak dinner while those poor people still starve and eat grasses while waiting for her promises. That is why Sam Rainsy Party will never be the major party in Cambodia because their goal is making promises.

    let me ask this to the SRP supporters, how many promises that he made while he's solicitating your money has Sam Rainsy fulfilled?

    It's no wonder why even SRP members start to defect to other parties like the CPP for example. SRP makes promises and eventually the people whose livelihood that depends on those promises find out the promises to be empty, they will go for the people that make good of their words. That is why I have seen many even Khmeroverseas that used to support SRP drift away from SRP bc of the emptry promises. At first, they loved it hearing exactly what they want to hear from Sam Rainsy. Then, after a while, it gets old with the same thing repeated over and over while there is no physical shape has taken place on the promises. Guess where do they next turn to? the CPP.

    On principle of good deed, Ms.Mu Soc Hua is unselfishly assisted refugees resettling in US although she might have no first hand tragic experiences.

    Given that, she did her best to be a good Khmer woman in acquiring skills, education and worked in community where Khmer refugees needed help.

    When comes to expressing her dissenting views on corruptive individuality in government practice her voice was silenced any way the evil could imagine to put down woman from equality and denied her due process.

    To advance her political rights to advocate human rights and welfare rights for poor ,she sided with thge lesser evil to fight for the uneducated millions who never understood what it takes to be expressive and vocal in own roghts for self-defense.

    Bashing her personal and opposing view in the corruptive individuality in government behalf made Khmer in Illinois not only wrongful but immoral.


    Per 1993 Constituion, Ms.Mu Soc Hua is not just a woman in the eye of laws. The Constitutionality allowed and encouraged people to speak against injustice and government wrong doing.In the sense, if Sen mocked MP Mu Soc Hua for his personal advancement that made him not an evil but a laws violator as well.

    I speak here as a human and apolitical voice and a Khmer as well.
    Please tone down in your half hearted truth in attacking individuality behind a hidden political ploy.

    I gathered you are a US citizen by now,so there are laws and restrictions that individual US can say or do in own behalf for the betterment of others.US citizenship allows individual to speak for the abused and the disadvantaged ones too.

    In this case, Ms. Mu has done plenty for others disregarding her political affilliation and private life.

    Some guy here in this site he/she stated that I might be ‘Youn Spy’. I am actually not I am a real Khmer, my hometown is in ‘Pdak’ Siem Reap province. I identify myself as Khmer and I use neck name as ‘Angkorian Man’ because I am a Khmer Angkor who was born in Siem Reap where the hometown of our original Khmer King resided during the Angkor period. Also the name ‘Krama Man’ because I wrap Krama at home daily after work, so people named me as ‘Krama Man’. I adore my country, by doing this to keep Khmer tradition and culture alive. I am proud to be Khmer, I am a Black-Khmer man, I am very attractive guy. Most the people at work know that I was a former Khmer Rouge soldier; they never bother to discuss any memory at the past and concerning the recent Khmer Rouge trail. Am I clear for you guy now?     Before the July 2008 elections, Sam Rainsy went to Rokar Chroloeung Commune, Ksach Kandal District, Kandal province and promised to reduce oil prices. He could went there for the first time since he came to Cambodia in 1992, because I built good road to this commune. He got 250 votes for spending 20 minutes there. Since then he never came back. He cheated people, as he also promise to take land from traders and give to the people.

    I always highly appreciate on your opinion as a Khmer. We are living in a democratic country that we can criticise anyone we like to do so. By giving a fair opinion, people consider on the matter. We must do good thing like our Lord Buddha teach us.

    Do not say something that is not true for example Cambodia will become this or that. We try hard to build the Land of Angkor from scratch after the Khmer Rouge genocidal regime which they killed about 4.5 million innocent Khmers. It is better than 30 years ago that we have every things for our life. Some people are still poor and must help them to work hard for a better life. The government along with the development partners (Japan, China, European Union Countries, USA, Australia...) are building infrastructure in the whole country such as roads, bridges, schools, hospitals, water resources for agriculture...

    Please come back home to see what is going on in the Land of Angkor which are visited by more than 2 million foreign tourists a year. During this first half year 2009, Cambodia received more than one million tourists even there are economic recession, disease ...

    The 1.7 million Cambodian killed by the khmer rouge is part of what I mean, Khmers killing Khmers, becuase of your ideas of alway blaming the ruling party of control by youns or other countries. For examples, alot of you are accusing the CPP party of controling by youns. And for land grabbing. The lands that those people being evicted from are owned by the government or privates. And they was kind enough to let those people live on their land temporarily until the government need or sold to developers or private owners need to used there land. And when they need to used their land, they faced with these problems. I live in the US. The lands that belong to the government or privates here are not allowed even enter the properties. They always posted sign,"no tresspassing, violators will be prosecuted." We have more homeless people than in Cambodia.
    And for government improved in 30 years, you need to go to Cambodia your self to see how much progress has been made. I have been there many time since 1995, I have seen all the progress, you should visit Cambodia your self and see what progress have been made. Thank you for your reply.

Objectively, you can’t blame ALL Khmer Rouges are bad, human NOT all bad, think and look around you. Do you think you could find good people around you to be trustful? Absolutely not there’s no one you can trust. Can you see some people get kill almost everyday by car accident, brutal argument etc, and being discriminated by race Black-Khmer and White-Khmer-Chinese, using her/his as slavery everyday at home. Hey! let me tell you especially the Phnom Penh people I’ve seen now very dicriminated against Black-Khmer, why? Because they consider Black-Khmer as a slave, low value, White-Khmer Chinese treat them high class better than Black-Khmer. This is abuse than Khmer Rouge living regime. Can you see it, this living society now is worse than Khmer Rouge. I hope you know what I meant? If you still keep getting mad, hate Khmer Rouge, it’s not going to do any good in the future. Khmer Rouge is KHMER and you are KHMER too, thus we must end now in order to have the country growth. SAMAKEE, SAMAKEE, SAMAKEE we will always win with to the enemy.

    Like 5:08PM Said, most of the Phnom Penh resident own their property way before the Khmer Rouge era. During the KR regime, the whole city were evacuated. Only after the Vietnamese invasion, that everyone return home. All property were privately own. You got it now?
    Believe me, I've been to Cambodia numerous time and people still lived in a straw house. You called that an improvement within 30 years?

    I do not have as much education, as you are, but I do understand that khmer rouge has destroy all properties ownership and almost everything else. So after the khmer rouge, everything including the property ownership was start from zero. You said, that people are still living in straw houses.
    Hey, Cambodia is one of the poorest country in the world, we started almost from nothing 30 years ago, how are you going to expect all Cambodian living in cement or bricks houses?. The progress we have in the last 30 years was alot, look all the bridges, roads, new buildings, peoples and everything else, by the way I believe Cambodia is one of fastest growth in the region.

    Correct me if I am mistaken. Vietnam invaded Cambodia during the Khmer Rouge era. And January 7th was the day of invasion. Right?

    Reading your other comments, I know you love our nation. And thank you for stating that you feel sorrow for those of us whose families had been almost decimated during this cruelest era.

    Friend, loving our nation is one thing. Standing for righteousness, justice, and freedom is quite another. You want Khmer to stop fighting Khmer. And I can assure you that deep in our heart no Khmer in his/her right mind want to fight with Khmer although our comments here at times seem pernicious.

    How can we avoid the mistakes the Khmer Rouge made? Conforming to the status quo is not the answer. You are the living example of conformity. Whatever Ang-Kar said, you followed. Look what had happened to our nation. I do not need to repeat that here.

    I know how you feel about the opposition party. I do not claim that the SRP or its leaders have all the answers to our nation’s problems. Nor do our fellow friends who are here regularly. It would be arrogant for anyone to think in such way. What we want is a chance to participate in what was promised to us as a democracy, assuming CPP and its leaders do not have all the answers neither.

    What frustrates many of us the most is that democracy or rather election is merely a tool to determine who has the power to solely control and set the nation’s agendas. That is a great departure from a participatory democracy.

    If I sound like I am defending the opposition party, I am - though I am not a member of this party. I am doing so because I am convinced that it is the right thing to do. I could careless who is in power as long as he or she creates a condition that is conducive for most of us who may hold different political views to participate in rebuilding our nation freely and safely.

    You too should stop advocating for individuals and should have the courage to stand for our nation as whole not just for a political party. Be independent.

    The frustration here is that after the 1993 election we should be working together to rebuild our nation. Viewing the situation from afar, we rather resorted to playing political games than working together. Of course, political parties have different visions of how each wants to lead the country. That is what democracy is all about. It is about people with different views working together to find a compromise or a common ground.

    It takes both parties that understand our common goal and respect for one another to gainfully working together. Without that, asking us to do so here is pointless.

    Let me stop here.
