Mu Sochua’s immunity will not be affected by the law but it could be difficult for her to get it back

A high-ranking official from the National Election Committee (NEC) said in the afternoon of 28 July that, if the court finds Mrs. Mu Sochua guilty of defaming Hun Xen, this sentence will not affect her political rights once she pays off the fine imposed by the court. Nevertheless, political analysts said that, most likely, there is little chance for Mu Sochua to receive back her parliamentary immunity according to the law and the explanation provided by Cheam Yeap, the CPP chairman of the National Assembly (NA) finance committee and a member of the NA permanent committee.

Tep Nitha, NEC secretary-general, told Rasmei Kampuchea yesterday that: “In the event the court finds Mrs. Mu Sochua guilty in this defamation lawsuit case, her sentence will not affect her right to receive her immunity back.” Tep Nitha added: “This is a light sentence. It’s only a sentence with a fine. It is not a sentence with jail time.” According to Tep Nitha’s explanation, the law only prevents those who are sentenced to jail from voting. This means that people who are not sentenced to jail time, have the right to vote and to present their candidacy during the elections.

Cheam Yeap claimed that when Mrs. Mu Sochua will be done paying her fine, and the court will send a letter to the minister of Justice so that the latter informs the NA about the fine payment, then the NA will move according the rule to decide on Mrs. Mu Sochua’s immunity. However, he also claimed that: “It’s like the case of Mr. Sam Rainsy, whichever way it came in, it will go back out the same way.”

Political analysts said that if they comment on Cheam Yeap’s claim, Mrs. Mu Sochua will have great difficulty to get her immunity back without the support from CPP MPs. Mrs. Mu Sochua saw her immunity lifted with the vote of 2/3 of the MPs. Therefore, [based on Cheam Yeap’s claim that] whichever way the case came in, it will go back out the same way, then Mrs. Mu Sochua must find 2/3 of the 123 MPs’ vote to get her immunity back.

Hun Xen also issued a warning to CPP MPs ordering them to reject their support. Therefore, Mrs. Mu Sochua’s case is different from that of Sam Rainsy because the latter’s immunity was suspended by the NA’s permanent committee and it was re-instated back by the permanent committee.

As for Mrs. Mu Sochua, she claimed that she will go to court to listen to the announcement of her sentence on 04 August, she believes that a fine sentence should not lead to a [permanent] loss of her immunity.

    There is no way that members of Parliement of the CPP will ever vote to give parliementary immunity back to disgrace Mu Sochua. Despite she paid the fine if she lost the defamation case to PM Hun Sen, but she has to work without parliementary immunity until the next election.

    As a self-proclaimed strong woman, why she needs Parliementary Immunity for???

    CPP must not give the immunity back to Mu Sochua. She has created too much confusions to the country. I am happy to see her out of politics. She has not done any good for the country. In 2003 election campaign, Mu Sochua was dancing on stage for her electoral campaign to be well known while being the member of Funcinpec. She danced very nice.. now she want to be a political champian for change in Cambodia. She is a nut realy. kk

    Well, Khmer in Cambodia as well as Khmer in overseas have freedom of speech and freedom in supporting any political party in Cambodia, but SRP and its stupid supporters think otherwise. Any Khmer who support its self name party, they will applause that you are Khmer and a good person, by contrast, if the same person chose to support the CPP, SRP will brand that person that you are not Khmer or whatever they like to accuse. That is the pattern of the thick face group and the loser party.

  13. When two Khmers from a different political party meet each other, they always use bad words to support their respective boss. I am, Khmer younger generation, very disappoited to such behavoir of my Uncles who have gray hair but use childish language in the pubic. This is general khmer character, isn't it?

    I, respectfully, beg you, my Uncles by age, to use friendly words to each other as we are khmer having the same khmer-blood. you should share only good behavior to the younger so that next generation, our Cambodia can be developed.

    Those are the characters of the Khmers from old schools (primary school) and some couldn't read or write but love to be called "Lok Thom". Now their old characters fell onto the young Khmers who also have less education or none, or from rich family members, and tehy too prefer to be just like their old farts.

    I am strongly agreed with your comment.
    Most of the comments in the KI are about cursing and insulting other Khmer or the nation. Beside, they always think that they are well educated and patriots but most of their comment are full of the obscene language. I used to hear these words from the gangs, the ignorance street kids.
    If you are the real Khmer, please do not use your words to inflame the nation to against each other. Moreover, it is time that we all should support each other to protect our nation in the time of crisis.

She knows she can gets backup from the people who on her side. Mrs. Mu Sochua, please stop fighting, filing complaint against Samdech Hun Sen. I am so sick and tired of you, I would never and ever read your compliant case, however I heard your complaint case months ago and it is useless.

    Actually, we get 90 seats in parliament over 123 total, furthermore we can gain more for the next election if we want because we were in absolute control in the situation. In constrast, Sam Rainsy and Khem Sokha were only a eggs against the stones, they had no chance to win. The result to restore Mu Suchua and Ho Vann their MP immunities were only pity on them.
