4 AUGUST 2009 – ANOTHER DARK DAY FOR JUSTICE AND DEMOCRACY IN CAMBODIA

The Cambodian Center for Human Rights (CCHR) regrets the verdict of the Phnom Penh Municipal Court on 4 August 2009 in the case of Sam Rainsy Party (SRP) lawmaker Mu Sochua, and condemns the police’s treatment of SRP members and supporters that followed this verdict. This verdict provides further proof that the Cambodian judiciary is a political tool of the Royal Government of Cambodia (RGC) used to silence opposition voices. Moreover, the violent scenes that followed the verdict are testament to the RGC’s hostility towards democracy and the freedoms of expression and assembly.

The verdict against Mu Sochua was the culmination of four months of political strong arming by Prime Minister Hun Sen, during which time Cambodians and the international community were given the opportunity to witness the extent to which the Cambodian judiciary and legal system is under the control of the RGC. During this period a campaign against the pillars of democracy; lawyers, politicians, journalists and NGOs, has been conducted through the medium of the Cambodian Court system with charges of criminal defamation, disinformation and incitement being initiated against, to name just a few; Hang Chakra, Soung Sophorn, Moueng Sonn, Dam Sith and Ho Vann.

On 24 July 2009 Mu Sochua stood before the Phnom Penh Municipal Court with no legal representation, her original lawyer having withdrawn from the case as a result of threatened disciplinary action against him by the Bar Association of Cambodia. In her opening statement and closing remarks, Mu Sochua called on the Municipal Court to prove its independence and to avoid making a political decision. The SRP parliamentarian exercised her right to silence when questioned by the Presiding Judge, the Prosecution and the Civil Party Lawyer, seemingly protesting against her lack of legal representation. Article 14 of the International Covenant on Civil and Political Rights, which is part of Cambodian law by virtue of the Constitution, guarantees the right to a lawyer of one’s own choosing, a right that had already been denied in this case.

On 4 August 2009, the Phnom Penh Municipal Court delivered its verdict finding Mu Sochua guilty of having defamed Prime Minister Hun Sen and sentencing her to pay a fine of 8 ½ million riel and a further 8 million riel in compensation. This verdict represents a nadir for the Cambodian political and judicial systems and any supposed separation thereof.

Upon hearing the verdict, Mu Sochua and her followers attempted to walk to the SRP headquarters on Sothearos Boulevard. The scenes of violence that followed, whereby members of the various police forces that were present attempted to intervene and prevent a peaceful march, evince an absolute disregard for democracy and the freedoms of assembly and expression. During these scenes the following incidences are reported to have occurred:
  • Mr. Chan Cheng, 52, SRP lawmaker in Kandal province was first hit with a baton by a policeman at the corner of Olympic Market, and later kicked in the chest in front of Langka pagoda;
  • Mr. Yon Tharo, another SRP lawmaker, was hit three times with a police baton;
  • Ms. Mu Sochua’s hair was pulled, and she received bruises and cuts to her body;
  • Ms. Seng Theary, former Executive Director of the Center for Social Development, was forcibly removed from the crowd;
  • Mr. Seng Cher, 45, from Kandal province and Mr. Ly Ne, 33, were arrested and released one hour later.
  • Mr. Yon Tharo’s bodyguard was also arrested. Before his arrest, he was hit on the head, kicked and kneed by up to 10 police officers. He has since been released.
  • Ho Sirin, 42, SRP activist was grabbed by the throat, kicked and kneed. He said a policeman in black uniform flashed a gun at him so he decided to stay still.
  • An old woman, aged 70, was beaten from behind on her back and around her waist.
The violent scenes of 4 August 2009 that followed a politically motivated verdict by the Phnom Penh Municipal Court capped what will be long remembered as another dark day for justice and democracy in Cambodia. The CCHR regrets the verdict and condemns the manner in which the police handled a peaceful procession.

    Disgrace Mu Sochua’s problem all along, is that she is trying to be a politician. She's not, never has been and quite obviously, never will be. She should have just been herself, provide alternative policies and show Khmer people what a great alternative MP opposition she would be. Instead, her foray into being a politician has been a disaster. She comes across as pretending to be something she's not. Now, her political career is on the line and herself also in the hot water.

    While the nation is facing complex economic, social and environmental issues disgrace Mu Sochua tried to promote her political stunt, aimed to get media attention. If this wasn’t such a clear demonstration of her selfish pursuit of personal ambition it would be laughable. There is no doubt that Mu Sochua has no real regard for the best interest of the nation. She is driven solely by a desire to become a “Champion of Women” by any means available to her, even if that has the potential to destabilize the country. Even worse she now says that she will appeal her case against Prime Minister Hun Sen to the Appeal court following the announcement of her guilty verdict by the Phnom Penh municipal court.

    People of integrity admit their faults, make amends and are judged fairly...Disgrace Mu Sochua is lacking in integrity and common sense and tries to change Cambodia into her own world. As long as Cambodia’s Court doesn’t issue any verdict which is fitted for her political stunt, she will scream for the justice all day long.

    Since you seem to focus on our Cambodia' issues, I believe you want Cambodia and her people to be freed like us all Khmers. But how to free ourselves, please follow very careful on US and China strategies. Because they are superpower nations who have a full impact on small nations like Cambodia.

    Please read and follow very careful US-Vietnam friendship;
    and
    VIETNAM PLAYS DOUBLED-STRATEGIES: One strategy Vietnam works for the US against China, TWo Vietnam works to take over Cambodia, and Thailand. The Preah Vihear troubes is the Vietnamese strategy.

    The problems in Cambodia between Mu Sochua and Hun Sen is GOOD for Vietnam, and while these two are fighting, we Khmers forget to look at Vietnamese whose strategies is to replace Khmers by their own people who speak fluently Khmers and take over Cambodia after the old Khmers will soon retire or die.

    I do NOT support Mu Sochua who continues her law suit against Hun Sen, I only support Mu Sochua if she finds the way to go back to work as MP to serve her country and her people, before Vietnamese who speak Khmers will take over her MP.

    What Khmer Pride do we have or Mu Sochua will have if we lost our Kingdom to the silence Invasion of Vietnam through new replacement of people from Vietnam who speak fluently Khmers?

    I have some questions for you who is now living in the US. I assume that you live in the US as a citizen or at least as an immigrant who can later on becomes an American citizen if you choose to.

    What do you think if these so-called Vietnamese people who speak Khmer fluently and live among your real Khmers happen to love Cambodia the way you love United States of America and they also want to defend Cambodia for the sake of themselves and their children?

    I guess you don't think they are capable of loving Cambodia the way you love United States of America. If they speak Khmer fluently and their kids go to Khmer schools, don't you think they are capable of loving their new land?

    Ask yourself where your loyalty lies if Cambodia and America are at war right now? Should I doubt your loyalty to America since you or your parents came from Cambodia?

    What do you think of the idea of encouraging these people to love what they have in Cambodia so they can feel welcome in their new society and therefore help the Khmers defend the very land they now live in?

    If Hun Sen could wage wars against America and conquered it, then turned it into a society where he continued to rule with absolute power, on what side would you be fighting?

    Alot of you are talking about democracy. The fact is CPP party was elected by the people, why most of you are not accepting people choice and said, it is a dictatorship. Is it becuase, it is not SRP party?. Or, what most of you mean is, if SRP is not winning the election, it is not a democracy?.

    I'm not talking about those Cambodians of Viet, Thai or Chinese decent I am talking about the ones who sent from Vietnam as spies, million Khmers knew about it.

    I am a son of Cambodia (of chinese decent), my heart goes to Cambodia and the people who were born in Cambodia, but as a future scientist I belong to no country but to the world.

    If the US will grant me a Citizenship I will take it, if not I will manage to work with other nations like Japan, China, and Euopean nations if I desire to do so.

    Poor or rich I always love my country, Cambodia no matter where I will live or work.

    viets have no strategy whatsoever to take over cambodia. the viets are weak and cant stand a fight with cambodia soldiers. your suggestion is wrong. remember the viets got defeated in the early 1990s and had to withdraw from cambodia. So, you theory holds no water here. the viets are now cooperating with cambodia as a neighboring friends. they don't have the strenght to fight a war with cambodia.
