The CCHR Welcomes The Acquittal Of Ho Vann

Cambodian Center for Human Rights

Press Release
Phnom Penh: 23 September 2009

_________
THE CCHR WELCOMES THE ACQUITTAL OF HO VANN

The Cambodian Center for Human Rights (CCHR) welcomes the decision by Judge Sin Visal of the Phnom Penh Court of First Instance to dismiss the charge of defamation against Sam Rainsy Party lawmaker Ho Vann, arising from a complaint made by 22 officers of the Royal Cambodian Armed Forces.

In his verdict on 22 September 2009 Judge Sin Visal stated that there was insufficient evidence to convict Ho Vann of the defamation charge. The CCHR commends this decision which can perhaps be viewed as the green shoots of judicial independence in Cambodia. Such progress is very welcome.

The CCHR recalls that Cambodia Law provides that Ho Vann’s parliamentary immunity will be automatically restored.

The CCHR is concerned with the fines imposed against Neou Vannarin and Kevin Doyle of the Cambodia Daily, and urges the Cambodian judiciary to respect freedom of expression. Nevertheless, the CCHR commends Judge Sin Visal for his decision to acquit Ho Vann, and hopes that this represents a new departure on the part of the Cambodian judiciary whereby independence and impartiality will be guaranteed.

There is no doubt that whenever the Court found not guilty or dropped the charge against any SRP MP, the SRP will applause to the Court's verdict, but if the same Court found guilty of any SRP MP, the SRP will condemn to the Court. That is the pattern of SRP, the party always been a loser.

Loser or no loser. The court shouldn't be bias or get instruction from anyone but the court itself.

Its a sign the court or judges is incompotent like the ruler. If you incompotent, don't try to be a judge or PM.

I would like to say thank you to Prime Minister Hun Sen whom is very kind at heart and is willing to forgive those who made mistakes against him. I also believe the court is doing the right thing by not charging our diplomat without sufficent evident to prove it otherwise. We khmer people must work together as a team to promote our intelligents as well as focusing on skilled migrants intakes because they are the foundation to rebuilding the country more effectively. We also need to be more focused on adding new infrastures to meet our people's need such; hospital, school, university and providing quality education to all of our khmer citizen...

Those MPs should have not been charged in the first place. Thanking Hun Sen means thathe's in charge of the court. There is no real justice in Cambodia. The decision made by the judge to acquit Ho Vann is all political. Let see if Mu Sochua can be acquitted. We should realize that Cambodia is ruled by one man, one branch of the governent. The excutive branch control everything. The judiciary and legisative branches are just rubber stamps. Think about thist--the Priminister himself is also a parliamentary member. Common sense tells me that LET BE REAL!

The Cambodia court is the court of CPP party. When the court belongs to the CPP, it must listen to Hun Sen; otherwise, the court jugde will lose his seat. This is the court of the clowns/monkeys "doing as I say."

    To 8:16PM,
You are so dumb. Hun Sen is now under great pressure from many countries that have given aid to Cambodia. Your Hun Sen was and still is a Khmer Rouge deep to the bone. A Khmer Rouge won't change his absolute Khmer Rougeism. If Hun Sen has just a little bit of kindness and sympathy, Cambodian people wouldn't be treated like animals as such.

You sound like New Phally. Rewrite your comment, so it can be understood by most.

    I agree with you.
Speaking in term of being incompetent, let me share with you by mentioning what Epictetus said, "If you undertake a role which is beyond your power, you both disgrace yourself in that one, and at the same time negleg the role which you might have filled with success."

The fact that the Cambodian court withdrew charges against MP, don't mean that the court is independent. I believe that international reaction that make Hun Sen ordered the court to drop the charges. Hun Sen don't want to hear the public outcry which could irritate the donor countries.

Sochua Mu is our hero and she has done a great job and I want to see her back as an MP, again. If not this country will need urgent support from various committies abroad. If possible, I would like our constitution be reformed. Working base on human right approach, by having a law and order to protect civilians, as well as the freedom to do whatever people want to do in term of rebuilding the country. I would to see Hun Sen works in partnership with the opposition leader rather then against them. This is the only way for him to be more success in whatever he wants to do.
