Sam Rainsy: Ho Vann must get back his parliamentary immunity automatically

Legal experts and opposition politicians said that the Phnom Penh Court should, through Ministry of Justice, send a request to the National Assembly to reinstate Mr. Ho Vann's parliamentary immunity after it dropped all defamation charges against him.

Mr. Sam Rainsy, leader of the eponymous Sam Rainsy Party (SRP), said by a telephone interview that the SRP will not write a letter to the National Assembly to request for it to give back Mr. Ho Vann's immunity by saying that by laws Mr. Ho Vann should automatically get his immunity back after the court dropped all charges against him.

Mr. Ho Vann was sued by 22 military officers after he criticised their qualifications awarded by the Vietnamese Military Institute. On 22nd June, the National Assembly stripped him off his parliamentary immunity and he fled to the United States.

A week ago, the court dropped all charges against him after international pressures and after U.S Secretary of Defence Robert Gates raised the issue with Cambodian Defence Minister Tea Banh during their meeting in Washington DC a week ago.

    Kouy Picet,
    Without immunity you are not Member of Paliament. Paliament is law maker. In comparison, without immunity you lost your seat in the Congress.

    What so important is if you lost that seat you lost ability to serve your people. The immunity is not easy to strip, it's our government-just don't respect the law. This why the immunity for the right people is very important. We can not affort to give up the seat to the wrong people.

    There's only 123 seats in the National Assembly.

    Cambodia is a lawlessness country.
    if there is law but no law is above yuonxen or slave-ahnuk and kingaroogay son. They walk in circle. yuonxen play the mean kids, the gay king play nice, the slave father just sit watch and laugh. jail is nothing but their play ground. one put in jail then one going to pardon..when one stripped off then one going to pardon. Those people never work, some of them just go to the place to sleep b/c it is free; free toilet, free foods and free AC.
    They have no shame...they have nothing to do except fighting each other. Most of them never go to school and now they are all judges and lawmakers. such a no brainer!!

    That is very stupid interpretation of the constitution that Sam Rainsy had. Can't he read article 80? Members of the National Assembly can't be prosecuted because of the protection of immunity, which can be lifted by 2/3. Prosecution can be suspended only with 3/4 vote by the National Assembly, which means that 3/4 reinstates the immunity. How can he intepretes that Ho Vann guy gets it back automatically? What an idiot!!

    Ho Vann need 2/3 of parliamentarian vote to get his immunity restitute, or approve by ministry of justice, but first he should write an apologize letter to our top 22 Generals before we think about his case.

    The Court only needs to send the latter to National Assembly about Mr Ho Vann innosence .

If the parliament is guilty of doing anything he or she has to pay according to what he or she has done and then National Assemble will have to vote to reinstate his or her parliamentary . But if he or she has found innocent , he or she will have his or her immunity back automaticly without doing anything .

    The court dropped all charges against Ho Vann, therefore he is not not guilty of anything, so he will get his immunity back automatically like Sam Rainsy said.

    You are right through the hole. In the 80's he lived at least 15 years right behind PCH College Campus, but stepped in that college nor did he go to Watt Irap. I guess he might have studied well enough in Cambodia, and he is not a Buddhist believer.

    Read below, does it even say anything close to the word ÄUTOMATICALLY?

    Article 80:

    The deputies shall enjoy parliamentary immunity.

    No member of the National Assembly shall be prosecuted, arrested, seized, or detained because of his/her opinions or expressions during the exercise of his/her duties.

    The prosecution, arrest, seizing, or detention of any member of the National Assembly shall be made only with the approval of the National Assembly, or of the Standing Committee of the National Assembly between sessions, except in case of flagrant delicto. In that case, the competent ministry shall report immediately to the National Assembly or to the Standing Committee for decision.

    The decision made by the Standing Committee of the National Assembly shall be submitted to the National Assembly at its next session for approval by the two-third majority vote of the entire National Assembly membership.

    In the cases stated above, the detention or prosecution of any deputy shall be suspended if the National Assembly casts its vote to suspend by a three-quarter majority vote of the entire National Assembly membership.

    It is all because Khmer people are too busy fighting with each other. It is us who allowed others to take advantage of our country and at the same time, we Khmer people always listened to the outsiders about how to improve the development of our country. As we all know that others would not want us to be better off than them in anyway, it is in our human nature, so what do we get? we were trained to destroy our own homeland and people instead and in doing so is for their intention to take away our land in the end!...so wake Khmer people, you must think deep... right now, all we need to do is, try to focus on migrants intakes to increase in population grow, to build a new nation of Khmer so that our heritage is still be there or we will have nothing left. So, all officials must come together at once and speak about how to increase population grow as well as creating a system that everyone is equally important, that is respect and protect! Aust
