CHRAC Calls for a Political Solution to Sam Rainsy Case

CAMBODIAN HUMAN RIGHTS ACTION COMMITTEE

STATEMENT ON
CHRAC Calls for a Political Solution to Sam Rainsy Case
Phnom Penh, 26 February 2010

The Cambodian Human Rights Action Committee (CHRAC), a coalition of 23 NGO members, regrets to learn about a recent complaint made by the Royal Government of Cambodia against Mr. Sam Rainsy, President of the Opposition Party, in addition to his former charges which was previously tried by Svay Rieng Provincial Court.

According to the announcement made by a lawyer who is representing the Government, it is believed that the new complaint against the opposition leader with new charges had been already recently lodged to the prosecution office of Phnom Penh Municipal Court. This news makes national and international public opinions another concerns about the recent political issue in Cambodia, particularly in relation to the democracy space and the roles of the parliamentarians; namely the roles of opposition parliamentarians which are often affected by the complaints filing to the court from time to time, while other national important issues strongly need of contributions from all politicians of different political tendencies.

With regard to this matter, CHRAC is in the opinion that all Cambodian political leaders from various different political tendencies should pay more attention on national interests and bound together through a significant national reconciliation in order to solve these problems peacefully. CHRAC, therefore, urges our political leaders to mutually respect each other and negotiate with their political maturity in order to address the national issues, and for the people of Cambodia to live in a peaceful and democratic society, of which the Government has often affirmed and committed to.

    CHRAC,

It's too little too late for a political solution to Xam RainXy case.

When Xam RainXy has uprooting the border stakes in Svay Rieng province to promote his political stunt and recently, he has misinformation and false public document, aim to damage the Cambodian government's reputation why the so called CHRAC has never came out to make any comment about it? Only when Xam RainXy is under siege, CHRAC shameless calls for political solution!

CHRAC should let Xam RainXy takes this issue to International Court which he's often said al along in the media and we should wait and see how far Xam RainXy can go?

Last time, PM Hun Sen forgave Xam RainXy for defamation because CPP needs SRP helps to change Constitution, but now, it's different story. The CPP no needs SRP. So, Xam RainXy is a fugitive for the rest of his life.

"On October 23 1991, the Agreements on a Comprehensive Political Settlement of the Cambodia Conflict were signed by Cambodia and 18 other nations in the presence of the United Nations Secretary-General. The agreements were the culmination of more than a decade of negotiations in which the Secretary-General had been closely involved from the outset."

    Article 5:

1: In the event of a violation or threat of violation of the sovereignty, independence, territorial integrity and inviolability, neutrality or national unity of Cambodia, or of any of the other commitments herein, the parties to this Agreement undertake to consult immediately with a view to adopting all appropriate steps to ensure respect for these commitments and resolving any such violations through peaceful means.

2: Such steps may include, inter alia, reference of the matter to the Security Council of the United Nations or recourse to the means for the peaceful settlement of disputes referred to in Article 33 of the Charter of the United Nations.

= Without the Paris Agreement and there would no UNTAC in Cambodia! It is funny how AH HUN SEN Vietcong slave government used UNTAC law to persecute Cambodian people such as Mr. Sam Rainsy? It is funny to me because AH HUN SEN Vietcong slave government never accept the role of Paris Agreement on Cambodian political settlement. And this is for the first time that AH HUN SEN Vietcong slave government acknowledge the role of the Paris Agreement !

From now on any time AH HUN SEN Vietcong slave government dare to use UNTAC's law and he must obey and respect the Paris Agreement down to the letter!

From now on any Siem and Youn violation of Cambodian sovereignty will be persecuted under the Paris Agreement!
