That’s what the prime minister cannot afford to have happen.” - Hang Chhaya, executive director of the Khmer Institute for DemocracyPHNOM Penh Municipal Court has issued a letter warning that opposition lawmaker Mu Sochua will be “detained by force” if she doesn’t pay a court-ordered fine within 10 days.
The Sam Rainsy Party parliamentarian has refused to pay the fine of 8.5 million riels (US$2,024) as well as 8 million riels in compensation – fees levied against her when the Phnom Penh Municipal Court found her guilty of defaming Prime Minister Hun Sen last August.
In the letter, dated yesterday, Deputy Prosecutor Sok Roeun ordered Mu Sochua to pay the fine to the treasury within 10 days.
“If [Mu Sochua] does not pay by the scheduled date, we will order her to be detained by force,” the letter stated.
Mu Sochua could not be reached for comment yesterday, but an assistant confirmed she had received the letter.
SRP spokesman Yim Sovann said Mu Sochua’s stance was intended to demonstrate “that the Khmer court is unjust and corrupt”.
Run Saray, executive director of Legal Aid of Cambodia, said it appeared the court was complying with legal procedures in enforcing the conviction.
“If you fail to pay, you could face a contempt of court order,” he said, and added that Mu Sochua could ultimately face jail time.
Such a scenario, however, would play into the hands of the opposition more than the ruling Cambodian People’s Party, said Hang Chhaya, executive director of the Khmer Institute for Democracy.

Instead, both sides might come to a last-minute arrangement that would allow Mu Sochua to avoid jail, he said.
Tith Sothea, a spokesman for the Press and Quick Reaction Unit at the Council of Ministers, said yesterday that Mu Sochua would not benefit from her own imprisonment.
“If she sees that imprisonment is her correct issue, it is her right. We see this as defiance, not as profit for the SRP.”

ReplyDeleteAbout court judgement, it is just shameful if government send Sochua to prison. It just show that government lack of law knowledge. If they are thirsty to get money from her, they can confiscate her property such as moto, car, house, and put in auction and take the amount stated in court judgement. That all they don't need to create big shameful reputation.
I believe not all khmer are stupid, but if Cambodian authority show action by bring Sochua to jail, it clearly that all khmer are really stupid.
At this moment, disgraced Mu Sochua and SRP stupid supporters can use USA and international community to scare to Cambodian government not to arrest her or say whatever they like but when the Court's order is expired in 10 days, it will be different story.
ReplyDeleteWhen you have stepped in any country no matter what you don't like that country's law or accused it's unjust for you, but if you have been fined by the Court, you have no choice but have to pay the fine or going to jail. This is a common practice for the rest of the world. Unfortunately, disgraced Mu Sochua thinks otherwise! She wants to change the world into her own way and keen to use everything to promote her political stunt. Will the government uphold the rule of laws or allow her gets away unpunished? We will see in the next 10 days time whether the law is strong or Mu Sochua is stronger than law???

There is nothing wrong with rule of law but in Cambodia people are not living under rule of law, but rule of bad people. Rule of Law is not for everybody in Cambodia, but only for rich, powerful people.
ReplyDeleteKhmer in Sydney CBD, who do you think you are? before you judge Madam Mu Sochua, you need to read and try to understand the full impact of how our khmer gov't did to Madam Mu and to our own people in general. Hun Sen has no right to judge anyone regardless of what condition he/she may be in. He started first in term of devaluing Madam Mu and when Madam Mu sued him, he back flip onto Madam Mu charging her on defaming him. What the hell? it is like " I am right and you are wrong, and I am big and you are small and there is nothing you can do about it". You see? this is called " use and abuse his power". Instead of promoting love and compassion for one another, he tents to promote war. He needs to learn about how to be an effective leader, you know the one that can be a good role model for our society, as not to be and oppressor but as a good moral leader. The leader that works for the people, with the people instead of against the people. In addition, good gov't tent to include as many qualified people as possible, the more interlactual people we have the better. In Aust, about 95% are educated people. We called our nation as the smart generation!. So, khmer gov't should be smarter by now in term of increase in professional background to help running the country. In Aust we have no time to critise but more time to help each other out to improve in commmunity development. we have what we called the "common goal and common interest" all political leaders working together to achieve this commonality of interest, that is zero tolerant for personal internal or external conflicts. Please brothers and sisters, try to learn from Aust and nothing will go wrong.
