Appeal Court to hold hearing in Sam Rainsy’s case on 09 August

The Appeal Court plans to hold its hearing in the case of Sam Rainsy and 2 other farmers one more time on 09 August after the court decided to delay its hearing scheduled for 06 July.

The Appeal Court plans to hold a new hearing on 09 August regarding the case of Sam Rainsy and 2 other farmers who were sentenced between 1 to 2-year of jail term by the Svay Rieng provincial court after they were charged with destruction of public properties and incitation to racial discrimination.

Next week’s hearing will be held after Sam Rainsy and the 2 farmers appealed the sentence issued by the Svay Rieng provincial court. The case was initiated by the Chantrea district authority, located in Svay Rieng province.

Choung Chu-ngy, Sam Rainsy’s defense lawyer, told RFA on 04 August: “I have prepared everything already to legally defend my client’s right. As a lawyer, [my client] is not involved in any crime as he was accused of.”

On 06 July, the Appeal Court held a hearing in this case once already, but it had to delay it when the defense lawyer and more than 20 SRP MPs walked out of the court room due to the absence of the two principal witnesses: the 2 farmers charged, Mrs. Meas Srey and Mr. Prum Chea who were not allowed to come to court to clarify this case.

Chan Sok Yeang, the government defense lawyer, added: “There’s no problem, I prepared everything already, i.e. the court sent the information to them and they have received everything already.”

Opposition MP Mu Sochua indicated that all SRP MPs will show up “to provide encouragement to the 2 farmers who were victimized by the court, a court that is used as a political tool [of the ruling party].”

Opposition leader Sam Rainsy was sentenced in absentia by the Svay Rieng provincial court on 27 January 2010 to 2-year of jail term after he was charged with destruction of public properties and incitation to racial discrimination because he uprooted stakes at border post no. 185 located inside the Cambodian village of Koh Kban Kandal, Samrong commune, Chantrea district, Svay Rieng province. The uprooting took place on 29 October 2009.

    The CPP clan better have a new hearing in the case of Sam Rainsy and 2 other farmers because any fucken border demarcation start at the fucken "white zone" or the "buffer zoner"! The fucken border demarcation doesn't start at the Cambodian farmer rice field!

    Without the rice field these Cambodian farmer will die! Is this the way AH HUN SEN do politic that is take food away from dirt poor Cambodian farmer and give it to the Vietcong!!!!!
