SVAY RIENG PROVINCE & PHNOM PENH—SVAY RIENG provincial court has found opposition leader Sam Rainsy guilty of racial incitement and destroying demarcation posts on the border with Vietnam, lawyers said. In a closed-door session on Wednesday, Judge Koam Chhean sentenced the Sam Rainsy Party (SRP) president to two years prison in absentia and fined him 13 million (around US$3,132), said Sam Sokong, the defense attorney of two villagers accused on similar charges.

“I cannot accept the trial today, because it did not take evidence and proof into consideration to find justice,” Sam Sokong said. “The court did not base its decision on the evidence.” He added that his clients – local villagers Meas Srey, 39, and Prom Chea, 41 – were also sentenced to one year in prison each on the charge of destroying public property and ordered to pay 5 million riels ($1,204) in compensation. Rights activists also reported that the three were ordered to pay 50 million riels ($12,048) for the removal of the border markers.

The charges stemmed from an October 25 incident in which Sam Rainsy joined villagers in uprooting six temporary border markers in Svay Rieng’s Chantrea district. Locals claimed they were placed in their ricefields by Vietnamese authorities. Sam Rainsy is currently in France.

Long Ry, an SRP lawmaker who attended the trial, also rejected the verdict, saying the proceedings were a farce. “The decision was prepared beforehand and everything was decided in advance. The court ‘acted’ very well,” he said.

But one government official said the criticisms were misplaced, since all Cambodian judges followed due process and adhered to the law. “Everyone has different ideas, but we have one law,” said Phay Siphan, spokesman for the Council of Ministers. “We have to accept the judge’s decision.”

    I don't know where are those judges got thier qualifications from but primary school student know what is right and wrong better than those judges. They all are Hun Sen dogs, when he throw the bones they will run for it. So cheap they are.

    Phay Siphan does not know or remember how Khmer Rouge killed people without giving them a chance to re-act. They killed Siphan's neighbors one by one and Siphan though that was OK but Siphan did not know when his turn comes.

    It's exactly the case. The powerful now sentenced Rainsy for crime he did not commit, but to save khmer land. Again, Siphan think it's OK. Who's next? pls, Siphan try to think. Do you remember Heng Pov?

    In Cambodian history from past to present...we continually have Cambodians who collaborated with the enenemies which resulted in the losses of Cambodian land. King Chey Chetta II allowed Vietnamese to live in Kampuchea Krom which resulted in the loss of the entire Kampuchea Krom to Vietnam. During the colonial era we had Aphaiwong family and Dap Chuon who joined Thailand which resulted in the losses of Battambang and Siem Reap to Thailand and were later returned to Cambodia in 1904-07 under French-Siamese treaty. Now we have M'siah Hyunh Xen allowing massive illegal Vietnamese immigrants to come and go as they please and allowing Vietnamese encroachments on Cambodian land. How can Khmer people allow Moronic idiots run the country??!! They must be brought to trial for treason and go to prison!! Based on history...one can say that King Sihanouk, Lon Nol and Pol Pot are patriotic, they safeguard Khmer land! King Sihanouk said that 'Yuon' are ingrateful alligators. Lon Nol and Pol Pot certainly did not like 'Yuon' as much as Huynh Xen!!

    The stupid king said he has no tie or involvement with politic. The comment is politically bias. When Hun Sen request the king to pardon the one time charged as spy at the Cambodian airport now is freed.

    When some or all members of SAM RAINSY Party requested the pardon from the king, the king said he can't get involve in politic. What a stupid comment that was.

    What about the fugitive of Thai (Thaksin)? Why did the king granted him a position by the request of HUN SEN??

    I CPP statesmen, am I proud today to see such a wonderful friendship and close tie by our eternal ally Hanoi.

    Today we share a victory. Nobody can take away the hard work our CPP has done to give Hanoi well wishes and heartfelt welcome, into our farms, rivers, lakes, or homes.

    I like to thank brother Soy Sopheap for his incandescent support of this Phnom Penh - Hanoi friendship in his news and criticism of all Khmers who do not believe in peace and harmony.

    I recommend brother Soy Sopheap for his faithfulness to dully apply for Vietnamese citizenship so he can travel back and forth and experience life as a new member of the Kampuchea Moi, new Kampuchea.

    We should be proud because we punished those Khmer who think their land come from their ancestors. If not for the January 7th, there is no land, no Vietnam no Cambodia.

    This is our stance as CPP, so therefore we will always gladly provide shelter and comfort to all and any from Vietnam.

    Khmer people have done nothing for the country, only the Vietnam soldiers and our great leader Hun Xen brought peace and stability, so we will not share it with Khmer who do not have gratitude towards us.

    this is called bias in the court of law as assumed by some above. in a fair and just of the court of law, only real evidence is used, not pre-judgment. where is the innocence until found guilty system? isn't that what cambodia adopted in the judicial system there? we have to wonder!

    Cambodia courts follow the Civil law tradition, so, in practice, the court operates much differently that common law tradition courts. The Civil Law courts are in most European Countries, most of S. America and Africa and well as Japan. Under that system, the heart of the prosecution is in the pre-trial phase which is conducted by the Investigating Judge. He/she can call the accused as well as witnesses in order for the judge to make his recommendation to the trial judge. The trial its self is not like a common law jurisdiction court. It will accept the finding and recommendations of the Investigating Judge, and evidence can be offered but rarely will the trial judge differ from the findings of the Investigating Judge.

    From 27th January 2010 onward, Xam Rainxy is a convicted criminal.

    It's so obvious for criminal, they have never admitted their crime but at the same time, they always try to say or show something to cover up their crime and get public sympathy but no matter what they crying out, no one is going to believe or take criminal's word seriously.

    Since Xam Rainxy has uprooting border markings, he is often said that he will take this border's issue to International Court, but so far, there is no International Court. Right now, through interview with Radio Free Asia, he is shameless mentioned about International Court again. When he will complaint to International Court?? As I am aware, International Court in Xam Rainxy's view could be in Beijing and the judge is former King Sihanouk.
