Judge denies request made by Sam Rainsy’s lawyer

Oeung Sieng, the investigating judge for the Phnom Penh municipal court, issued his official rejection to the request made by Sam Rainsy’s lawyer to set up a joint committee to survey the Cambodian-Viet border in Svay Rieng.

The rejection was signed by the judge on 11 May 2010 and handed over to Sam Rainsy’s lawyer on 18 May.

Chuong Chou-ngy, Sam Rainsy’s defense lawyer, said that the judge rejected his request to set up a joint committee to survey the coordinates of the Cambodian-Viet border posts no. 184 to 187 in Chantrea district, Svay Rieng province. The judge indicated that the request made by Sam Rainsy’s lawyer was not correct as the government already has a border committee and there is no need to set up a new border committee.

However, Chuong Chou-ngy said that the judge’s decision was not correct because he [Chuong Chou-ngy] wants to see the joint committee that includes all parties in the lawsuit case surveying the border posts that were the source of the lawsuit against Sam Rainsy, accusing the latter of involvement in this fake map. Chuong Chou-ngy said that he will appeal the denial decision made by the judge.

Along with the rejection above, Chuong Chou-ngy told reporters that the judge issued an order to Ky Tech, the government lawyer, to provide additional proofs on the location of the border posts in Chantrea district, Svay Rieng province. The judge also issued an order to the secretary of the national border committee to clarify about the exact coordinates of border posts 184 to 187.

At the beginning of April 2010, Chuong Chou-ngy sent two requests to the investigation judge of the Phnom Penh municipal court: (1) request the accusing party to provide the proof to the location of the border posts, and (2) request to set up a joint committee that includes all parties involved to survey the exact coordinates of the border posts in Chantrea district, Svay Rieng province. Sam Rainsy claimed that border posts 184 to 187 were planted on rice fields belonging to Cambodian farmers. Sam Rainsy provided several maps and documents to support his claims.

Ky Tech told CEN Online that he received the judge’s order already, and he will provide the provide the proofs to the planting of the border posts once again in one to two weeks time because he needs time to discuss further with map experts.

Ky Tech added that the request by Sam Rainsy’s lawyer to set up the joint committee, such committee would be very small and it could not cover the duty of the national border committee which is recognized by both the National Assembly and the government. Furthermore, such request would be contrary to the charges brought up by the prosecutor who accused Sam Rainsy of issuing false information and falsifying public documents in this false map lawsuit.

If found guilty by the court, Sam Rainsy could face 5 to 18 years of jail time in addition to the 2-year jail sentence handed down by the Svay Rieng provincial court on 27 January 2010 for his involvement in the uprooting of stakes at border post 185.

The Appeal Court will decide on the charges leveled against Sam Rainsy on 06 July 2010, Chuong Chou-ngy indicated.

    The Judge don't want to face the truth because it will be hard for him to do his job . If he goes along with the fact , it will go against his boss CPP . That judge is a piece of tool for CPP , just look at the way he is doing .

    Whose rice is that? Is it belong to Cambodia or to Youn? Why doesn't CCP use their brain to think about this a bit clearer? If this rice field belong to Young, no way that Youn let Khmer does the farm on their land, and if this rice field belong to Khmer it means that CCP is not cutting land for Youn?

    Why the post is in the middle of the rice field, how the border committee's work?

    A CPP judge rejected a proposal to find the truth about border encroachment by the Viets? How surprising! I never would have thought! Aren't those high-ranking officials supposed to represent the interest of Khmers? Well, maybe just this one is not. I'm sure the rest would not do anything to the detriment of Cambodia! I must be dreaming.

    What I'm wondering is Ah Mr. Ke banh tech has ever seen that soi l to see how far from VN bother?let forget about Mr. Hun Sen for now because he has only one eye which has been control by remote from Hanoi. Or possibly ah Ke banh Tech from VN as chomneanhka and did not go back.A lots and of them just like that they move from place to another. They learn khmer.z
