Cambodian Activist Chooses Jail in Standoff with Prime Minister

To be a critic of the Cambodian government is difficult and, sometimes, dangerous work. But to be a female activist is even more challenging in the male-dominated society. Mu Sochua, an opposition party parliamentarian, is one of the country’s most powerful women. She is now counting down the days until her arrest on charges of defaming Prime Minister Hun Sen.

Strong legs

It all started when Mu Sochua sued the prime minister for defamation. Last year, Mr. Hun Sen called Mu Sochua “cheung klang,” which means strong legs. Mu Sochua says “cheung klang” was used in a disparaging way to disrespect her gender and intimidate the opposition. She sued him for the equivalent of 12 cents in what she called a symbolic protest. The prime minister responded with his own defamation suit, alleging that her lawsuit unfairly disparaged him.

Cambodia’s courts struck down Mu Sochua’s case but upheld the prime minister’s. She has until July 15th to pay about $4,000 in fines. But she says she would rather go to prison.

“It is my conscience that tells me I have not committed any crime. It is my conscience that tells me that we have to stop living in fear, and fear of one man who has ruled Cambodia for over 30 years,” Mu Sochua says. “And for me, it’s a gender issue as well. Because if I allow it to happen, if I pay the fine, what does it mean to the value of women who represent more than half of the people of Cambodia?”

Women's rights

Mu Sochua was not always a member of the opposition. From 1998 to 2004, she served in the government as the minister of women’s affairs. Since then, many more women have joined the government. Mu Sochua says the social image of women has improved somewhat, but that the changes have not been institutionalized.

“The women who are elected from the ruling party, the party of the prime minister, unfortunately do not serve their constituency because they serve their party first,” she says. “Which means that they don’t challenge, they don’t monitor the implementation of the laws.”

Mu Sochua says she is unwilling to stay silent while Prime Minister Hun Sen intimidates the Cambodian people, including those in his own party.

“It’s not about me and the prime minister,” Mu Sochua says. “It is about the opposition party making all its efforts to fight a prime minister who acts as a dictator. And it is about time to make a move for change.”

Detention

Authorities have not said how long Mu Sochua would spend in prison if arrested. She says she is mentally preparing to be behind bars for six months. Her case is not unprecedented. In 2005, several human rights activists were also jailed for defamation but released in less than a month largely because of international pressure.

The world may be watching Mu Sochua’s case, as well. The Cambodian parliamentarian is a Nobel Peace Prize nominee and a U.S. citizen. But she says she is not using her status to try to avoid arrest. She says if going to prison will help illuminate Cambodia’s problems, then she is willing to do whatever it takes.

Western nations often raise concerns about democracy and human rights in Cambodia, but critics say they do not do enough to hold the Hun Sen government accountable. In June, foreign donors awarded Cambodia more than $1 billion in development aid on the same day the Supreme Court upheld the prime minister’s case against Mu Sochua.

    MP Sochua will be the next Prime Minister because she uses her Cheng Khlang to kick ah Khvak SenVietman head out of the corrupted Youn puppet office who only know how to serve his boss so well by killing or torturing our Khmer patriots. We Khmer needs to rally our support behind MP Sochua "If she goes to jail." Remember: she speaks for us and we need to help her out and vote for the next premier of Cambodia that way our motherland (by nature of the word) will lead by a lady who purely loves her own citizens and knows how how to defend her from ah Youn and ah Siem leeches.     Good gov't never jail their activists but to include them, so that the gov't itself can see a bigger picture about what else needs to be done for its nation and country. Now who would eliminate educated people?, no one in the world accept Pol Pot regime. Why? because he was listening to the outsiders to eliminate its own society from their existence, in doing so is for the perpetrators to get what they want, e.g Viet get some of our land, chiness got to sent their people or army to control khmer or Thai can get part of it as well and then leaving khmer with nothing but ruined. So, wake up Hun Sen, don't abuse our owncitizen and let others enjoy the benefit of our conflicts, pain and sufferring. Please try to be smarter than Pot Pot. I can see that you have done alot for our people and our country starting from the year zero. Off course, you have done a good job but the only thing that you are lacking off is uniting our citizens as whole to have a common goal and common interest. It is right for an opposition leaders to debate based on what else need to be done for our society. Unfortunately, sometime things gone wrong in term of personal conflict in which could be avoided however least we can do is learn from it. So, please let make peace and not war. Please include all women to have equal right and equal power to have a say. It is this simple, let just say "let forget about our personal conflicts and let move on toward serving our nation". Here is a good start and also a good role model for our nation to learn from our own mistakes and also to learn to forgive one another for the best outcome. Again if khmer don't love khmer no one in the world will. Aust

    how long is the jail terms? maybe she'll come out of the jail as a real heroine which makes her even more popular to stand out in khmer society. the key to keep making voices heard both in cambodia and all over the world as well. if that lady in burma can do it, so can ms sochua. i think she'll have lots of supports as she seemed well known already.

    At this moment, disgraced Mu Sochua and SRP stupid supporters can use USA and international community to scare to Cambodian government not to arrest her or say whatever they like but when the Court's order is expired next week, it will be different story.

    When you have stepped in any country no matter what you don't like that country's law or accused it's unjust for you, but if you have been fined by the Court, you have no choice but have to pay the fine or going to jail. This is a common practice for the rest of the world. Unfortunately, disgraced Mu Sochua thinks otherwise! She wants to change the world into her own way and keen to use everything to promote her political stunt. Will the government uphold the rule of laws or allow her gets away unpunished? We will see in due course whether the law is strong or Mu Sochua is stronger than law???

    Khmer in Sydney CBD ignores the fact that the Court in Cambodia is CPP court. Judges are appointed to serve Ah Sen Khvak. So whatever Ah Sen wants his court will make sure it happens. In this case Ah Khvak wants to strip the opposition impunity and send her to jail so she cannot practice politics against his boss ah Youn who uses him as puppet. Don't iognore the big pictures. Cambodia has no inedependent court system and the constition has been changed to serve the CPP purpose, not the people. Therefore, Cambodia is ruled by dictatorship style. Not democratic. That's why MP Sochua refused to pay the stupid fee to feed the corrupted judge CPP for ah Youn Puppet. This is an act of not giving up the principle, not defiance to the law. It's lawless, dude.
