Verdict short on justice but a good beginning for next time

Dear Editor,
"My request is that once the trial (exercise) is over, all these pathetic old men (and an old woman) should be either set free to roam the streets of Cambodia or else be sent to a good old folk’s home in China to live out the rest of their lives freely."
First of all, Duch’s recent conviction and sentencing to 35 years imprisonment by the Extraordinary Chambers in the Courts of Cambodia represents a day of reckoning for many.

At least one of our former tormentors had, at long last, faced the docket in a relatively fair trial.

Duch’s case also represents a minor yet invaluable test for the ECCC, which was made much easier by Duch’s willing cooperation – hence the reduction in his prison term to just 19 years.

Suffice to say, Duch is only a “small potato” or a “small fry”, one of about 120 or so who should be prosecuted as well.

Indeed, Duch is only a scapegoat for countless other of his former comrades.

It is impossible (and also impractical) to prosecute them all, due to the lack of resources, and more importantly, due to the lack of political will.

Still, Duch only has to serve approximately 11 minutes for every single life he had directly and personally murdered (reportedly 14,000 to 16,000 lives, if not more, snuffed out). Duch is expected to serve much less time in prison, assuming that he will get time off for good behaviour, a very good chance for this convert to fundamentalist Christianity.

So we may see Duch on the street, among all of us, sooner rather than later.

That’s a reality – not justice. It’s a slap in our face, to state it simply.

This is one (of many) reasons why I personally did not file a complaint application to the ECCC’s Victims’ Participation Unit.

It would have been a good exercise and might have even made me feel just a tidbit better, as a survivor.

Still, half-full is better than half-empty, right?

It was still a very good day for humanity, all things considered.

Realistically speaking, Duch may sooner or later face street justice (or, the people’s court) in Cambodia.

Regardless of the countless flaws, Duch’s trial was a good exercise and a warm-up for the next case, involving much-higher ranking policy makers during the Democratic Kampuchea regime.

This next case will be a much bigger test and a challenge for the ECCC. It shall make or break the ECCC with its complicated and relatively pricy processes.

My hat is still off for the ECCC and its dedicated staff.

It was Joseph Stalin who once said, “Kill one is murder, kill millions is only a statistic.” My nine dead family members and millions others are simply a statistic. Really?

Lastly, I have only one simple request, as a victim and a survivor (and a somewhat devout Buddhist).

My request is that once the trial (exercise) is over, all these pathetic old men (and an old woman) should be either set free to roam the streets of Cambodia or else be sent to a good old folk’s home in China to live out the rest of their lives freely.

No sense in keeping the old folks locked up in prison (a waste of Cambodia’s limited resources) since there is no death penalty.

    agree, considering that this is the first time a court like this exist or created in cambodia. of course, it has to be improved for the sake of justice and fairness to the KR victims and survivors, etc... we all can learn from our mistakes or trials and so forth...

The many lives that have been taken under Khmer Rouge is not and will not be taken lightly, because we are talking about close to millions lives that were perished under this evil regime.     From a simple gesture made by Aki Ra whom was once a Khmer Rouge due to his younger age and lacked of life experience, thus he has no choice but to join the Khmer Rouge and has been indoctrinated to by ill minds of the regime leaders and led him to lay all these mines in Cambodia. No one can blame Aki Ra for joining the Khmer Rouge, it was a choice with choices. This has clearly shown that Cambodia was once a dangerous place in a dangerous time that led to the atrocity since Hitler Days against the Jews. But questions remain to be illusive as to whom invented these mines, bombs and other life threatening pieces of destructions, and brought into the gentle land of Cambodia. Cambodia is not a country that has a capacity to invent such destructive objects that can kill. Cambodia is a country that believes in Buddhism, to say that this country is a country of evil and killed all these lives and to blame Cambodia alone is rather ludicrous and insane and that perpetrators are still on the loose. No one dare to look into China, US and Russia which were the countries that have the capacity to invent such objects that can kill, having said that, it leads us to the Trial of Khmer Rouge. The entire regime rest assure on one man and his name is Duch or Kaing Gek Iev. How can one man did all these killings when he was just a prison guard. Who gave the orders to kill? What crimes have these victims done against the state that deserve such torture and suffering and severe punishment that no one had ever seen in history of mankind? Where did the Khmer Rouge get their method of killings from? Who show Khmer Rouge how to kill? What purpose behind these killings? Who will gain from these killings at the end? There are so many questions that must be answered and yet, there is only one man to be convicted at the end. How can one man get 35 years and now reduced to 19 years sentenced be equal to 1.75 millions of lives that this regime has destroyed? Millions of dollars have been spent, many effortless hours have been put into the process, not just in Cambodia, but the across the golbe. There has to be more than a one man show. Why Duch? Why Kaing Gek Iev? Why him and why now? What about Khieu Samphon? What about Noun Chea? What Khieu Khanarith? What about Sihanouk? What about those that we dont know about that are still alive today? At the end...the life of one Khmer do worth nothing, when Angkor was such a great legacy to all who are known as Khmers and live in one of the greatest Empire of its time.

    Thank You. My tears have been shed and my blood has been spilled. Along the way I have lost more than 20 members of my relatives, but above all what is really precious to me, it was time and education to which that I have lost during my younger days.

    Cambodia, my country, I will make a vow to you that one day I shall return to lead you before my days are done.
