Mu Sochua still maintains that Hun Xen defamed her

Kampot SRP MP Mu Sochua showed up at the Appeal Court to clarify her lawsuit case in which she accuses Hun Xen of defaming her.

At the court, she still maintains that Hun Xen defamed her in a speech he gave in Kampot on 04 April 2009.

The new claim made by Mrs. Mu Sochua was made in front of Appeal Court Judge Uk Savuth in the afternoon of 02 October 2009, when Mrs. Mu Sochua was summoned by the court in relation to her lawsuit against PM Hun Xen.

Her original lawsuit was dismissed by the Phnom Penh municipal court in May and the court claimed that her lawsuit did not have the proper legal weight.

However, Mrs. Mu Sochua was not satisfied with the ruling of Phnom Penh municipal court and she also asked that the court review the case of the defamation lawsuit brought up by Hun Xen against her recently.

Following a 1-hour clarification at the Appeal Court, Mrs. Mu Sochua, a MP who lost her parliamentary immunity, told reporters that she maintains her claim about Hun Xen’s speech as aiming at her and it affected her honor as a Khmer woman.

Mrs. Mu Sochua also demanded that the Appeal Court hold a hearing to decide her case in conformance to Article 63 of the UNTAC criminal law regarding the defamation made against her that affects her honor and her good standing.

In the morning of 04 April 2009, during a speech made in Kampot province, Hun Xen said, without naming her, that a woman in Kampot who is a “Cheung Khlang” (thug) in the fight against land disputes, ran to hug someone, then she turns around and accuses that person of unbuttoning her blouse… Mrs. Mu Sochua claimed that Hun Xen’s speech was aimed at her and that it affected her honor as a representative of Cambodian women, as well as a MP.

Because of her daring to sue Hun Xen, Mrs. Mu Sochua was in turn sued back by Hun Xen who accused her of defamation against him.

On 04 August 2009, the Phnom Penh municipal court handed down its verdict and imposed a fine of 16.5 million riels ($4,100) on Mrs. Mu Sochua and decided that she lost her case against Hun Xen. This case has now reached the Appeal Court.

    i think srp and their small group of extremists are bias and racist against cambodia and our khmer people in general. imagine if they were in power, cambodia would not be as developed as we are today. that's a scary thought to think about it because they seemed to wan to keep cambodia and our khmer people in the dark so they can easily rule over ignorant population, etc... that's how they have always done it in the past. thank god, cambodia has changed and had come a long way since... of course, they are ex-elitist who real motive, believe it or not, is to suppress and keep cambodia and khmer people igorant forever so they can dictate to them what and how they want things to run the way they wanted it in cambodia because a lot of time they forget that there are more to cambodia than themselves or their types, really. i'm glad khmer people are adopting and educated now to think differently from them. god bless cambodia in many way. thank you god.

    All of you must be idiot to say that Hun Sen is a good leader. I cannot even stand to see his ugly face and his communist voice in the radio. He is no different to any black shirt khmer rouge soldier at all.
    At this moment, we need leader with high moral and high integrity to lead the country to real peace and real development so that Cambodian people can live in prosperty and harmony. At present Cambodian cannot even afford to clean and safe drinking water and let alone for a real development.
    We must understand the real Development.
    1-Building a dynasty
    2-Building a country
    3-Building a Nation
    Cambodia is at present in the process of building Hun Sen dynasty and selling the country.
    Building a country is very easy by selling the country and develop the cities and roads to benefit the overseas people by the sacrifice of Cambodian people.
    But for building a Nation, we really need a good leader who care about their own people. Everything must for the benefit of Cambodian people.

    Had we already do away with this backward thinking honor face saving crap law, there would not be people running around suing each other and putting the country in a legal mess when it needs to be dealing with more important issues like immigration, border, education and infrastructures.

    You are public officials, if you can't take a statement about your incompetency then go back and work your farm where you are most competent and everybody can praise your there.

    Don't use the law to hurt other and when they use it back you send them to prison.

    How is that the law? Are we still living in dark absolute power and no public servanthood nation anymore? Oh why did I say anymore, we never had any, in our history, a regime that serves the people honestly!

    SRP supporters keep accusing Hun Sen of being power hungry. How about Sam Rainsy? If Sam Rainsy is not power hungry how come he is still opposition leader despite his party have not gained more support from the poor and the intellectual? In the West, he would have been replaced by a new/younger leader long time ago!

    Many Cambodian are still cannot understand what different between leaders who wanted to Build their own dynasty, their own country and their own Nation.
    1-A leader who wanted to build their own dynasty:
    Look at North Korea, Burma, Cambodia, Zambawe ( Mogabe ). These leaders do not care about the well of their citizen at all. He wants to be leader for the rest of their lives and then transfer the position to their children. They don't want to pay good living salary to their public servants. They only wanted to pay to their bodyguards very well to intimidate other. All their citizen and tehir countrymen will live in poverty, fighting to each other, killing to each other. They don't care to build a good system for their young generation. They lead their country under a pyramid system by appoiting from top level to groun level. They use their citizen as a milking cow to work for their family and their dynasty.
    2-A leader who Build country. This leader is no different to the first group. They sold their country to all investors without considering good or bad impact to their country by the expense to their own citizen and their fellow national to make themselve rich
    They don't care the wellfare of their citizen and their public servant as long as their family can rip off from the system.
    3-A leader who is truely building a Nation is totally different.
    We can find these leaders in many civilised Nation such Australia, New Zealand, USA, China, South Korea, Japan, France, England, German, Russia etc.. and etc... In these countries, we can see their population are very happy citizen with good education, good healthcare system, good socitey.

    To clearly see defamation law applicable or not, we ought to distinguish between private affairs and public affairs.

    private affairs: any matters or properties of individual are classified as private.These matters do not affect others and neither be affected by the others.
    Says,Mr A is having an affair with Ms K with both agreed to, is considered to be private.
    In reality, what was said about Mrs Mu is perfectly private,where the line or law is crossed.

    Public affairs: These matters are belonged to collective groups, companyor states. Office bearers are obliged to response to any query in relation to events, matters,properties belonged to collective enterties as such. For instance, anything is said about managing affairs of Samdach Hun Sen in relation to states, he is obliged to response under duty of care.Says, corruptive acts or any abuses or defending country and people promptly is his obligations as a temporary office bearer.

    It appears to be either confusion or manipulation/distortion over these above matters. And so many exercise power (public power) to cross the between line),so called abusive power in order to serve individual goals or profits.

    It is frustrating to see grown up to wrap themselve with child acts.

    People are to be bornt for free and free speeches. If you don't like to criticise, you shouldn't offer yourself as a politician. All Politicians are to be scruitineered by all public for all your behaviours and your actions.
    Why they don't call hun sen as extremist when he paid all Cambodian Doctors for US$ 50 per month? My son is a Doctor but he earn $ 100 per hour. Why they don't call this Hun Sen as extremist when he paid National school teacher $US 30 per month and a factory worker is paid US$ 50 per month?

A doctor in US has an annual salary of $500,000 dollars and more per year, depending on his specialty. A doctor in Europe earns less than half of that amount, and a doctor in Africa earns on a small fraction of that amount. Next time, try to be a bit more competent than the CPP officials whom you accuse of incompetent.

    Hun Sen and Hun Sen supporters always think that Hun Sen is up to the job as PM of Cambodia and without him to lead the country, Cambodia will not be sustanable. This is the logical thinking of a dictator. However, Hun Sen and his supporters should know that for a country that lead by the same leader for 30 years, begging to survive for 30 years, and people standard of living is no better during that 30 years period then, that leader has a performance issue. As such, change of leadership is needed to better off the country. If Hun Sen is a true nationalist he should step down and have someone else run the country.

    All political leaders need to separate between perosnal conflicts and the job that they suppose to do! They must learn to ignore all personal conflicts because all personal conflicts can affect the future of governing the country. They need to be more focus on what else need to be done, like,community development. I think our gov't still have lack of ministers cooperation like; education minister, human service minister, road engineering minister, maybe 20 plus more minister in different field...or otherwise if not enough head ministers, will be losing control of whom should be responsible for what? we also need a watch dog, complain centre to deal with all sorts of illegal allegations...

    hey, the fact is cambodia is not as bad as some extremist people painted it to be, really! wake up, people, get rid of that boring outdated thinking of some of you. aren't you realized khmer people in general are getting bored with your unfounded, politics bias, fear, ambition, etc? people are indeed get bored with it, believe it or not. things are a lot different now in cambodia and will continue to improve more and more, really. some people need to be patient for a change. of course, we all wanted cambodia to improved and become better in all field, however, sometimes, people are having too much wishful thinking and forget to do reality check. what about the ability of cambodia? if some people keep on making trouble, how are they supposed to expect a smooth ride into transformation for cambodia. i think some people who fight too much are not really smart in their ability to lead cambodia. they often forget that there are more to cambodia than you and i and more, really! don't we all have to draw a line, sometime? wake up, people, be clever and educated for a change, ok!
