Sam Rainsy Summoned by Svay Rieng Court

Svay Rieng provincial court has issued a summons to opposition leader Sam Rainsy, who is facing charges for allegedly leading a group of villagers to pull up demarcation posts near the Vietnam border in October.

Sam Rainsy has been asked to appear on Dec. 28, according to a summons issued Wednesday and obtained by VOA Khmer.

Sam Rainsy, who has rejected the case as politically motivated, had his parliamentary immunity suspended by the National Assembly in November, paving the way for investigations into the allegations by provincial court officials.

“I issued a summons yesterday,” investigating judge Long Kesphirom told VOA Khmer Thursday. He declined to give more details.

Reached by phone in France, Sam Rainsy told VOA Khmer he had not been given a chance to defend himself, and that he was meeting with villagers as their parliamentary representative when they complained of Vietnamese incursion onto their land.

“But it was not so, and now the authorities have issued a complaint against me instead,” he said. “They can do whatever they want. I don’t care, because the court works for the powerful and the ruling party, and not for the national interest.”

The court case and suspension of his immunity have been criticized as a wider government effort to crack down on dissent, following the jailing of an opposition-aligned journalist earlier this year and a defamation suit brought against Mu Sochua, an SRP representative for Kampot province, by Prime Minister Hun Sen, in April.

    Sam Rainsy should care because there are many people who are left behind in Svay Rieng. Those people, who went to the rice field with him, have no country to escape to nor do they have any privilege to say "no" to the Cambodian court. A statement like this doesn't help him.

She is brave. She deal with Hun Sen not only Svay Rieng court. So Sam Ransy should come and defend himself in infront of the one eye stupid court.

    meas duc tho, Mr Sam Rainsy and his supporters work for the nation as a whole. Rainsy cares about his country, his people and his welfare. Leadership of a country is about the whole ountry, but not just a group of people. national interest, that is what the SRP stands for. You are talking the CPP language here, care only for the CPP supporters, I can see that, that 's why all the CPP people are left to eat and shit on the country's resources to extinction. Nothing is left in cambodia now.

    The way your CPP is running the country will see it disappear - Khmer people becomes a nation of beggars and minority in their own country.

    I rather see Cambodia become another Burma because there is no yuon behind Burma. But you can't say the same thing about Cambodia and Laos. That is why no one can compare Rainsy to Aung San Su Kyi.

    You stay alive to fight for your country another day. Remember when the Khmer resistance adopted this strategy fighting the yuons in the 1980s ? If you have no military to confront them, you have to be smart. What you are advocating is trapping Sam Rainsy for your own yuon master, like you did to Hem Krisna and other resistance groups in the country when your yuon masters were invading and occupying us.

    We know your trick too well by now. That is how we Khmer have survived and exist to these days.
    Otherwise we would have become another Champa and Kampuchea Krom long ago.

    If you check my Blog, you will know the reasons why I disassociated myself from HRP.

    It was one of the biggest mistakes I made in my life and I am not ashamed to say that. Sometimes we need to learn it the hard way.

    I hope you don’t mind hearing some opposing views from Chhim Wat Koh.

    For those who are not familiar with the term “Chhim Wat Koh,” it is a humiliating and offensive term used to refer to an underprivileged person who supposed to be poor and unintelligent and lived in Wat Koh (a Buddhist temple in Phnom Penh.).

    In democracy countrie you have court system that run by educated and professional judges,lawyers,prosecuteors but Cambodian court is running by a bunch of thugs who know nothing of rules of law, but corruptions and Viet thief subservants. This is known as Kangkaroo court.

    I expect the foul languages to come from some members of the CPP, the ones who is supposed to be labeled as un-Khmer. But, I don't expect such words from members of a party that supposed to be better than the CPP, a party that have such a great motto... SRP is not just any party, isn’t it?

    I was "duped" by the so-called experts in Cambodian politics. I believe that those people have no business in making a living on the pain and suffering of poor Cambodians. It is bad enough that poor Cambodians have lived under severe oppressions for so long, if someone doesn’t intend to save and serve the interests of Cambodian people, they shall not be allowed to keep on cheating the public.

    I stopped my association with certain political party for this reason and I will continue to speak my mind to help stop the abuses. I rather go to hell for quitting supporting the evil rather than keeping on helping them to suck Cambodian people’s blood.

    About being a Cambodian political cemmentator? No, thanks. I will keep my daytime job.

    I live in America and I am so frustrated with the corruption and the injustices that is being served on a daily basis by Hun Sen and the CPP! We, the ones who can speak out and act on behalf of the poor and helpless in srok Khmer, we have to unite and work together to make this change a reality. The current government, the leader's number 1 priority is their own personal gain! They have no concern for the welfare of the Khmer people or for the future growth of Cambodia. It breaks my heart to see the Constant injustices and the abuse of power Committed by these traitorious men, who have no right to be in power. Hun Sen and his thug of a party have so much blood on their hands, how much more suffering can the Khmer people endure? We have to take action now!

    3:20PM, I also grew up in America and I totally agree with you. I felt the same way. This is why I support the opposition.

    If you want to help the least you can do is write letter and continue to encourage others to also write letter to US and UN Representatives. This will help to raise issues and to get their attention on Cambodia. We need international help because our government is destroying our people and nation.

    I read the letter you wrote to the United Nation, in Washington D.C. in regards to the land grabbing/forced eviction and all the atrocities committed by Hun Sen and the Cpp. I was very moved by it and I am greatly motivated to join your worthy efforts.     To Misters Chhim and Meas,

    Please note the following points.

    1. Mr Hun Sen and his fellow leaders ran away to Vietnam as well, and they did not return until they got Vietnamese escort. At the time they probably felt that they would face certain death if they returned- the same feeling that Mr Rainsy has now, I presume.

    2. Regarding name callings. I agree with you that some supporters from BOTH SIDES, ought to take a few deep breaths before contributiing their comments. But, after seeing one injustice after another for years and decades, I hope you can appreciate the opposition supporters' frustrations. Also, the name-calling coming from supporters are just that- name-calling. Apart from a few egos brings bruised by it, no physical harm has been done. Contrast that with the physical intimidation, wrongful jailings, and deaths in Cambodia, you would agree that name-calling is somewhat insignificant. Anyone not prepared to cop a few ugly comments, should not be contributing to websites like this at all. As I have observed, there have been many calls by opposition supporters for some hot heads to refrain from using foul language, but none has come from the CPP supporters. Perhaps they are all saints and never joined in such practice.

    3. As for Mr Sam Rainsy not returning to Cambodia, this world has proven that leaders live to fight another day, while their supporters suffer. Nelson Mandella was the only one to turn the tides from a jail cell, but even while he sat in jail his suppoters where beaten and killed by the hundreds, if not thousands. Aung Sang Suu Kiy, considered by the world to be the leading light of democracy in SE Asia, is powerless after many years under house arrest. I doubt if the government of Cambodia will be satisfied just to put Mr Rainsy under house arrest. As far as I know there are many young people now in Vietnam who cannot get any government job because their parents or grandparents supported the South Vietnamese government during the war. As for facing the Courts with evidence, since when did the Courts in Cambodia put evidence and facts before party lines and power? Would Cambodia be in the situation it is now in if all arms of the government obeyed evidence and facts? Let us say that Mr Rainsy returns to Cambodia to face his accusors. The same people who are calling him a coward now, will find a reason from somewhere to label him a traitor and hang him from the first tree they see. What then? The CPP will find some "yes men" to install as their opposition, just like the Youns have installed the CPP as the "government" of Cambodia. The injustices, corruption, extra-judicial killings, acid throwings will continue. So yes, Mr Rainsy should live to fight another day. His supporters who are being called to courts (by the way, what is happening is blackmail by the CPP)will be supported by SRP MPs in Cambodia. And if they understand politics at all, they will understand his situation.

    That's all I have for now, gentlemen. I am sure you will have a few choice words for me. Fire away, just not literally please. After all, we are all Khmers

So far, Hun Sen and his admin have never been taught a lesson by UN regarding a series of law suit against opposition member parties, human rights abuses, land forced eviction, and so on.. How much longer will we let the thugs keep abusing khmers and khmer nation? Put the STOP to this or will never. The US toppled Sadam Hussain and who can get rid of Hun Sen?     Let leave politic aside and get to real facts on this issue.
    The border posts that Mr. Sam Rainsy uprooted were planted by the joint border commitee of Cambodia and Vietnam. To legally uproot those border posts can only be done by joint border commitee of Cambodia and Vietnam. Or by approval of both government.
    Mr. Sam Rainsy is a law maker not the decision maker of both border commitees or the decision maker of both governments. Mr. Sam Raisy by uprooted those border posts and incited those people to uprooted those border posts, he commited crime. Since he is a law maker, I believe he should come back to pay for what he have done. If he don't come back to pay for what he have done, it show that he doesn't care about rule of laws.

    It seem that all oppositions used the terms the Court of Cambodia is not independent as their excused to not show up in their defend. Look the court is open to the public when they heard cases. Alot of international observer and reporters there to witness. Could it be that the oppositions afraid of the real evidences which proved that they are quilty. So in any court of laws in the world, if you don't show up to defend yourselves, you will get guilty verdict, and don't blame the court if you don't show up.

    The term use for Kangaroo court is politically and practically corrected. Yes, Cambodia does have all kind of laws but no one care and enforce the laws particularly the rullers themselves that abusing the laws. What good are the lawyers in Cambodia when they can't practice their knowledges to full scale and completely controlled by the rich and the powerful. I do believe Mr. Sam Ransy learnt his lesson by refusing to attend the court since the Cambodian court is only for Kangaroos.

    There are 4 scenarios for Xam Rainxy's immediately future:

    1. He is staying in France as he was before jumping into politics in Cambodia (go back to square one).
    2. He goes to Thailand and ask his ally (Democrat party) to appoint him as economic advisor to Thailand's government and use Thailand as a base to attack to Cambodian government.
    3. If he's a brave man, please come to face the Court in Svay Reang and prepare to accept the verdict as most people do. Don't be afraid to go to jail if he dared to commit the crime.
    4. Waiting in France until the Court issued the verdict, if he was found guilty, he will bow his head to the ground and write a sweet letter to "APOLOGY" to PM Hun Sen as well as government, please let him come back to Cambodia to continue his political career likes PM Hun Sen forgave him in 2006. Xam Rainxy will use the word "National Reconciliation" as a pretext to save his coward act and ugly face.
