"What Is the Kangaroo Court Waiting For?": Sam Rainsy

WHAT IS THE KANGAROO COURT WAITING FOR?

Mr. Pao Pheap, 40, second deputy chief of Samraong commune (Chantrea district, Svay Rieng province) from the Sam Rainsy Party has been summoned by the Svay Rieng Provincial Court to appear before a judge on 22 December 2009. The summons is in connection with the “incitement” and “public property destruction” charges that the same Court has levied against me following the 25 October incident in Samraong commune’s Koh Kban Kandal village where I uprooted six wooden poles in the middle of a rice field at the request of its owner. Those poles purported to be tentative border posts but were actually false boundary markers illegally planted on a private property.

Why hadn’t the Court summoned me first? As the main “suspect” or “accused” of an obviously political crime I should be the first person to be summoned and interrogated. Why judicial proceedings to “punish” me have come to a standstill? Why the CPP-controlled authorities were in such a hurry to remove my parliamentary immunity on 16 November without first asking me any question? Why is it so quite now? How much time do they need to continue to test the waters? Is it so embarrassing for them?

I want their kangaroo court to prosecute me now.

    Every time the border encroachment issue arises, the CPP leadership is quick to deflect public attention and Opposition criticism from its dubious and collaborative role in this sorry saga. Instead of debating as to which map is more appropriate for demarcation purposes, or why Opposition critics have not come up with a more viable map of their own, if the latter are not happy with the work of the border committee and so forth, why not allow the whole process to be scrutinized and assessed publicly and transparently? Who would lose out from such an open, democratic vetting? Not the Khmer people or the nation, surely? At the very least, owners of the land in question themselves should be fully informed of the committee’s relevant plans and procedures, their express consent should be sought prior to any joint decision being taken to carry out the committee’s work.

    What if the border committee itself is being led by technically incompetent individuals or its chairperson? One hears VN has even offered to train Khmers on border mapping. No prize for guessing what manner of knowledge would be disseminated to the students here.

    On the other hand, the technical nature and complexities of border mapping has frequently been used to bar and rebuff critics from gaining inroads into the committee's work. However, even this would not matter too much were it not for the fact that national integrity is at stake, and rice farmers' lands are being threatened.

    Up to now, no villagers have lost their land? Really? Khmer farmers along the border with VN have been reported to have been forcibly removed from their ancestral land since the early 1990s and beyond. It is a slight blessing that this latest incursion into Khmer land comes in the form of wooden stakes (which are illegal objects planted on private property), and by themselves these poles may not seem a great deal, until, that is, one recalls the incremental and insidious practices of Vietnamese expansion of past and present:

    • First, establish legal-physical presence in the given territory tentatively, either by means of leasing or temporary holding.
    • Second, populate the land with labourers and provide them with the necessary economic incentives to work it and derive long-term self-sufficiency from their occupation.
    • Third, provide the occupiers with arms and security protection in event of their lease being revoked. These stages would then be repeated elsewhere until new territory is fully acquired and entrenched under state protection.

    Attention should also be given to other remote border regions such as Rattanakiri, Mondulkiri, Krati (Kraches) and KP Cham, where there might not be farmers to cry foul.

    As usual, it is not so much what has been agreed on the map as such that matters, but rather it is these moving realities on the grounds that really count.

    Mr. Sam Rainsy said that he is a Member of Parliament of Cambodia, then why he is not in Cambodia?
    The Parliament only lifted his immunity so the law inforcement can investigate his above the law act of incitement and public property destruction not prohibit him from doing his duty as a member of Parliament. May be he is coward to face the truth and let the people he incited to commit the act to pay for his action.

    According to sources in Phnom Penh
    speech ceremony said, Hun Sen will not allow Sam Rainsy to return to Cambodia. Sam Rainsy must face criminal trail and serves time in Prey Sar at least 10 years before he could run the public office again.
    Some of his followers start defect to CPP more and more every day for their safe and to avoid Ghos flag hanging in front of their house.
    Hun Sen Added today at the speech ceremony "Sam Rainsy's political life is over or finished in Cambodia".

You may have closed off your ears back then. the SRP did urge the hunh xen govt to seek international support in finding the resolution to the preah vihear saga from the start, but it was hunh xen that kept changing his mind, yes, no, no, yes, to te tune of the siams.     You said, the court is not independent. Look the court is open to the public when the case is heard. Why don't the accused show up and defend them selves and if the evidences are in favor of the defends and the court still charge the defends as quilty then you can blamed the court. But if you don't show up don't blame the court, because their are alot of foriegn observers including reporters are at the court when the cases are heard. So proved to them that the court is not independent by show up to defend yourselves. Because in any court of laws in the world if you don't show up to defend yourself then you are automatic quilty period.

    Let understand the situation if there is a potential lost of Cambodia soil to Cambodia's Neighbour whether Vietnam, Laos or Thailand. The people of Cambodia should be inform about it. An the government of the day have a duty of care to check and ensure that it has been implemented correctly. An if not they should take quick action to audit and correct it accross our boarder. It is Sam Rainsy job as Opposition leader to inform the government. Plus it was a temporary board posts the CPP government acknowledge these, so Sam rainsy is not doing anything wrong. If he were to remove the "permanent" boarder post that would have been a different storey... but it not so his immunity should be reinstated now.

    Board protection and enforcement is a nation security matter. I more concerns at those CPPs official who allow Thai and Vietname fishermans to fish in our water.....this is illegal and surve no benefit to Cambodia's fishermans and the economy....

    Your first guest was almost right.
    Yes I was in Lowell, Massachussetts for one year, but I moved from there along time a go to another state. Right now I spend more time in Cambodia then in the US. And I know how the law in the US operate very well. If you use the US laws for MR. Rainsy, he would be in jail already. Why?. Because he was a law maker not enforcer, so by uprooted those border posts, he was acting as not only a laws enforcer, but as a judge. And you should know this also the US Representatives and Senators do not have immunity, that mean if they broke the laws, they can be arrested at anytime.
    But alot of you don't know much about Cambodia, but alway blamed this and that. For example,land grab and eviction. Most of those people that you guys saw were evicted were fake evictors. Why? Because most of them had sold their property to some other people already and those new owner paid these people to stay there to ask for more compensation from the government or companies.For example they sold to the new owner for $1500. at the end the new owner got pay $10,000. through the old owners.

    According to PM Hun Sen's speech yesterday, Xam RainXy's political career is on the line now. If the Court found him guilty and PM Hun Sen refused to write a pardon letter to King Sihamoni, Xam RainXy has no way come back to Cambodia. Will Xam RainXy dare to serve jail time in Cambodia? I don't think so.

    The more Xam RainXy dares to jump too high, when he falling back it will hit him very painful.

    I will put my house and bet that when Xam Rainxy has run out of option and no where to go, he will bow his head to the ground and writes the letter to "Apology" to the Cambodian government, please let him comes back home in Cambodia. What ashamed?

    This is Cambodia, not France. If you want to become a leader/PM, you have to be willing to make sacrifice and go through the physical hardship, not run around and take refuse in Paris.
