Cambodia has approached the International Court of Justice over the disputed territory near the Preah Vihear temple in a move that has stoked blazing tensions over the issue.

Thailand wants the dispute over the 4.6 sq km area settled by the two countries through the Joint Boundary Commission.

A Foreign Ministry source said the chances of a bilateral solution would diminish if the international court in the Hague became involved.

Cambodian Prime Minister Hun Sen said on Tuesday his country would complain to the court that Thailand was occupying its land, Associated Press reported.

"Cambodia has reached the limits of its patience," Hun Sen said during a visit to the disputed border territory.

"Cambodia wants to solve this territorial dispute by filing a complaint to the international court at the Hague." He said he would also ask the United Nations to help solve the border issue.

What Cambodia plans to do is not new. In 2008, Phnom Penh tried to take the disputed area issue to the United Nations Security Council.

Thailand, under then prime minister Samak Sundaravej, successfully convinced members of the council in Thailand and New York, and other members of the Association of Southeast Asian Nations, that the issue should not be resolved by outsiders.

Prime Minister Abhisit Vejjajiva said yesterday the issue should be beyond the authority of the world court. He earlier insisted on using negotiations to fight for Thai sovereignty over the area around the temple as it is part of Kantharalak district in Si Sa Ket.

The world court ruled in 1962 that the temple belonged to Cambodia but it did not touch on the disputed area.

Nationalist passions have run high along the border since 2008, when Thailand first backed, then opposed, Cambodia's bid to have the temple declared a World Heritage site by the United Nations Scientific, Educational and Cultural Organisation.

Cambodian-Thai relations worsened late last year when Cambodia named former prime minister Thaksin Shinawatra an adviser on economic affairs.

The Cambodian government refused to extradite him to Thailand despite the government's request.

The two countries are now poised for a conflict over a management plan for the temple, submitted to Unesco by Cambodia. The UN agency requires Cambodia to safeguard the temple as a historical World Heritage site.

Thailand suspects that Cambodia has included part of the disputed area in its plan. The plan will be tabled for discussion by the World Heritage Committee at its next meeting in July in Brazil.

"It is clear that Cambodia will include N3, or the overlapping area of 4.6 kilometres, in the plan," said Vasu Poshyanandana, secretary-general of Thailand's International Council on Monuments and Sites.

"We will object to the plan before it is included in the conference's agenda," he said.

"Cambodia has carried out the plan without Thailand's consent. That makes the plan unacceptable."

Thailand will soon map out its position to counter the Cambodian proposal.

The landscape management plan will be circulated to members of the World Heritage Committee about six weeks before the meeting.

But Mr Vasu said: "We have no need to wait until that time."

    good observation. of course, any bilateral talk about preah vihear is dimishing. first cambodia wants our international borderlines to be properly demarcate before any bilateral talk can take place. this way cambodia will be satisfied with knowing that our territory near preah vihear temple is secured and undisputable by siem pad thugs. so, siem must stop making illegal demand that we development the temple bilaterally with them. it's not their saying, it's cambodia's saying and decision! and siem must stop making claim to our temple's property of the 4.8 sq. km area. the icj verdict of 1962 also indicated that surrounding access way to our temple is cambodia's. siem has no legal claim! we want icj to tell thailand to respect our territory and temple once and for all so there will be no more future stealing of cambodian territory by bullshit siem pad thugs again!

    siem always tells us not to go to court, i wonder why? they knew the result in advance, i guess! siem afraids to go to icj and world court with this case because they know they are the thief! however, they can't stop cambodia from taking them to court!

    Correction to this article by two bias writers of Bangkok Post...

    ... Cambodian-Thai relations worsened late last year when Thailand invaded Cambodia and started to occupy Cambodia land around Preah Vihear. Soon afterward former prime minister Thaksin Shinawatra flew from Dubai to visit and support his old friend, Samdech Decho Hun Sen.

  5. It is clearly indicated that Siam don't want to go to the International Court of Justice. THis is meant that Siam has no proof that the 4.6 sq km land belong to it, but purely belong to Cambodia. Simple analysis, if anyone sure the land belong to it, it is good to bring the case to third party.

    OK, so Hun Sen curse at Thai so what? They need to hear it directly in the language that they understand and this i support him fully. He is human like you and I. When we are really angry what do we do? we curse for the hell of it. Do we care about image or how stupid we look? no because anger take over it. We just want to release it out! Some people cannot understand nice talking, we need to use rough language to make them understand.

    If Khmer in Thailand think they are Khmer, then they 'd better speak up. Don't let Thailand changes Khmer name to Thai and just be quiet or go along with it. What are you thinking? It's not o.k to be Khmer and yet call yourself Thai. Worse , yet speak or substitute Thai's language as your own. Look there are 14 millions Cambodian who still breathing and speaking in Khmer language everyday at home or in Cambodia.     I agree what my priminister Hun Sen said to the Thai government. You should know the fact that you are the rubber, you rubbed Khmer, Khmer territories and cultures tradition. You said we (Campucha)stole your land, actualy you are the one who rubbed and and stole Khmer land. Do you understand Ah Khun Thai? Also, the Khmer language you had copied. Can you see ALL temples in Thailand, it proves that formerly Khmer territories.

    If you see this video clip, you will be happy that Cambodian kicked the Thai out. But those poor Thai are Khmer.
    They even speak Khmer.
    How said the foreigners made Khmer confront Khmer.

    Of course we know very well all of them are Khmer blood and speak same language, but they have different dress under the Thai masks.
    The Cambodian Constitution protected all Khmer life, inside-outside (also Khmer descent in Thailand) and of course oversea's Khmer. It is not easy for the Cambodian Government to have a clear decision. We Khmer have to think twice, before we go to the war with Thailand (Country just for Thai).
    But Thai don't have any complexity, because thai love to see Khmer from both side kill each other. Thai wanted very bad to liquid and destroy the Khmer Nation from this planet.
