Opposition leader Sam Rainsy declared that he will not return to Cambodia to face the Phnom Penh municipal court as long as the Cambodian government will not release 2 Cambodians from jail in Svay Rieng.
The condition above coincides with the summon issued by the Phnom Penh municipal for Sam Rainsy to come and clarify his lawsuit case on 09 March. Sam Rainsy was accused by the government of falsifying public document and of diffusion of false information.
Sam Rainsy told RFA from France that: “I will go by myself, but the government and the court authority must release the two Cambodian farmers who were arrested and they must return their rice fields back. This is not Sam Rainsy’s case, this case involves the Cambodian people, it involves the territorial integrity of our Cambodia. My defense lawyers are those who love justice, my lawyers are those who help expose the truth.”
In February, PM Hun Xen declared that he will not pay attention to the conditions imposed by Sam Rainsy.
Chuong Chou-ngy, Sam Rainsy’s defense lawyer, said: “I will send the petition to the court to legally defend him and I will study the case to see what document the government lawyer based on to make his accusation?”
Regarding the case above, Ky Tech, the government lawyer, brought up a court case against Sam Rainsy to the Phnom Penh municipal court on 26 February. He said: “To me, I believe that the case stems from a proper legal matter, this is good case for my side.”
On 27 January, the Svay Rieng provincial court sentenced Sam Rainsy in absentia to 2-year of jail time after he was charged of destroying public properties and of incitation to racial discrimination, simply because he pulled out stakes at border post no. 185 on 25 October 2009. The incident took place on Koh Kban village, Samrong commune, Chantrea district, Svay Rieng province, along the Cambodian-Viet border.
Two Cambodian villagers, Mr. Prum Chea and Mrs. Meas Srey who were also accused of the charges, were sentenced by the Svay Rieng provincial court to one-year of jail time each.
The additional lawsuit brought up by the government against Sam Rainsy was because he published documents that included Google Earth maps claiming that border stakes between Cambodia and Vietnam concluded under the 1985 border treaty at the location of border posts 184, 185, 186 and 187, Cambodia lost between 200 to 500-meter of territories, this does not even include the number of loss at other eastern Cambodian provinces.
Var Kim Hong, the chairman of the government border dispute resolution committee, and Hun Xen both reacted one after another in February. The pair rejected the claims made by Sam Rainsy, saying that Sam Rainsy’s was falsifying the truth and this touched off another round of lawsuit against Sam Rainsy in February.

ReplyDeleteThe post that the government accused Mr. Sam Rainsy and the owner of the farm is the invader post that Cambodian government and Youn government posted on the Cambodia farmland without consent of the legal rights farm owner.
Mr. Sam Rainsy and the villagers uproot this post then the government accused for destroying the public property. But those post are not accurate border post as the governemnt and Youn claimed. So, in defending Cambodia territory Mr. Sam Rainsy exposed the map of from United Nations and the current google satalite map. Proof that the post is clearly on Cambodia land wich also proof Youn intentionally ecroaching our territy. Therefore it is not true border posts but invader post. This post is agreed by Youn and Hun Sen only not Cambodians nationwide.
In addition to the charge for uproot the invader posts, the government slap two more charges again Mr. Sam Rainsy for the accused of producing fake map and falsify the public informations.
However, the government always and will try to silent whoever brought up the senstitive Cambodia/Youn border issues. They are thieves and do not want people to expose the truth to the Cambodians and the world.
If you haven't notice, the ruling party, Hun Sen, CPP is working in best interest of Youn not Cambodians and Cambodia nation.
Can Khmer people all united stop fighting each other can we claim Kampuchea Krom back from Youn?

It is easy to say to stop fighting. If Hun Sen, CPP governemnt stop abusing our people and destroying our nation then the fighting would end. People who love Cambodia should not stop fighting and support this criminal government.
