Prosecutor wants 5 more Khmer Rouge investigated

PHNOM PENH, Cambodia — A prosecutor at Cambodia's Khmer Rouge tribunal has formally recommended that five more suspects be investigated for crimes against humanity and other offenses, setting the legal body on a collision course with the country's powerful prime minister.

A statement from the tribunal Tuesday said the acting international co-prosecutor, William Smith of Australia, submitted his recommendation to the co-investigating judges, who would then decide whether to issue arrest warrants.

Citing the confidentiality of the process, the tribunal announcement did not identify the five new suspects. It said the cases involved at least 32 instances of murder, torture, unlawful detention, forced labor, and persecution that constituted violations of Cambodian and international law.

Cambodian Prime Minister Hun Sen has repeatedly spoken out against expanding the list of defendants beyond the one now on trial — Kaing Guek Eav, also known as Duch, — and four others in custody.

On Monday, Hun Sen said such action could lead to civil war, a claim doubted by his critics.

"I would like to tell you that if you prosecute (more leaders) without thinking beforehand about national reconciliation and peace, and if war breaks out again and kills 20,000 or 30,000 people, who will be responsible?" Hun Sen said.

The tribunal's Cambodian co-prosecutor opposed further indictments, but the tribunal last week ruled that his international counterpart could seek them. The tribunal, created last year under an agreement reached in 2003 between Cambodia and the United Nations, employs joint teams of Cambodian and international court personnel.

Lars Olsen, a spokesman for the tribunal, said there was no timeframe for action by the co-investigating judges on Smith's submission, made Monday.

The tribunal is seeking justice for the estimated 1.7 million people who died in Cambodia from execution, overwork, disease and malnutrition as a result of the communist regime's radical policies while in power between 1975-79.

The U.N. administrator for the tribunal issued a blunt reminder Tuesday to Hun Sen that the panel was independent.

"It is a clearly established international standard that courts do not seek approval of advice on their work from the executive branch," Knut Rosandhaug said in a statement.

Critics accuse Hun Sen of trying to limit the tribunal's scope to prevent his political allies from being indicted. Hun Sen once served as a Khmer Rouge officer and many of his main allies are also former members of the group.

The tribunal's long-awaited first trial — of Kaing Guek Eav, the Khmer Rouge's chief jailer for war crimes and crimes against humanity — opened in March. A joint trial of the four other defendants is expected within the next two years.

The Khmer Rouge came to power after a bitter 1970-75 civil war, and after being ousted from power in 1979, carried out an insurgency from the jungles until 1999.

Hun Sen has dominated Cambodian politics for more than two decades. He ousted his former co-prime minister in a 1997 coup and has since ruled virtually unchallenged.

    Hun Shit will be among the next five. He already knew in advance; that's why he pee on his pant and scare to death. He made a threat to the UN about civil war and who is responsible for 200,000 or 300,000 people will be killed? That is the question he asked to the UN. He thinks the UN will take responsible. Shit, this uneducated leader doesn't know he is the one who will be responsible for Khmer dead.

    Why he knew he will be one of them? Because one of Khmer co-prosecutors is Ah Sok An's niece. She is the obstruct the justice. She and other Khmer co-prosecutors might be on trial too if they keep blocking the court.

    This is not Cambodia jungle court like Hun Shit court. This is the UN international court. They have their rule of court. They don't play game with the bunch of crook people like Hun Shit. If he is above the law, he will be one of them.

    Take them down, Mr. UN. Don't let them win you. He is just a dog who barks to scare people.

    Even though Hun, Sen is not a good leader; but I am glad that Heng, Somrin and Hun, Sen were former K.R. I don’t know Vietnam bought them or not. But in fact two of these leaders had courage to save the Cambodians from the bloody hand of Khmer Rouge regime. Without them you and I may become the skeleton that been display at Tuol Sleng.

I was there and watched the innocent Cambodian dying. I had only the questions without answers. How come the UN, US just show after the Vietnamese
    invaded and liberated the Cambodians from the bloody hand of Khmer Rouge?? Until now I still can not get the right answers!!

    If Hun Sen is really against killing , why did he organize the coup against Ranarith and kill alot of his political opponents ? His rhetoric doesn't fit what he has done . When he said the war could break out if more arrest will happen, that was his propagation because he wants to proteck himself and his comrades from being prosecuted by the KRT .

    Let me give you the answer. There was no Human Right in Cambodia during the Khmer Rouge regime because Khmer Rouge didn't need help from donor countries like Hun Sen does and Hun Sen promises to restore freedon , democracy and respect Hunman Right in order to get those donations . That's why you see NGO all over the country just to keep an eye on Hun Sen to make sure he will keep his words.

    You've admitted that Hun Sen and Heng Samrin are former Khmer Rouges.  And we all know that Khmer Rouges murders innocent Khmer peoples.

    What make you think that Hun Sen and Heng Samrin are not Khmer Rouges now?

    From what I unerstand, Hun Sen and Heng Samrin are continue to kill innocent Khmer peoples.

    Let me make it clear to Khmer Rouge supporters, the current Cambodian government are run by Khmer Rouges the same peoples that responsible for killing almost two million innocent Khmer peoples.
    Don't try to differentiate between Pol Pot Khmer Rouge Regime and Hun Sen Khmer Rouge Regime.  Cambodia still have Khmer Rouges and Khmer Rouges are still continue to murders innocent Khmer peoples.

    Without Hun Sen and Heng Samrin; journalists, leader of the Free Trade Union, innocent men, women, children, political opponents members of  FUNCINPEC Party and Sam Rainsy Party would still be alive today.

    To say that Hun Sen and Heng Samrin had courage to save Khmer peoples from Khmer Rouge Regime is an insult to the victims that had been murders by the same Khmer Rouge (Hun Sen and Heng Samrin).

    I do have one question.
    Why are Khmer Rouge supporters so dumb?

You may don't know what all these guys did during that killing field times. If their hands have bloods they must be brought to justice.We should learn from this country,USA whoever have committed crimes or have criminal records... should not be taking any governmemt jobs.If you are Cambodian and you love your people and your country, you won't disagree with my opinions and there are only democracy, real democracy that can make our Cambodians and our country better...so don't worry about the civil war going to start, no more jungles now,Cambodians are smarter and smarter now, they don't like to kill each other no more, and they won't believe their stupid leader on more...why they have to go to war and kill each other again ? who support them ? China ? Vietnam or Thailand ? so I believe Cambodians living abroad and inside Cambodia who love justice will support this Khmer Rouge trials to bring the real justice for the victims and to stop this kind of genocide happening again, also to give the lesson to our next country leader not to do this such stupid thing again...
