Cambodian opposition leader said that there is no hope for the KR Tribunal to move forward. Sam Rainsy, opposition leader, said that the ECCC internal rules will not be finalized in April as claimed by ECCC officials.
Sam Rainsy said that this problem is caused by the lack of independence of court officials, and by the political interference of the Cambodian government in order to delay the process.
Sam Rainsy said: “First, under the excuse of sovereignty, they said that Cambodia must lead this court and foreigners should not interfere. Then they claim it was a funding issue, they have created all kind of problems before finally all the funding can be found. Then they talk about governance, a delaying tactic, they claim that there must be one law after another because all these laws are interdependent on each other. Now, the internal rules issue is raised, there is no ending to this, they are using all kind of pretext to delay the process.”
Reach Sambath, the ECCC spokesman, responded to Sam Rainsy’s accusation: “In reality, this tribunal is linked to law technique, and that’s how the law is handled. Take a look at Sierra Leone for example, before the internal rules are established, it took one year, and in Bosnia, it took 2 years. Now we are only a few months into the process, how can someone accuse us?”
Reach Sambath added that since Friday 02 March, small groups of the court judges are meeting to discuss the internal rules, with the Cambodian judges meeting in Phnom Penh, and the international judges meeting in Bangkok, Thailand. The plenary session to discuss the internal rules which include more than 100 articles, will be held between 07 and 16 March.
A number of officials from civil societies believe that the internal rules could be resolved. Chhanh Youk, director of DC-Cam, said: “The tribunal asked for more time since last year, up to April, in order to resolve this issue. We should not have confidence or lack of confidence on this issue. For me, the most important factor is that the court place greater consideration on the victims to resolve this issue.”
The ECCC started functioning since July 2006. The court has a 3-year mandate, and has a budget of more than US $50 million.

THe delay of Khmer Rouge Trial is a tactic of Hun Sen and Sihanouk to avoid Sihanouk embarrassement for his killing policies in the 1975 for the revenge he has with all Lon Nol Supporters. If this trial collapse, it will prove to the world that Cambodian government is being formed by a group apes. This apes species do not have justice system. THe strong one will dominate the weak one. Be honest; I am very skeptical about new leadership, it can go either ways. Cambodia still have
