The Kampong Cham MP contested the constitutionality of the NEC’s decision to condemn him to pay a 10 million riels ($2,500) fine for disparaging the CPP leaders during the 2008 legislative campaign.
Threatened by Hun Sen to lift his parliamentary immunity, opposition leader Sam Rainsy does not intent to be intimidated by it.
Sam Rainsy’s office just reacted through a communiqué: Sam Rainsy lodged a complaint with the Constitutional Council regarding “the unconstitutionality/illegality” of the NEC’s decision which was subsequently validated by the same Constitutional Council. “Those decisions are pertaining to a "criminal offence" that is under the exclusive jurisdiction of the Tribunal under the Supreme Court,” the SRP communiqué stated.
As stipulated by the law, 17 MPs wrote to the Constitutional Council to support Sam Rainsy’s procedure. Finally, Sam Rainsy also wrote to Heng Samrin, the president of the National Assembly, to inform him about his procedural steps.

Just lock up Ah Scam Rainxy and suspend his political party from all election until all fines are paid.
Don't listen to nonsense from Ah Hypocrite who called Khmer people, "A culture of impunity", and he himself is immune from any criminal charge.
CPP parliamentarian members must recognised that Parliament is a National Institution to represent Cambodian National laws makers. They cannot believe with large number of members would be OK to do everything they like. Otherwise bigger country such as China and USA would be OK to take over small countries. In this 21 century, people are living within laws and not within physical power. Therefore, the first thing CPP member of parliament is to strenghten laws to protect Cambodian citizen for all walk of lives not only member of parliament of other party. Each member of each party has been elected by National General Election ( not by appointment). Therefore they cannot simply be removed their immunity by only large number of CPP. The main party can offcourse to approve their policy of their government but cannot change the rules of laws within National assembly to dismiss their members to whom elected by people at all. If they think because of their large numbers, they can dismiss all opposition members already?
Each member of parliament can only dismiss by their own party because Cambodia has adopted Parliamentarian proportional system where voters have voted the party to represent them. If during General Election, each member has been elected by their own name ( First Past to Post, then noone can remove them at all. Cambodia needs to strenghten rules of laws and should not strenghten individual power. It is so dangerous for this kind of promotion. Indeed that was a conspiracy of Sihanouk and late Sam sary to destroy Song Ngoc Thanh movement. But Mr Song Ngoc Thanh has revealed that secret, he has shot Mr Sam Sary to death in Thailand. But since then, Cambodian authority is still maintaining that late Sam Sary was a traitor. But in reality he has sacrified his life for Sihanouk. Therefore we must not look down on Mr Sam Sary at all. We must remember that Sihanouk wanted all his loyalt members to die for him. Here Mr Sam Ransy is also the same.He may have trusted to much to this old man. But this old man has never cared about him. Sihanouk has always expected everyone must die for him and his family. Mr Hin Sithan was an army officer of Lon Nol regime. He was not a khmer Rouge at all.
