The DC-Cam NGO, which specializes in research and collection of documents aiming at bringing charge on former KR leaders, earned sharp criticisms from Duch’s defense team on Tuesday 21 April, following an incident related to the date of a document cited by a civil party lawyer.
While civil party lawyer Silke Studzinsky asked to question witness Chan Khorn regarding his testimonials obtained and transmitted by DC-Cam, a confusion took place: the same document was dated 8 March 2000 in the French version, and 30 April 2003 in the English version.
“Whatever we know about the merits of the DC-Cam NGO, it has never been a legal institution,” François Roux rebuked while underscoring to the fact that in the testimonials, no mention was ever made about the witness right to remain silent and not to incriminate themselves.
“Furthermore, there were serious difficulties in the translation of documents, from Khmer to English and from Khmer to French. I know that the ECCC had to use the service of DC-Cam for the translation, but it was a bad service done to them,” François Roux added.
The defense lawyer asked that documents obtained by DC-Cam and that should be filed, be set aside while waiting for a decision from the tribunal.
