Cambodia: Can a Deadlock Be Broken?

Leading the line of attack as a self-anointed No 9, the long ruling/running PM Hun Sen of Cambodia has consistently eschewed/evaded the notion and principle of good sportsmanship and the idea of a level-playing field in politics, as well as within his own CPP party leadership circle, allowing rival factions and former foes alike ample room for self-enrichment by any means, and immunity from prosecution before the law for misdemeanours and all manners of personal excesses, including rights abuses at expense of powerless citizens and squandering of state assets for personal gains, but giving them the cold shoulder and a brutal elbow, a rash flying tackle or two even whenever their actions and exercising of conscientious functions and conduct threaten to undermine his movement on the brutal pitch of political football, standing and grip on the reign of play so as to dictate the terms of the contest itself and its outcome for the duration of, and after the designated time slot of 90 minutes - plus the obligatory extra time! - [He wants to play on until he is 90!], with the attentive grooming and promotions of his own children and clans a clear indication of what to expect once his own playing career is over - School of Vice

Cambodia: Can a Deadlock Be Broken?

There is no problem that lacks a solution, though we may not like our choices. Manmade problems are solvable through imaginative, productive, creative thinking and carefully thought-out action. Some predicaments are harder to deal with than others. The pain from the loss of loved ones does not heal overnight. Some learn to live and cope with loss, some seek professional help, some never move on.

There is a Khmer saying that goes, Choss toek kropeu, leung leu khla – there is crocodile in the river, there is tiger on the bank. Yet, being imaginative and creative can help beat such a circumstance. There are alternatives, and a better alternative does come along.

Lord Buddha says, "Nothing is permanent." Life is a series of choices. There is not a perfect world. One makes the choice one thinks takes one closer to an ideal state.

At present, Cambodians have worked themselves into a political deadlock. There are two rivals: The Cambodian People's Party that has ruled Cambodia since January 1979 with Vietnamese help, and the opposition Cambodia National Rescue Party, a mid-2012 merger of the Sam Rainsy Party and the Human Rights Party, that seeks to change the status quo.

Right after the national election on July 28, the CPP government-appointed National Election Commission rushed to declare preliminary election results that favored the CPP with 68 seats and CNRP, 55 seats. The CNRP objected, and declared it had been robbed of its election victory through election irregularities and flaws – a claim backed by many non-governmental organizations. If the election had been free and fair, the CNRP says, it would have won a majority with 63 seats – leaving the CPP with 60 seats in a parliament of 123 members.



The CNRP demanded an investigation by an independent joint committee, failing which street protests and boycotting of the first session of the parliament would take place.

Taunting, rhetoric, threats spiraled and augmented tension and news outlets reported the deployment of government troops and armored vehicles.

A few days after the election, on August 2, in a speech to farmers in Kandal province, Premier Hun Sen said that the constitutional rule of 50 percent plus one majority makes a CNRP boycott of the inauguration of a new parliament immaterial, for it cannot prevent the formation of a new CPP government: "We don't need to depend on or beg another political party to attend a meeting." He warned the CPP would take away the seats of CNRP legislators who are no-shows.

Hun Sen's interpretation of the constitution has been questioned. Attorney Sok Sam Oeun, executive director of the Cambodia Defenders, asserted that a quorum of 120 out of 123 legislators is required to open a new national assembly. Article 76 of Cambodia's 1993 Constitution stipulates, "The National Assembly consists of at least 120 members."

It may be the logic of CNRP leaders that without the presence of CNRP legislators at the National Assembly, there would not be the quorum required to open the Assembly; that without an Assembly a new CPP government, which it must approve, cannot come into being. Thus, a CNRP leader told me, "Time is on our side and we are fully aware we hold the key to a new Cambodia."

Talks failed on forming the joint committee requested by CNRP leaders to investigate alleged election irregularities. Then talks restarted, and talks failed again. The talks were doomed from the start, as reports indicated that neither party entered negotiations in a spirit of compromise, only with demands that the other party yield. The CPP wanted a joint committee to include the pro-government NEC. The CNRP objected. The CNRP, which first wanted the United Nations to be a negotiator, softened its stand and proposed observer status for a UN representative. The CPP objected to any foreign involvement.

But credit must be given to the CNRP as it declared in its latest statement on August 31: The CNRP wants a joint, independent, investigating committee to resolve election irregularities. "After this independent committee has been established and carried out all of its duties, the CNRP will accept any decisions made by this independent committee."

If the CPP is certain it has won fair and square, why not agree to a joint committee?

CNRP leaders have consistently vowed to try all avenues to find a peaceful solution to the election conflict and have promised that street protests would be a last resort. CPP leaders have warned they will arrest those responsible for any violence and destruction.

The CNRP filed its complaints at the Constitutional Council, another CPP-controlled institution, which is required by law to render a final verdict on election results by September 8 – a verdict CNRP leaders expect will repeat the NEC's announcement favoring the CPP.

The Ramvong circle dance is what the words say, a dance in a circle according to the drum beats, thak-thong thak-thong. Some foreign participants joined the circle briefly and left Cambodian circle dancers to perform their chak kbach.

On August 20, US and Australian diplomats in Phnom Penh renewed calls for an investigation of election irregularities. A few days earlier, the European Union High Commissioner's statement said, "Alleged irregularities will have to be dealt with before the final result can be announced" – i.e., on September 8.

But one day after, on August 21, visiting Chinese Foreign Minister Wang Yi congratulated and welcomed "the victory" of Premier Hun Sen and the CPP. The Chinese urged "all (Cambodian) parties" to hold talks peacefully and "to put in place quickly a new National Assembly and a new government."

Wang then warned outsiders: China – whose government provided Phnom Penh with 1,000 handguns and 50,000 rounds of ammunition for Cambodia's National Police just two days after the election, and has given more than 2.8 billion dollars in aid and loans to Cambodia since 1992 – will not tolerate "outside" interference in Cambodia's political process.

CNRP leaders have seemed to follow the late King Father's "popular consultation" technique when he was a Prince and the country's Chief of State. CNRP President Sam Rainsy and Vice President Kem Sokha toured Cambodia's provinces to report election-related developments to the electorate, to consult the electorate on their thoughts about the next course of action. On August 25, the CNRP held its public hearing, "Voters Seek Truth and Justice" at Freedom Park. Authorities said the number of participants would be limited to five or six thousand; between 10,000 and 20,000 people showed up.

The impression I have formed from correspondence and news reports is that the CNRP public hearing is reminiscent of the late King Father's Sakmach Cheat or National Congress. In the 1960s I attended a few congresses at Phnom Penh's Veal Men, where citizens from different provinces came to raise issues and present requests to those in authority. Scholars and writers referred to the Sakmach Cheat as a kind of town hall meeting under Prince Sihanouk's chairmanship – a "direct democracy," some called it.

The CNRP public hearing "Voters Seek Truth and Justice" brought mostly CNRP supporters and sympathizers and interested citizens to Freedom Park, where both sides exchanged views on how to seek "Truth," i.e., what really happened at the July 28 election, and "Justice," i.e., remedies for the irregularities and flaws that prevented the voters' true wishes from being implemented.

The hearing was reportedly lively. I enjoyed James Pringle's piece (8/29) that described the event (good cheer, laughing people, an old folk song sung by CNRP Mu Sochua, speeches, applause, brave words from participants, among others).

"This is to fulfill our responsibility, to keep the people engaged, and to take their complaints to His Majesty (King Sihamoni) at some point," a CNRP leader told me.

A subsequent statement released by the CNRP called on the CPP to hold talks to establish an independent investigative committee to examine election irregularities. The statement repeated the CNRP position that failure to form such a committee would compel "the last resort . . . a mass peaceful demonstration against the result of the election. It will be held on September 7." The international community would be urged not to recognize the election results, nor any government created by those results.

The CPP responded it also wanted to talk.

But these exchanges were only the chak kbach movements by the Ramvong circle dancers. There cannot be talks between two non-talkers.

On August 29, a CNRP training session facilitated by an NGO was provided to CNRP working groups on tactics for a nonviolent and peaceful mass protest on September 7. Two protest rehearsals were planned for September 1 and 5.

Sam Rainsy took the time to clarify that the purpose of the mass demonstration is to reinforce the demand for creation of an independent investigative committee.

As the CNRP has its first rehearsal on September 1, the Phnom Penh Municipality gave a special training to 2,000 anti-riot police on how to handle the September 7 mass protest.

Last Friday, August 30, came a royal letter from King Sihamoni, who is in Beijing for a medical check-up. He called on Cambodians to respect the Constitution, the supreme law of the land, and use it to resolve their conflict. A day later, CNRP MP Mu Sochua posted on her Website: "His Majesty has called for the respect of the Constitution" and "The voters will use the Constitution as the supreme law of the nation to call for freedom, rights and justice."

That brings me back to the CNRP's mini-congress at Freedom Park on August 25 and on what reminded me of the late King Father's legacy, Sakmach Cheat or the National Congress.

In light of His Majesty King Sihamoni's call, would it not be in the Cambodian people's interest to seek implementation of Article 147 of Cambodia's 1993 Constitution (formerly Article 128) on the National Congress?

Article 147 stipulates, "The National Congress shall enable the people to be directly informed on various matters of national interests and to raise issues and requests for the State authority to solve." (Italics mine)

In the old days, Cambodians from remote areas of the kingdom traveled to Phnom Penh for a few days to participate in the Sakmach Cheat. Of course, some government officials exploited their ignorance and fear of authority, and manipulated issues for the officials' own benefits. Yet, some folks had the courage to speak their minds.

Today, I am focusing on Cambodia's supreme law of the land that provides an opportunity for the people "to raise issues and requests for the State authority to solve." I am also focusing on Article 149 (formerly Article 130) which stipulates, "The National Congress shall adopt recommendations for consideration by the State authorities, Senate and the Assembly."

I see the recent CNRP public hearing as a mini-Sakmach that seized the spirit of Article 147. Why not take this CNRP mini-Sakmach of supporters and sympathizers, and concerned citizens, a step further and convene a Sakmach Cheat with emphasis on Cheat on National/Nation to include the Khmer people from anywhere in the country and members and supporters of all political parties ready, willing, and able to attend? Let the world observe how, when an army and a police force do not engage in politics, but remain neutral institutions, the people would be able to come to a peaceful solution to the country's problems?

The July 28 election has shown us that the Cambodian people on the whole have developed and matured in their thinking. They may lack political sophistication, but they are no longer seduced by the glitz of new construction in the capital. They know they are hungry, that many have had their land confiscated, that there are not health services, good schools for their children, or the capacity have their basic needs met. Their souls long for a higher level of contentment. They may not understand what change entails, but they know what they don't want. So they voted. And now they question how it was possible for this election to have been lost. What went wrong?

I am conscious that in Article 148 (formerly Article 129), it's the Prime Minister who has the responsibility to convene the National Congress that shall proceed under the King's chairmanship. I don't expect the CPP Prime Minister, to convene such a meeting, at which he would be confronted by dissatisfied citizens; but let there be an official request to the Prime Minister and the King. The King's recent letter reminded Cambodians of "responsible institutions" "tasked" by the Constitution to resolve national issues. Is the National Congress not an institution tasked by Article 147 and Article 149 to serve the people? I expect many reasons to be given why the Sakmach Cheat cannot be convened. Let the explanation flow. And let the people express what they think on September 7.

But if the answer is a Yes to a Sakmach Cheat, then let the Cambodian people come from across the land on September 7 to gather in Phnom Penh "to raise issues and requests for the State authority to solve," and to "adopt recommendations for consideration by the State authorities, Senate and the Assembly."

I like to think positively and take risks to reach an ideal.

Four terms ago, Sihaknouk helped Uneducated leader,Mr. Hun Sen, but right now he is gone so Hun Sen is still alone, sad.I think that Mr. Sam Rainsy should stay calm, strong, don't believe what CPP is talking about. Cpp does not want to solve the problem, It just want to control Cambodia and bring VN to live in Cambodia,that is it that Uneducated man wants.

The National Constitutions Council must demand Hun Sen to step down for cheating and election fraud. If the Constitutions Council is failing to remove Hun Sen, it is a Prostitution Council. It is a useless Council all Cambodian must never trust a Council that destroy our motherland.

Thank you Dr. PeangMeth for the important part of constitution ,article 128 re.national congress which will provide Cambodians to participate and express their concerns to the government. Sadly, many know that PM has never paid attention to this particular mean of any resolution may arise out of this parth of democracy. As the result of that, corruption will subsequently reduce . It is interesting that PM confirms that he would follow king father steps but NOT to implement constitution fully, for the betterment of Cambodia, and it has been 28 years to neglect all these important frameworks.

Another important parts that those articles 8&9 should provide the king more important and active social roles in participating the progress of Cambodian society, in collaboration with national NGOs(social mechanisms) and international NGOs and possibly with assistance from the U N as well.

Chinese has problem with them YOUN for thousand of years now, and it is time for the Chinese to use their nuclear bombs on them crooks before it is too late for the Chinese to survive well. The YOUN are the cancer of the Southeast Asia and the US knew them well too, that was why, they had wwii with them YOUN people. Just a note that any independent body of institution that foster fairness and equality in judgement and decision making that reflect the views of the voters and overall cambodian electorate they will be supported by them also.
So my point is this if the constitution council take a stand and say that the elections irregularities as or has been put forward and alrady confirm is true that the CPP cheated. They should demand that the form CPP leader Hun Sen step down from his role and allow for independ parties that is balance, fair and free to be the abritrator of the dispute and they should take voice of the voters as key to their decision and that they too should put NATIONAL interests ahead of personal interests in order to have a better future for Cambodia. This discipline is yet to be seen other then the current demonstrated by the CNRP MPs and leadership of Mr Sam Rainsy and Kem Sokha.

Why do foreigners always play trick with other countries by imposing dumb (Avydya, Akvichea) and heartless (Khohoeuv) puppet (Ting Mong)leaders? When will foreigners realize that we will be instead grateful and long-lastingly friends if they help us have a Preah Bath Dharmeuk leader who can make Cambodia shine? Think about that, does Cambodia shine right now? Poor us, Rural Cambodians aspire to be shoes shiners in Thailand so far. They do not even have enough training to be shoe shiners.
Even our present leader may just be able to join the shoe shiner group in Thailand once he is completely in disgrace and stripped from his wealth and title.

Praying will never work with the evil Vietnam and its puppet Hun Sen. I knew the result of the praying already: Zero.

However, it would show the CNRP's weakness, no realistic plan to achieve its goal.

Khmer people have empowered you (CNRP) to win the election already. Your job is to take the necessary steps to claim that win.

I said before that it was fortunate that Sihanouk died last year. If Sihanouk were alive, he would have forced the CNRP to give in to whatever Hun Sen wanted.

So, please don't be so stupid by considering to any Sihamoni's suggestion. He is simply a tool for Hun Sen. Sihamoni said whatever Hun Sen told him to. I felt terrible when I heard the words “ Preah Reach Damress Preah Maha Ksath”. Please tell me just one action that this King has done for Cambodia.

Did Sihamoni ratify and promulgate the 2005 supplemental treaty, which sealed Koh Tral as Vietnam's property and allowed the Vietnamese to infiltrate into Cambodia at will, etc...?

Here is my suggestion:

Vietnam wanted to swallow Cambodia a very long time ago. Vietnam has been controlling Cambodia for 33 years.

Do you think Vietnam will relieve its grip on Cambodia after the CNRP's praying ?
No way Jose.

It will require a powerful force from the international community to make this evil Vietnam leaves Cambodia for good. The international community needs a leverage to break Vietnam's grips.

Where is that leverage and who has it ?

The CNRP knows, Khmer people know, and I know that the only way to stop Vietnam is through a peaceful demonstration. We must invoke Mahatma Gandhi's concept by marching peacefully, demanding the CPP to accept its electoral loss or we offer the CPP a new election if this Vietnam's slave felt that its loss was a fluke.

We march peacefully, daring this evil Vietnam and its puppet to shoot us. Only when the killings were enormous that the international would exercise its right to intervene and help Cambodia. Otherwise, the evil Vietnam and its puppet Hun Sen would deplore the international community as the interferer of Cambodia's internal affair.

The number of Khmer people who got killed in the demonstration is the LEVERAGE that the international community needs to intervene to help Cambodia. Khmer people are the creators of such leverage.

If the evil Vietnam lost its soldiers to conquer Cambodia, it would be logical that Khmer people lose some lives to save Cambodia. No other way around.

I have put the number at 100,000 people death to win over this evil Vietnam.

Khmer people cannot back down after some people got killed. Use those brave Khmer people death as a motive, a fuel, a morale force to go forward until the international community move in to help us. We cannot do one half way, one half measure.

Our protest has a solid foundation: we demand for justice, the loser must accept the electoral result.

Are 100,000 people too many to sacrifice to save Cambodia?

It is absolutely not, considering the fact that Khmer people will suffer heavily after Cambodia becomes a province of Vietnam or 3 million Khmer people who were largely killed by the evil Vietnam through its Khmer Vietminh during the Pol Pot era.

I put the number at 100,000 because I don't want to see people demoralize after some brave Khmer people die during the peaceful demonstration. The actual number should be much lower.

In brief, we help ourselves first by creating a leverage, give it to the international community to hit that evil Vietnam and its puppet Hun Sen, then finally a lasting peace will come to Cambodia.

Sam Rainsy was almost killed in the 1997 grenade attack. In this life, there are not many second chance. Therefore, Sam Rainsy and Kem Sokha must not present at the rally. Jayavarman 7 became Khmer hero only after he made a surprise powerful counter attack to crush Champa, not praying for Champa to give him peace.

A leader must be a able to make a difficult decision: Jayavarman 7 ‘s decision to launch a counter attack to crush Champa is more difficult than a decision to stage a peaceful march demanding the loser to accept its defeat.

It is a great idea to have all parties to convene in a public forum. However, it all deppends on the honesty of the ruling party. Are all CPP people ready to listen and hear what people will say? Bottom line, are they even genuinely consider power sharing with the opposition.

The real question is why Mr. Hun Sen is needed for another 5 years or more? What pending crucial and critical issues that he must extend his ruling to take care of?

History will not forget anyone who ignored or disrespected the will of the young Cambodian people who have clearly spoke their minds and hearts through this election! Do not forgo the youths' futures and cheat them of their voices because the old guards just wanted to keep the status quo.

Besides, thirty (30!) years of the same leader and leadership is no good for any system and country. No creativity and innovation can come out of this old system.

We thank you for your article. It would be a good idea if a public forum " Samach Chiet " can be convened whereby the King acts as the Arbitrator, and the CNRP, the CPP, the Constitutional Council, the NEC would answer the questions asked by the Khmer people at large.

In Samach Chiet, all ambassadors, foreign dignitary, foreign and local press will be invited. The entire Samach will be televised and broadcasted live.

To start, the leaders of CNRP should initiate and approach the King with this " Olive Branch ".
If all else fails, the CNRP can still hold mass demonstrations.

This peaceful demonstration is a brilliant idea that should be embraced by everyone who values lives. CHANGE is what we are looking for. A softer approach like this can be a powerful tool in showing unity and diligence to ask for change. I don't agree with it only last 2 hours but it is a good start.

The CNRP,

The expansionist Vietnam has controlled Cambodia over 30 years, and it has pushed its citizens to fill up Khmer land.

Khmer people knew the grave danger of our nation and have empowered the CNRP to lead the country by overwhelmingly voting for it.

Now, it seems like the CNRP does not know what to do when the CPP just made up a number and called itself the winner.

If the CNRP kept melting under pressure, Cambodia future will be so dark because the CNRP is the last obstacle for Vietnam to complete its absorption of Cambodia.

On the election day, Sam Rainsy congratulated the people for the victory. Later on, he changed his tone... then the Yuon slave Khiev Kanharith seized the opportunity and declared that the CPP got 68 and the CNRP got 55. And don't be surprised those numbers will be solemnly proclaimed on September 8th by the robot NEC.

After the election, the CNRP revealed that it will make a nationwide protest, and now change to a praying ...

Cambodia has suffered heavily because of Sihanouk's limited knowledge and crazy behavior.

Currently, when the CNRP decided that it would follow PREAH REACH DAMRESS OF THE KING SIHAMONI, who has been following Hun Sen's orders, really shock Khmer people.

Can the CNRP ask itself this question: What has Sihamoni done for Cambodia since he was born or since he put the throne on his head ?

The CNRP must do whatever is right for Cambodia, claiming your victory that Khmer people gave to you, and please act like a man. Draw your own steps to get that victory, and forget about that King Kong.

Well...When people said deadlock and it is because people fail to make decision. If Sam Rainsy made the decision to have independent inquiry into election fraud then he must stick with that and wait for the outcome! If Hun Sen made the decision to create obstacle and make it illegal under Cambodian constitution to have independent inquiry into election fraud then he must stick with and wait to see the outcome!

But for average Cambodian people they can see clearly that independent inquiry into election fraud is the way to go and to have mass protest(not mass pray) to demand justice under Cambodian constitution is the proper thing to do.

Why is it so hard for Hun Sen to accept independent inquiry? Maybe Hun Sen afraid of the outcome! Sam Rainsy and Cambodian people certainly are not afraid of the outcome! For Hun Sen not to accept the independent inquiry is against the will of Cambodian people! For Hun Sen to allow the NEC to tamper with the election and to have the NEC play a role in finding justice for Cambodian voter is criminal!

NEC is breaking the election rules and regulations by tampering with the election box! NEC is criminal!
