Lawyer Choung Chou Ngy's letter to the CBA

Dear all lawyers,

I am lawyer CHOUNG Chou Ngy, ID300.

Yesterday, I submitted a request for Bar Council meeting to issue a decision saying that “My protest against prison officers not allows detaining my client at Kandal prison on 23rd September 2011 is legal duty, not a crime. Because I am the lawyer, I have the rights to defend my client”.

At that time the prison officers did not have any detainer so that they could not detain my client, then my client went home.

Now the prosecutor of Kandal court charged me with the crime.

Opposition Lawyer Court Ordered To Remain in Country

“For the last time, please drop this case and take this time to resolve other national issues.”
Kandal provincial court on Monday issued an order for opposition party lawyer Chhoung Chu Ngy to remain inside the country while he is facing charges for abetting the escape of a suspect in a land dispute case last year.

A court official said the order was made instead of an arrest, and that Chhoung Chu Ngy must notify the court if he moves homes as well.

Chhoung Chu Ngy is accused of helping Meas Peng, a deputy commune chief for the Sam Rainsy Party, leave detention at the Kandal court in September 2011, where he was to be questioned for his role in a protest over a land dispute there. A second opposition official, Chan Chen, is facing similar charges.

Synopsis: SRP Lawyer Choung Chou-ngy filed a lawsuit with the minister of Justice against 3 Kandal provincial court officials: (1) Lim Sokuntha, a jugde at the Kandal provincial court, (2) Vong Bunvisoth, the deputy prosecutor at the Kandal provincial cout, and (3) Sum Bora, a clerk for the Kandal provincial court. The trio is accused of colluding to falsify a document to send Meas Peng – a client of Choung Chou-ngy – to jail temporarily and also for issuing false summons order against Meas Peng.

In a court summons, Judge Sin Virak said that if Choung Choungy did not appear in court, “we will issue a warrant to arrest him”.
All eight lawyers representing opposition SRP lawyer Choung Choungy will defend him during his scheduled court appearance next week, Cambodian Bar Association spokesman Yim Sary said yesterday.

Yim Sary told the Post that Choung Choungy had been summonsed to appear in Kandal provincial court this Monday and each of his lawyers planned to accept an invitation from provincial court Judge Sin Virak to attend.

“All lawyers have already received the invitations,” he said.

Sok Sam Oeun, one of the eight lawyers, said his client would have a better chance of receiving justice if all his lawyers were there to support him.

Seven lawyers representing opposition Sam Rainsy Party lawyer Choung Choungy have requested Kandal provincial court delay the questioning of their client because he is in the middle of a one-month meditation, lawyers said yesterday.

Choung Choungy was summonsed to appear in court yesterday for questioning over allegations he aided and abetted a prisoner’s escape from detention, but lawyers have been unable to confer with their client, Cambodian Bar Association spokesman Yim Sary told the Post yesterday.

“The reason we have asked for the postponement is because Choung Choungy is busy practicing the precepts of religion, so he cannot attend the court for questioning,” Yim Sary said.

Synopsis: Choung Chou-ngy, the SRP defense lawyer, is concerned about political pressure exerted on him and this could affect his profession as lawyer who must fairly defend his clients. On 11 January, Choung Chou-ngy said that he will show up to clarify the accusations leveled by the Cambodian Bar Association (CBA), but that he is not sure what day he will show up yet. He explained that what is not clear is the fact that the summons by the CBA takes place the same time he is taking his religious vow. “The CBA letter orders me to show up on 27 (January). I plan to continue my religious obersation, therefore, I did not say anything yet about the 27th, I will think about it and will come up with a resolution.”

Despite its ongoing investigation into opposition Sam Rainsy Party lawyer Choung Choungy’s ethical behaviour, the Bar Association has assigned seven of its lawyers to defend him against a criminal charge, association officials said yesterday.

Bar Association spokesman Yim Sary told the Post yesterday that Choung Choungy was involved in two separate and unrelated cases.

“He has been charged by the Kandal Provincial Court in connection with a crime, and the Bar Associations is investigating whether he has acted contrary to the ethics of a professional lawyer in holding a press conference to criticise the justice system,” Yim Sary said.

Sam Rainsy Party lawyer Choung Choungy, already facing charges of abetting a prison escape, now stands accused by the Cambodian Bar Association of contravening his professional code of ethics by criticising the justice system, the association’s president said yesterday.

The association will issue a letter to the lawyer asking him to appear before its council to explain his actions.

Choung Choungy’s “meditation for justice” campaign — a response to the charges against him and SRP parliamentarian Chen Chang — has included shaving his head, dressing as a monk and displaying slogans aimed at the Justice Ministry and the Bar Association.

Bar Association president Chiv Songhak said Choung Choungy had contravened the professional and ethical code for lawyers.

Cambodian Bar Association president Chiv Songhak said that Choung Choungy could be penalised or dismissed from the Bar Association if he was found to have breached its code.
A lawyer for the Sam Rainsy Party yesterday began his meditation for justice campaign at the opposition party’s headquarters in the capital’s Meanchey district, after a Buddhist layman shaved his head and blessed him.

Dressed in white, the lawyer began meditating in the morning between placards calling on the Justice Ministry, prosecutors, lawyers and the Bar Association to defend justice.

“Lawyer Choung Choungy is focusing on clear sightedness, keeping silent and seeking tolerance and truth through meditation to liberate people from danger and obstacles,” layman Hing Phirom said.

“He is doing it for the nation.”

Judicial Intimidation of a Lawyer Representing an Opposition Party Activist

On 29 December 2011, Mr Choung Chou-Ngy was charged under Article 565 of the 2009 Criminal Code of the Kingdom of Cambodia (the “Penal Code”) – “Provision of Means for Escape”. This charge has been brought in response to the release of Mr Choung Chou-Ngy’s client, Mr Meas Peng, deputy chief of Banteay Dek commune in Kandal province’s Kien Svay district, from prison on 23 September 2011. The Cambodia Daily reported that the Kandal provincial court found that Mr Choung Chou-Ngy’s actions in helping his client to be released from prison were not in accordance with the laws of his profession, and that they in fact constituted helping his client to escape – a penal offense. The Kandal provincial court has since confirmed that Mr Choung Chou-Ngy has been charged.

Mr Choung Chou-Ngy, who began working as a lawyer in Cambodia on 3 March 2005 and has represented a number of high profile clients, including Mr Sam Rainsy – eponymous leader of the Sam Rainsy Party – represented Mr Meas Peng in May 2011, when he was charged by the Kandal provincial court with masterminding a violent protest against a property owner embroiled in a land dispute. On 22 November 2011, Mr Choung Chou-Ngy was summoned for questioning on 7 December 2011 with regards to the release of his client from prison. Mr Choung Chou-Ngy rejected this summons for questioning, stating that he was only following the law by defending his client and that, if he had made a mistake, only the Bar Association of the Kingdom of Cambodia (the “BAKC”) had the remit to punish a lawyer’s professional mistakes.

Mr Choung Chou-Ngy asked for intervention from the chief of the BAKC, Mr Chiv Sung Hak, in order to resolve this charge. The chief of the BAKC in turn sent a letter on 6 December 2011, requesting that the Kandal provincial court send the BAKC any relevant documents in relation to Mr Choung Chou-Ngy’s case and allow the BAKC to resolve the issue. However, on 26 December 2011, Radio Free Asia reported that the Kandal provincial court sent a letter in response stating that it was not able to comply with the request because the alleged charges were not a violation of the code of ethics for lawyers but a criminal case. If found guilty, Mr Choung Chou-Ngy will face between one and three years in prison and a fine of up to 6 million riel (about US$1,485). Mr Choung Chou-Ngy told The Cambodia Daily that he will not be fleeing the country despite the charges that he is facing.

Kandal provincial court on Monday issued a summons for an opposition party lawyer who is wanted for questioning alongside an opposition lawmaker for allegedly abetting the escape of a court suspect.

The investigating judge for the Kandal court said Chhoung Chun Ngy, a lawyer for the opposition Sam Rainsy Party, has been summoned to appear Jan. 18 to answer charges of helping a deputy commune chief named Meas Peng escape questioning at the provincial detention center late last year.

Rights groups have condemned legal action in the case, saying the government is abusing the power of the court to hurt the opposition ahead of elections later this year.

ភ្នំពេញៈ មេធាវី​គណបក្ស​សម រង្ស៊ី​ លោក​ជួង​ ជូងី​បាន​ថ្លែង​នៅ​ក្នុង​សិន្និសីទ​សារព័ត៌មាន​កាល​ពី​ថ្ងៃទី​៣០​ ខែធ្នូ ឆ្នាំ​២០១១ ​នៅ​ទី​ស្នាក់​ការ​គណបក្ស​សមរង្ស៊ី ​ថា​លោក​នឹង​កោរ​សក់​ស្លៀកស​ពាក់ស​ភាវនាធម៌​ចាប់​ពី​ថ្ងៃ​ទី​៤​រហូត​ដល់​ ថ្ងៃ​ទី២០ ខែ​មករា​ឆ្នាំ​២០១២​ ដើម្បី​ឱ្យ​តុលាការ​ព្រះរាជ​អាជ្ញា​ចៅក្រម​គោរព​ច្បាប់​និង​ផ្តល់​យុត្តិធម៌ ​ដល់​ពលរដ្ឋ​កម្ពុជា​នៅ​ទូទាំង​ប្រទេស​។

លោក​ជួង​ជូងី​បាន​ថ្លែង​បែប​នេះ​នៅ​ក្នុង​សន្និ​សីទ​សារព័ត៌មាន​ថា​ចាប់​ពី​ថ្ងៃទី​៤​មករា​ឆ្នាំ២០១២​ទៅ ​លោក​នឹង​ទៅ​កោរ​សក់​ស្លៀកស​ពាក់ស​ភាវនាធម៌​ក្នុង​គោល​បំណង​ឱ្យ​តុលាការ​ព្រះរាជ​អាជ្ញា​ចៅក្រម​គោរព​ច្បាប់​ផ្តល់​យុត្តិធម៌​ដល់​ពលរដ្ឋ​កម្ពុជា​នៅ​ទូទាំង​ប្រទេស។
