និទ្ទណ្ឌភាព និង​ប្រព័ន្ធ​យុត្តិធម៌​ទន់​ខ្សោយ​នៅ​កម្ពុជា គឺ​ជា​ចំណុច​ខ្លាំង​នៃ​ពាក្យ​បណ្ដឹង​របស់​អង្គការ​ចលនា​អំណាច​ពលរដ្ឋ​ខ្មែរ ដែល​បាន​ដាក់​ទៅ​តុលាការ​ព្រហ្មទណ្ឌ​អន្តរជាតិ (International Criminal Court = ICC) ប្ដឹង​ចោទ​រដ្ឋាភិបាល​កម្ពុជា ក្រោម​ការ​ដឹកនាំ​របស់​លោក​នាយក​រដ្ឋមន្ត្រី ហ៊ុន សែន ថា បាន​ប្រព្រឹត្តិ​បទ​ឧក្រិដ្ឋកម្ម​ប្រឆាំង​មនុស្ស​ជាតិ។

មន្ត្រី​ឃ្លាំ​មើល​តុលាការ​អន្តរជាតិ អ្នកស្រី ឃ្លែរ៍ ដឹហ្វហ៊្វី (Clair Duffy) នៃ​អង្គការ OSJI (Open Society Justice Initiative) មាន​ប្រសាសន៍​ថា តាម​គោលការណ៍​ដើម្បី​អោយ​តុលាការ​ព្រហ្មទណ្ឌ​អន្តរជាតិ​នេះ​មាន​សមត្ថកិច្ច​ចាត់​ការ​រឿង​ក្តី​ព្រហ្មទណ្ឌ​ណា​មួយ​បាន​នោះ លុះត្រា​តែ​ម្ចាស់​បណ្ដឹង ឬ​ដើម​ចោទ អាច​បង្ហាញ និង​បញ្ជាក់​អោយ​រដ្ឋអាជ្ញា នៃ​តុលាការ​នេះ​ជឿ​ជាក់​ថា ទី១ បទ​ល្មើស​ដែល​ប្ដឹង​ទៅ​នោះ មាន​សភាព​ធ្ងន់ធ្ងរ ដែល​អាច​បង្ក​ក្តី​បារម្ភ​ដល់​សហគមន៍​អន្តរជាតិ។ ទី២ មាន​ភស្តុតាង​បញ្ជាក់​ថា បទ​ល្មើស​នោះ​កើត​ឡើង​យ៉ាង​ទូលំ​ទូលាយ ជា​លក្ខណៈ​ប្រព័ន្ធ។ ហើយ​ទី៣ តុលាការ​នៅ​ក្នុង​ប្រទេស​នោះ មិន​មាន​ឆន្ទៈ ឬ​មិន​អាច​រក​យុត្តិធម៌​ជូន​ជន​រងគ្រោះ។

Human Rights Situation Still Poor: US

Cambodia remains a country with a poor human rights record and endemic corruption, whose citizens can face extrajudicial killings or abuse in detention, the US State Department said in a report released Friday.

Land disputes, forced evictions and a lack of democratic freedoms remained problems, according to the 2009 Human Rights Report.

“Although civilian authorities nominally controlled the security forces, in many cases security forces acted under directives of the [Cambodian People’s Party] leadership,” the rights report says. “Security forces committed extrajudicial killings and acted with impunity. Detainees were abused, often to extract confessions, and prison conditions were harsh.”

Cambodia’s judiciary remains weak, with human rights workers reporting “arbitrary arrest and prolonged pretrial detention,” according to the report. “Land disputes and forced evictions were a problem. The government restricted freedom of speech and the press through defamation and disinformation lawsuits and at times interfered with freedom of assembly.”

Phay Siphan, a spokesman for the Council of Ministers, said the report, which runs 29 pages, was “not fully complete.”

Cambodia was still dealing with vestiges of its civil wars and as a result lacks some human rights protections, he said Friday.

Cambodia To Form Business Dispute Court By 2009

PHNOM PENH, Feb 18 (Bernama) -- The Cambodian Ministry of Commerce has finalised a 40-article draft law creating an independent commercial court and arbitration body, said China's Xinhua news agency quoting a local media report Monday.

Mao Thora, Under-secretary of State for the Commerce Ministry, has said that it is hoped that the specialized court for business disputes will be formed by 2009, the Cambodia Daily newspaper said.

Many are hoping that a commercial court would improve Cambodia's capacity to fairly judge disputes in the business sector, and thus move the country further on the road toward a sound market economy, it said.

In a country where the justice system is weak, Mao Thora said the specialized commercial court is needed to ensure investor confidence.

"Investors do not want to filed complaints about business in the civil court. They need a specific court," he was quoted as saying.

The new court could reduce the number of cases clogging provincial courts, impacting the entire justice system, he said.
