S’pore released Heng Pov, Phnom Penh deceived

Singapore police authorities had sent Heng Pov, the former Phnom Penh police chief and former advisor of Hun Sen, to the international border gate with Malaysia in the evening of Friday because of the competition between two currents. The first current is the Cambodian government which wants to bring Heng Pov back to Cambodia, and the second current is an overseas current that wants Heng Pov to obtain asylum in a third country, or face justice in Singapore or in another country.
Victor Kyong, Singapore police spokesman, confirmed to the news media that the Singapore police authorities indeed arrested the former personal advisor of prime minister Hun Sen on the evening of Thursday. However, the arrest was not made because of the request from the Phnom Penh authority, but that it was done according to the Singapore law because Heng Pov’s visa expired. Therefore, one day later, the Singapore authority released Heng Pov but told him to get out of Singapore.
Victor Kyong said: “It’s true that Mr. Heng Pov was arrested based on the immigration law Section 15, Article 1, regarding his stay beyond his visa expiration. Mr. Heng Pov was sent to the immigration authority for further proceeding.” However, the spokesman did not specify what other actions ensued, whether Heng Pov is allowed to stay in a third country, or if he is sent back to Cambodia to face justice, or if he will face Singapore justice.
Khieu Sopheak, the ministry of Interior’s spokesman, declared yesterday that he is not sure if Heng Pov will be brought back to Cambodia. However, he claimed that if the Singapore authority does not deport Heng Pov back to Cambodia, it will make crime perpetrators from Cambodia or from any other countries believe that Singapore would be a good hideout. He said: “We do not know when he (Heng Pov) will be deported or where he will be deported to. Singapore law does not specify whether Mr. Heng Pov can go to a third country or not.”
David Chen, Heng Pov’s defense lawyer, said that he received the news about the arrest of Heng Pov already but he declined to comment. David Chen also said that he last met Heng Pov at the end of last week, and if Heng Pov is sent back to Cambodia, his life would be in danger. Heng Pov could face torture and death just like Ho Sok, the former Funcinpec secretary of state of the ministry of Interior, who was assassinated during the coup d’état of July 5-6, 1997.
David Chen claimed that Ho Sok died at the ministry of Interior because the Singapore embassy turned him out during the [coup d’état] fighting. On the other hand, if Heng Pov is sent to face the Singapore justice, Heng Pov will fight according to the law, and he will tell the court of the life danger he will face if he were to be sent back to Cambodia.
Regarding the request for asylum in a third country, David Chen said that he cannot provide any detailed comment.
Yesterday morning, Keo Vanthan, the deputy chief of Cambodia’s Interpol, told reporters that he did not yet receive information about the arrest.
An official from the ministry of interior said that the Cambodian authority is pursuing to have the Singapore authority send Heng Pov back to Cambodia. However, no response to the request has been received yet because Cambodia and Singapore do not have an extradition treaty in place.
The same anonymous official also claimed that there is no case for the Singapore authority to send Heng Pov back to Cambodia. The official said that the Singapore authority will surely send him to the international gate with Malaysia.
Another source said that it was because of the competition between two currents – one wanting to send Heng Pov back to Cambodia, and another overseas current wanting Heng Pov to go live abroad – that Singapore was forced to remove Heng Pov out of its territory.

The Khmer government's attempt to get Heng Pov deported back to Cambodia relies on only one punchline, i.e. that if Singapore doesn't deport him back, the country will be a transit or haven for terrorists. Well, I don't think so. Terrorist or politcal fugative, Heng Pov is a special case that needs to be accorded with special treatment. The precedent here will be difficult to apply because of his high status within the corrupt government of Hun Sen and also his knowledge of the darkside of the current Cambodian government. Unless the current leadership of the Cambodian government repeated the same step as Heng Pov did, Singapore can score an international relation point by not intentionally subjecting Heng Pov to possible abuse of rights and justice.
