The National Election Committee has rejected eight appeals by the SRP demanding the removal of more than 9,000 people they claim are Vietnamese nationals from the 2006 voter list due to a lack of evidence, officials said Monday.
The SRP had complained that 9,188 Vietnamese nationals were registered in Svay Rieng, Kandal, Prey Veng, and Siem Reap province, and that they should be erased from the list.
But at an appeal hearing Sunday, the NEC rejected two of the appeals because the SRP had no documentary evidence to back up their claims, according to Phan Keo Mono of the NEC's public information bureau. And Monday, the remaining six appeals were dismissed, the SRP said.
"There was no evidence for the judge to make a decision. They just wrote down the complaint," Phan Keo Mono said of the Sunday hearing.
SRP Cabinet Chief Ly Sery Vyna said the party will appeal the rulings to the Constitutional Council within 10 days.
The SRP identified the alleged Vietnamese nationals based on information provided by other villagers, SRP leader Sam Rainsy wrote in an e-mail Sunday.
"We leave it to local villagers, who know each other well, to identify who meet and who don't meet the criteria stated in the nationality law," Sam Rainsy wrote.
The SRP filed its appeals to the NEC after commune officials rejected similar requests.
Commune councils in four provinces and Phnom Penh have approved the removal of more than 1,000 names provided by the SRP, according to party officials and election monitors.
Officials in Kompong Loung commune, in Pursat province's Sampov Meas district, agreed earlier this month to delete 892 of 1,365 names of people the SRP claimed were Vietnamese nationals, according to a copy of the decision received Monday.
Chhoun Cheurn, a Kompong Loung commune clerk, said officials agreed to delete the names because they belonged to people who had moved from the province or who lacked proper identity documents.
But some have questioned whether it is always possible to prove whether an ethnic Vietnamese person is Cambodian or not Koul Panha, director of the Committee for Free and Fair Elections, said that because voters have previously not needed identity documents to register, it is next to impossible to verify the nationality of some voters.
"Who can say? We don't know clearly [their nationality]," he said.
