Nhiek Bun Chhay summoned by the court for 29 December

Kampuchea Thmei newspaper reported that the Phnom Penh municipal court issued a summon for Nhiek Bun Chhay, Funcinpec secretary-general, for a clarification on 29 December, regarding the lawsuit against Prince Norodom Ranariddh, Funcinpec former president, who is accused of selling the Funcinpec headquarters. Nouv Sovathero said that he is not aware of the summon, however, he said that if there is indeed a summon, it is a normal process because it was his party’s complaint, and that the court issued the summon to explain about the complaint. The court also issued a summon for Prince Norodom Ranariddh for him to come and clarify the lawsuit, on 05 January. Ly Sovanna, the prince’s lawyer, claimed that the prince will go and testify by himself, however, he also asks to bring along a large number of his witnesses with him.

I cannot understand this kind of court. I have experiences myself with the high court in foreign country. THe system is different from Cambodia. The court do not need to summon the plaintif and the defender.
Example of Nhek Bun Chhay.
Say Nhek Bun Chhay is a plaintif. He must send to the court through his lawyer a set of affidavit making his claim against Rannarith ( defender). Upon receiving affidavit from Nhek Bun Chhay, the court should send a copy to Rannarith ( defender) to respond. Rannarith can respond by himself or by his lawyer with his affidavit. After receiving Rannarith affidavit, the registra must send a copy to the plaintif to respond again. The plaintif can again respond to the defender for any misled by defender of any new claim. If both parties stop responding, the registra will confirm a hearing. THe court can adjourne without the plaintif and the defender because they have their lawyers there to work for them. During the hearing the judge will ask each party lawyer to express their legal right. Each party will hear their fligh through their lawyer and a letter from the judge to confirm which party is winning.The judge will declare the winner. The court has to reserve the looser 15 days to submit his appeal against the ruling. The case of Rannarith and Nhek Bun Chhay is a case of business and trust. Therefore, no need to be panic. This is not a criminal case.
