PUTRAJAYA: Cambodia’s jailed ex-police chief Heng Pov is seeking to cite the Malaysian Immigration director-general, its enforcement chief and a senior prosecutor for contempt for deporting him before he exhausted all his avenues of appeal here.
Heng Pov claimed that the three senior officials should be committed to prison for deliberately suppressing the facts before the Court of Appeal.
He also accused them of orchestrating his premature deportation to Cambodia to serve an 18-year jail sentence for conspiring in the murder of a municipal court judge there.
Heng Pov, 52, filed the action against director-general Datuk Wahid Mohd Don, the immigration department’s director of enforcement Datuk Ishak Mohamed and the Attorney-General’s Chambers deputy head of prosecution Mohd Hanafiah Zakaria on Wednesday through his lawyer N. Sivananthan.
The action is supported by the affidavit of his Singapore-based wife Ngin Sotheavy.
The Federal Court is scheduled to hear the application next Friday.
In the application, Heng Pov claimed that the three officers had misled the Court of Appeal through an affidavit and oral statements from the Bar when they said they had not decided as to how and when the Cambodian would be deported.
“They were fully aware then that arrangements had been made with the Cambodian government to have a private plane waiting at Subang airport to remove him from Malaysia,” Sivananthan said.
“The contemnors acted contrary to law by handing him over to the Cambodian government’s representatives outside the Palace of Justice (which housed the Court of Appeal and Federal Court) when counsel had indicated that he was going to the Federal Court to get an application to stay the deportation.”
The notice of motion stated that the three officers had been informed by 12.15pm on Dec 21 that the Federal Court was ready to hear Heng Pov’s stay application.
“The fact that Heng Pov was taken away on a flight that left the airport at 12.30pm is a clear indication of the contemnors' conduct intended or calculated to obstruct, interfere and impede the administration of justice,” Sivananthan said.
He added that the deportation, having been made despite Heng Pov being granted a visa by the Finnish government, was a disregard for the law and the sanctity of the judicial process.

LOL, they are trying to charge
the malaysian official with a
15 minutes conflict from the time
the officials was informed about
the hearing to the time the plane
took off.
I don't think any court could
proscecute anyone for that.
first, it take longer than 15
minutes to get Heng Pow out of
the detention center, then into
the car, then through the lunch
hour traffics just to get to the
aiport, not mentioning the usual
bad airport traffic, unless they
ran over everyone on the way.
Moreover, it takes more than 15
minutes to go through airport
gateway and get the plane ready
for take off without being hit
by and incoming planes ...
If that is possible, it suggests
the airport control tower staffs
are involved in the traffic
coordidation as well, which is
highly unlikely.
There is no way they can pull
that off in 15 minutes without
causing catastrophies. They
need at least 45 minutes and a
lot of lucks.
This is nothing more than a
lawyer's scam. They knew they have
not a drop of chance, but there
are moneys to be made from the
client. I hope Heng Pov's wife able
to save some money for their kid's
education ... or whatever.
Malaysia has too many gangsters just like in Cambodia but Cambodia is the worse one. They came into Thailand and killed monks. These lawyers will take all the money from the wife Heng Pov. She will soon get no penny left.

It was definately a set-up to get Heng Peo out of Malaysia. Get those fuckers in jail. Everyone in the world knows how bad the Cambodian government is; but this time is the Malaysia who sold their reputation.

right now, the "15 minutes"
argument that he got isn't going
to do crap to any official.
Attorney fee aint cheap when the
case is abroad. We are talking
expense for luxury hotel, food,
and car rental. We are talking
about hourly premium rate...
I would estimated about 1,000 USD
per day. If he managed to drag the
senseless case out to a year, we
are talking 365,000 USD down the
toilet.
what your government hun sen should do is to let him speak with his attorney so that he can defend himself. you are defending a government of injustice. wait until it happens to you or your family. then you realize they how bad they are.
heng peo got money, you have to mention it to slow him down. he will take those fuckers to court and let he world knows about our proud government of hun sen and cpp and the corrupt malaysian court officials. for the money, it is well worth it.
