Cambodian ex-police chief to sue Malaysian officials

Former Cambodian police chief Heng Pov sits at Phnom Penh Municipal court. Heng has been granted permission to take legal action against the senior Malaysian officials who allowed his swift deportation, landing him in prison for murder, news reports have said.

Cambodia's ex-police chief has been granted permission to take legal action against the senior Malaysian officials who allowed his swift deportation, landing him in prison for murder, news reports have said.

Heng Pov, sentenced in absentia over the killing of a judge, was detained by immigration authorities after fleeing here and expelled to Cambodia before exhausting all legal options.

Now the Malaysian Federal Court has granted Heng Pov leave to cite the three officials for contempt, the Star newspaper said.

"We have read the material and considered the ex-parte application. We have also heard the submission by counsel and are of the unanimous view that at this stage, there is prima facie evidence for leave to be granted," said judge Malanjum, according to the Star.

Malanjum ordered Heng Pov's lawyer, N. Sivananthan, to file the motion in 21 days against Immigration Department director-general Wahid Mohamad Don, enforcement director Ishak Mohamed and government lawyer Hanafiah Zakaria.

Heng Pov was convicted and sentenced in absentia by a Cambodian court on September 18 for conspiracy in connection with the killing of a judge in Phnom Penh.

He fled the country and arrived in Malaysia from Singapore, where he was detained on immigration offences.

Malaysia's high court ruled he be returned to Singapore, his last port of embarkation, from where he planned to travel to Finland, which had offered him refuge.

However, the court of appeal found in favour of the government and within minutes, even as an appeal was being lodged, he was flying back to Cambodia, where he was jailed.

Is that justice done or a set up? The plan was waiting to take Heng Peo to Cambodia as if they already knew the answer.

What setup? They had the clearance
from the verdict of the judges in
one of the hearing, unless that
judge was also part of the
conspiracy, or they were able to
read his mind that Heng Pov will
be turn over to the Khmer
officials. Don't be rediculous.
It is a long shot to be any
type of setup.

The appeal decision did not came
until sometime after, and by that
time, it was too late.
