Phnom Penh – A block cement fence wall which is being built in the Russei Keo development zone with the authorization of the Phnom Penh municipality, has been ordered destroyed by a government official accompanied by several bodyguards. The incident took place at 11:00 AM on 06 March. The Russei Keo police and authority can only look at the destruction of the fence wall without daring to say anything about the incident, even though they know full well that the action taken by the government official brings shame to the government which the official belongs to. The destruction of legal land properties brought a lot of surprises and strong reaction from the legal land owners who are building the fence wall, nevertheless, nobody dare do anything against the powerful government official because of fear.
The legal owners of the fence wall said that the wall was erected 5 days earlier, and they obtained proper authorization from the Phnom Penh municipality and the local authorities. The fence wall was erected to surround 13 plots of land which has legal ownership paperwork. The 13 plots is located in the development zone of the municipality of Phnom Penh, as government officials, the owners legally purchased the plots from the municipality and they have official papers to prove ownership, as well as the authorization to erect the fence wall. However, the powerful government official ordered the destruction of the fence wall, while the police can only stand and look as the destruction was taking place.
It was reported that a government official arrived at the incident location on a silver Honda CR-V. He was accompanied by 2 other cars carrying 5 or 6 bodyguards. The cars stopped in front of the land plots where workers are erecting the fence wall. He then proceeded to order the destruction of the fence wall. Not only that, he also threatened the police officers and the local authorities who were ordered to stand guard to protect the legal land owners.
The land owners who are building the fence wall said that this is a violation of the law by the powerful official. Koh Santepheap was not able to obtain clarification from the official. The land owners claim that all 13 families living on the 13 plots will sue in court to find justice. They hope that the law will protect the law-abiding people, and that it will not protect the unlawful people.
An official said that recently, Hun Sen warned about removing officials who are violating the law to grab lands belonging to the state and lands which already have owners, his warning was aimed in particular to those powerful official who are trampling on the ordinary citizens, even if the powerful person is 3-star general. Hun Sen said that if the land-grabbers do not heed his warning, he will remove them from their position. Therefore, the violation perpetrated by the powerful government official in this case, is nothing more than a challenge to Hun Sen’s warning. However, if the destruction of the fence wall is a lawful case, then it should be resolved according to the law instead.
