PHNOM PENH (AFP) - Cambodia's ousted royalist leader Prince Norodom Ranariddh was Tuesday sentenced in absentia to 18 months in jail for fraud, over the illegal sale of his former political party's headquarters.
"There is enough evidence to sentence (the prince) for breach of trust," presiding judge Sao Meach said after the hearing.
The prince, who is in Malaysia, was also ordered to pay 150,000 US dollars to the Funcinpec political party, from which he was sacked as president last October.
Sao Meach said Ranariddh had committed a breach of trust after trying to buy land -- presumably for a new Funcinpec compound -- in his own name following the 3.6-million-dollar sale of the old party headquarters.
An arrest warrant was issued for the prince last month after he twice failed to appear before the court.
Prime Minister Hun Sen said at the weekend that he would not request a royal pardon for the prince, painting his former coalition government partner as a unrepentant troublemaker.

Right after Hun Sen, the law breaker himself issued a statement he would not write to the King to pardon Rannaridh, the Jungle Court of Hun Sen found Rannaridh guilty. What a laughable!! Hah..Hah.

It seems that many commentators accept that Ranariddh's trial was fair, the court was independent, competent and impartial, and he well deserves that punishment. If they really do, they give too much credit to Cambodian courts.
Furthermore, they should be reminded that trial by default or in absentia, legal in the Cambodian criminal justice system, is a violation of human rights. Article 14 of the International Covenant on Civil and Political Rights to wich Cambodia is a party, fixes a number of minimum guarantees of a fair trial, one of which is "to be tried in his [the accused's] presence" (3.d). They should be reminded that the Malaysian judge who decided to deport former Phnom Police Commissioner Heng Pov back to Singapore from where he had entered Malaysia, rejected his (Heng Pov's) trial and sentencing in absentia by the very court that has tried Ranariddh. It should be added that Ranariddh can still challenge his sentence at the same court and/or appeal against it to the Court of Appeal. If he does, he is entitled in Cambodian law to be presumed innocent. To be fair to him, one should give him the benefit of the doubt.
