Cambodia's election law is as flexible as the ruling party wants it to be

NEC official: Oath is not against the law

Tep Nytha, the secretary-general of the National Election Committee (NEC), said on Monday that the request made by CPP officials in Siem Reap to have villagers swearing their oath of allegiance to the CPP party which they belong to, is not against the election law. Last week, it was reported that the Svay Sor commune chief, located in Varin district, Siem Reap province, told several hundreds of villagers to swear that they will only vote for the CPP in the upcoming 2008 election. Tep Nytha told The Cambodia Daily that the action taken by the commune chief is not wrong because he did not force the people to swear. Tep Nytha added that this is not the election period, therefore, political parties have the right to authorize their party members to provide their oath (of allegiance to the party).

Article 124 of the Law on the Election of Members of the National Assemlby says, inter alia, that " A person or political party that...uses duress, threats, or coercion to secure a promise to vote for a candidate or political party he desires;...; Regardless of any criminal penalty,he shall have his registration card confiscated, his name deleted from the list of political parties participating in the election, and in the case of a candidate, his candidacy conceled by the National Election Committee, and/or shall be fined from five million (5,000,000) to twenty-five million (25,000,000) riels." This law does not specify any election period.

NEC Secretary-general Tep Nytha should not take any public stand on this case of forcing people to take oath to pledge to vote for such and such party, as complaints against this offence could be filed with the NEC. Though he may not take part in the adjudication of the case, his prejudice does influence the NEC when the latter adjudicates it.

Tep Nytha should learn to be an impartial NEC official.

Dr. Lao, I don't see any duress,
threats, or coercion ... where
did you see that? All I see is
a strong and persistence
salemanship to build up customers.
Don't tell me you never encountered
some of those persistent salemen.
Should we summoned them too?

Can political party do whatever it wants to its party members? cut fingers, take nail out, etc., to keep thier oath. can that things happen?

Let a court of law find out the truth, whether there were duress, threats or coercion, or not.

You and I cannot be sure either way. Nor can be NEC Secretary-General Tep Nytha.
