Khmer Krom: Nonviolent Demonstrations OK?

Cambodia's constitutional commitment to allow freedom of expression, assembly and peaceful demonstrations is finally being put into implementation by law, signifying a positive prospect for human rights activists and especially the Khmer Krom community.

Below is an article published by UNPO:

Cambodia’s Council of Ministers issued a communiqué indicating that the plenary session of the Council of Ministers, held on 05 October 2007 had agreed and approved the nonviolent demonstration right draft law which was prepared by the Ministry of Interior.

The draft law includes 6 Sections divided into 30 Articles. The communiqué stated that the draft law on the nonviolent demonstration right was prepared on the basis of Articles 37 and 41 of the 1993 Cambodian Constitution which provide the right of citizens to strike or to stage nonviolent demonstrations, and guarantee the freedom of expression and assembly. Pursuant to these articles, the aforementioned rights are to be implemented in the framework of a law. Such a law has so far never been passed. The fact that it has been drafted and could soon be passed is an encouraging sign after so many peaceful demonstrations were disrupted by the police in the past years.

A Member of UNPO, the Khmer Krom (from Kampuchea Krom, South Vietnam) constitute a large community in Cambodia. Their natural refuge when fleeing suppression in Vietnam, Cambodia has not always been a safe haven for them. Despite their nonviolent approach, the Khmer Krom have repeatedly been prevented from staging peaceful demonstrations in Cambodia by the police (some of their demonstrations have even been violently repressed). The passing of the nonviolent demonstration right law will be a major step towards the democratisation of Cambodia and might, by ricochet, have impact on the politics of the region, allowing oppressed minorities from Vietnam and Laos to voice their concerns in Phnom Penh.

Note: Articles 37 and 41 from the Cambodian Constitution:

Article 37 - The right to strike and to non-violent demonstration shall be implemented in the framework of a law.

Article 41 - Khmer citizens shall have freedom of expression, press, publication and assembly. No one shall exercise this right to infringe upon the rights of others, to affect the good traditions of the society, to violate public law and order and national security. The regime of the media shall be determined by law.

No problemo for anyone who want to demonstrate, but don't go beyond what I outline in bold above.

Also, our government is responsible for all foreign diplomats who work in our country. If any of those people is injured, this could well implied that the demonstration is not peaceful, and the government may banned all Ah Khmer Yuons from demonstrate indefinitely ... Thus, if you are going to demonstrate, make sure you choose mature person for this because you are responsible for all the side effect from your demonstration.

Oh well! The Article- 41 sound so dam good in writing but when it come to put into practical use and the whole concept of Article- 41 is worthless than the paper and the ink used to write on!

Khmer people must be careful because AH HUN SEN Vietcong slave always use his Vietcong thugs and gangsters to disrupt any peaceful demonstration and the Vietcong puppet will use the disruption and the chaos as an excuse to ban all form of demonstration!

True, in theory Article 41 is fair to everyone, but in reality it may not always come out as it is intended to be because everything is subjected to further manipulation and interpretation by the constitution committee.

Frankly, I am not a law or rule-of -law fan. but I am not totally against it either. I am more a fan of morality or rule-of-moral. I believe if our moral value is dead, there is no rule-of-law could come to rescue our society. People will manipulate laws against each other just to get ahead without any concern for anyone.

As for Ah Khmer-Yuons, we have never historically see eye-to-eye on anything. Every time we want to go left, they want to go right, and when we want to go right, they want to left. And had they rode along with us in the Vietnam's dispute, they would not have been in the mess that they are in now. Therefore, you can't blame us for their stupidity. Even today, we have the solution to their issue, but their impatient and lack of good faith toward us, have crippled our ability to do anything toward their crisis. And until they reconsidered their judgment, there is not much more we can do.

Having said the above, regretfully, we see Ah Khmer-Yuons as a threat to our national-security, and this will certainly restricted their ability to demonstrate free willingly by Article 41 in most case. Hey, they created a mess for themselves, and they have no right to create a mess for our people too.

1:39, what I mean by Ah Khmer-Yuons is the Khmer people from South Vietnam. And They are everywhere around the globe. Most of them escaped when South Vietnam was defeated. Some of them end up in AU, UK, ..., or US. And those who end up in Long Beach, I would referred to them as Ah Khmer-Yuon-US, but because the name is rather long to type, I often omitted the "-US". Sorry if that causing confusion.

Open your eye CPP members, you bastard government doesnot prevent Cambodian to protest in front of Burma embassy, but your bastard government prevent Khmers (not just Khmer Krom) to protest in front of your boss (YOUN) embassy. This is a freedom that Your government gives to cambodian people. With this evident, your CPP party will go to hell in the next election. This is a real evident shows to Cambodian that your party is just a YOUN slave. Opposite party can use this evident to show to Cambodian in the villages so they understand the real face of the CPP.

I am surprised to see the reaction of the CPP leaders regarding to the Khmer Krom issues. The CPP leaders are in a deep shit now because its boss ORDER them to protect its boss's fame in Cambodia public. The CPP leaders only react to whatever its YOUN boss said. Now, the YOUN ask CPP leaders to attack Khmer Krom, this is why we see lots of CPP leaders and supporters oversea start calling Khmer Krom as ah Khmer-YOUN so Khmer from Cambodia wont trust Khmer Krom. This tatic has been done by YOUN for years. So, stop using that bullshit tatics.

YOU dont need to tell Khmer people that the freaking current Cambodia has a policy for Khmer Krom. Your current government cant even protect our own Cambodia's land to stop the YOUN encrouching to Cambodia. Your freaking government cannot even tell the YOUN to stop sending illegal YOUN to cambodia. You cannot even do the real works for Cambodian benefits, how the hell you have a policy to help Khmer Krom living in under your boss's colonization. Stop Bullshit that YOUN's SLAVE. and Khmer to become Yuon. I wonder why all khmer inside and abroad hates their Government so much, Because, their bitter life are packs of an oppression, suppression. oh..... our beloved Nation,oh... our beloved Native, may soon be an extinct species, and those who survive will find themselves identified as one of several ethnic minorities in the a “Greater Yuon”. Because they are demonstrating once again their skillful of propagandas and guiles and deception. I remembered

Based on what you said, it shows that you guy are just a bunch of stupid people following your YOUN's boss order. If you call it a protest, of course, it will have no National Security Threat. Demonstration is a peaceful way of showing their freedom of expression that is declared in the article 19 of the Universal Declaration of Human Rights.

Oh, I forgot, CPP members and leaders are just bunch of stupid and barbarian, so you guy may never heard of the Universal Declaration of Human Rights. That is why you run Cambodia as a country without government and let Vietnam came to Cambodia do whater they want even arrest and deport a Cambodian Buddhist monk to Vietnam. Is that Ashamed?
