PHNOM PENH, Feb 18 (Bernama) -- The Cambodian Ministry of Commerce has finalised a 40-article draft law creating an independent commercial court and arbitration body, said China's Xinhua news agency quoting a local media report Monday.
Mao Thora, Under-secretary of State for the Commerce Ministry, has said that it is hoped that the specialized court for business disputes will be formed by 2009, the Cambodia Daily newspaper said.
Many are hoping that a commercial court would improve Cambodia's capacity to fairly judge disputes in the business sector, and thus move the country further on the road toward a sound market economy, it said.
In a country where the justice system is weak, Mao Thora said the specialized commercial court is needed to ensure investor confidence.
"Investors do not want to filed complaints about business in the civil court. They need a specific court," he was quoted as saying.
The new court could reduce the number of cases clogging provincial courts, impacting the entire justice system, he said.

I sure hope that the Business Dispute Court will be independence from the ruling party, and provide justice for business owners/investors and the people of Cambodia with no bias. However, I highly doubt that it will be independence. I think it will just going to be another corrupted court added to the already corrupted judicial system so long as the CPP (Hun Sen/Hanoi's puppet) remains in power.
I hope this is a step in the right direction.
Why does it take such a long time to realize such thing? I have to wait and see and I hope this new Business Dispute Court won't operate in secrecy and be more open and transparency for the public!
A new commercial court won't solve the basic problems of corruption and whether or not there is a learned judiciary. Cambodia follows the "Civil Law" tradition style of court system that was inherited from the French. In that system, the basic assumption is that it only will give justice if the judiciary is not corrupt and second, that there is a learned judiciary- both of which are extreme challenges for Cambodia in applying the rule of law.
i think it would be a great thing to have a business court like this. it would help cambodian people from abusive business practices by greedy, unfair companies out there who want to establish business in cambodia. plus, it would serve as justice for disadvantage cambodian workers and serve as a sound, reasonable advocate for both businesses and workers alike from beign taking advantage of by one or the other.
Any kind of setup of Cambodian court system must not cost Cambodian people too much money and too much time just to bring matter to the court and the court must deliver quick justice without fear from any individual or political influence!
Cambodian court must provide quick resolution to all disputes party within reasonable time because the Cambodian court system under AH HUN SEN dictator is taking too much time and too much money and justice is not a guarantee for Cambodian people and this is got to stop now!
