Dr. Pung Chiv Kek does not want to see politicians suing each others

While vice-prime minister Hor Nam Hong is suing Sam Rainsy for accusing him of being the Boeng Trabek jail chief, Dr. Pung Chiv Kek, President of the Licadho human rights organization, expressed her regret, saying that she does not want to see lawsuits between politicians just before the election period. She said that lawsuits near the election will greatly affect the voters. Dr. Pung Chiv Kek added that politicians should reply to each other’s accusation through information broadcast in the newspapers or over the radio instead, that would be much better than bringing their cases to court. Regarding this lawsuit issue, Hor Nam Hong said that if Sam Rainsy apologizes to him for misspeaking, then he would withdraw his lawsuit. However, on Tuesday Sam Rainsy still maintained his strong standing of not apologizing to Hor Nam Hong.

Now that is so fair! Since Cambodia has KR Tribunal already and why not take on AH HOR NAM HONG lawsuit because after all it is dealing with the KR issue!

I wouldn't worry so much about those lawsuits as our courts' lack of independence, impartiality and competence as most judges and prosecutors are members of the CPP.

It's a worry because the courts are not independent. If they are independent then we don't worry because everything will be judged according to the laws. But because the Cambodian courts are biased and not independent, they will judge this case according to what Hor Namhong wants, which is a conviction for Rainsy, and that's a worry.

True, Cambodian judiciary has never been independent, biased, corrupt and judge according to what the executive branch, Hun Sen and CPP I mean, wants.

The ECCC was instituted to try people who committed crimes against humanity during the Pol Pot era. If Hor Nam Hong and Keat Chhun were guilty of those crimes then the ECCC would have jurisdiction. At this time those two people have not been named in any indictment nor has the ECCC indicated that both men will be called before the ECCC.
Since Sam Rainsy saw fit to repeat Sihanouk's words he subjected himself to the same repercussions that Sihanouk faced, namely a lawsuit. Since this is Cambodia only a Cambodian court has jurisdiction to apply Cambodian law if a plaintiff files a complaint in that venue, no matter whether they are believed to be partial. An argument that Sihanouk might have won the appeal is worth nothing, as it is purely hypothetical. That report in the Cambodia Daily is full of innuendo and very short of legally substantive evidence. Sam Rainsy is in hot waters again because he can't keep his mouth shut when he knows full well that some things need to be treated very carefully. But he has a tendency to run off his mouth without presenting any evidence. He is treading on thin ice.

Mr. Sam Rangsy chose to have hot potatoes on hands while Cambodians are preparing to go to the polls. Getting caught tangled with Phom Penh Tribunal is what he is choosing. Otherwise, he would just leave the matters to Khmer Rouge Tribunal as he is convinced of the crimes committed by Keats Chon and Hour Nam Hong during DK era. Personal attacks are not the high road that honest politicians should borrow. Why don't you attacking the government policies instead as you always know how to do very well? People poverty, corruptions, foreign policy, Vietnamese colonization ... etc? We expect you to win the election at the up coming polls, not getting troubles with defamation law suite!

It's difficult to claim the CPP court independent when it is always politically biased. Well, they have pay for the reputation they have built upon. They can't blame people but themselves.

The CPP court is just as independent as the US, UK,..., or AU court. It can't be any better.
