A Phnom Penh municipal court judge canceled the questioning session on Kaing Kek Iev, aka Duch, the former Tuol Sleng chief under the KR regime, and who is an important witness in the lawsuit by Hor Namhong against Sam Rainsy for defamation and disinformation. No source can officially indicate the reason for the cancellation of this questioning. According to a request sent to the court to include witnesses, the court issued a summon inviting Duch, who is currently jailed at the KR tribunal, to come for a questioning session on 16 May 2008. Because of security concern, the prosecutor of the Phnom Penh municipal court plans to travel to the KR tribunal to question Duch instead. However, on 15 May 2008, a source from the Phnom Penh municipal court revealed that the questioning session was canceled. There is no official indication as to why this questioning was canceled.

It is a conflict of interest for a Deputy Primme Minister to use a suspect of crime to support him as a witness. Without defencing himself first for allegation of his role in Khmer Rouge regime, he cannot sue other people as the victims of the regime or to anyone who just wanted to know the trueth. To defence himself, he must resign all his positions to allow for a full investigation just like Duch and other Khmer rouge leaders. At present, even Khiev Samphann who was the President of the regime is also denying his role in killing all Cambodian citizen. Therefore, who has killed 3 millions Cambodian people? ECCC is another jurisdiction to trial the former senior KR leaders, is a hybrid court consisted of Khmer and foreign judges. Everyone knew from heart that Duch was the man at Toul Sleng, however, he is a prime suspect of the KR trial but is yet convicted.
By allowing him to be a witness in this particular lawsuit is to giving him [Duch] the window of opportunity to voice a free opinion of what might be contradict to the ECCC's mandate of a fair trial for all suspects.
Duch is already in dentention and ECCC absolutely doesn't want to provide a wistness protection programme just simply he would be a witness in this particular

Yes, there is no question that people you mentioned were former member of KR, however, they were defected and jointly came back arms in arms with other affilates to liberate people from the killing by KR.
