Deputy Prime Minister Hor Namhong has confirmed that he had lodged a defamation and disinformation law suit against Mr. Sam Rainsy in the French court in relation to Mr. Sam Rainsy’s speech which alleged that Mr. Hor Namhong was the chief of the Boeng Trabek Prison during the Khmer Rouge regime.
Mr. Hor Namhong had confirmed this law suit in a press conference at the Ministry of Foreign Affairs on the morning of the 27th of June.
Mr Hor Namhong Said: “If we let the Khmer court judge this case, people will say that the Khmer court is biased. So we decided to go to the French court, and wait to see what the people will say about that?”
Mr Sam Rainsy was happy that this case has been brought to the French court which he considered to be more independent than the Cambodian court. He added that the court hearing will take place next year.
Mr Sam Rainsy said: “The French courts are independent, the French courts don’t listen to the dictators like the courts in Cambodia. I’m so happy that I have the opportunity to expose the truth, to show the evidence as well as to bring the witnesses to testify as to who played what role during the Khmer Rouge regime. I have waited for this opportunity for a long time. I’m very happy that I have an opportunity to challenge him in a French court. It is only in the Cambodian courts that we cannot win any case against any Cambodian government leaders.”
At the same time Mr. Hor Namhong has announced that he has withdrawn a law suit against Mr. Dam Sith, a Sam Rainsy Party MP candidate and an editor of the Moneaksekar Khmeer newspaper. Mr. Dam Sith was arrested on the 8th of June and was released a week later when PM Hun Sen intervened.
The international community was concerned that the law suits against Mr. Dam Sith and Mr. Sam Rainsy will affect the upcoming election which will be held on the 27th of July 2008.

Don't need to lose money khmer,Kr trial is near by you.Alot of survivor there.Keep money for our poor people,if not French judges need also money .
This is an opportunity for both sides to prove who is right, who is wrong in a fairly independent French court. If Hor namhong lost, he should accept the French court's verdict and also abandon any further legal actions against Rainsy in the Cambodian court. Should Rainsy lost, he must also accept the verdict because he said he believe in the French justice system. What I worry is that Namhong just pretend to sue Rainsy in a French to avoid any criticism that he control the court. But when he lost in the French court he might pursue Rainsy in a Cambodian court again. This is my worry.

This is the strategy of Mr Hor Nam Hong avoiding the ECCC court. If he continues to suppress this sensible information regarding being chief of the prison, he will eventually force the case to the appropriate court dealing with KR, ECCC.

Ask Hor to pass by France so the Interpol can arrest this guy for genocide. That's right Hor crime against humanity is very serious.
Hor should drop the lawsuit against Sam in the Cambodian court as well since there is no need to have two lawsuits.

6:27, a lot of people want high position in prison, just like they want high position in government today, and they are jealous when they can't get the position.
At any rate, Prison chief doesn't decide who should live or died in prison. This is no difference from any other part of the world. All decisions came from outside, unless prisoners doesn't follow prison code, then they will have no choice but to get rid of them.

Hor Nam Hong is now playing with hot water. He may understood that his court case with Sihanouk was totally different with this court case.
1-Sihanouk was a leader of the Khmer Rouge too. So he cannot sue his subordinate.
2-Sihanouk was not in France to fight with his case and let his case to loose without an appeal.
3-Now Sam Rainsy is different because he was not a member of the Khmer Rouge movement.
4-Both Hor Nam Hong and Sam rainsy are both member of parlimant of Cambodia therefore they are both public therefore Hor Nam Hong cannot sue Sam Rainsy for his suspect of Hor Nam Hong past at all( Free speeches).
5-Now Khmer Rouge TRibunal is already established with UN support and has expertised in dealing with Khmer Rouge affairs, therefore French court will dismiss this case and will have to refer that case to Khmer Rouge Tribunal.
6. Sam Rainsy can file a counter court case for all his legal fees, his travelling expenses and can ask the court to file Hor Nam Hong to Khmer Rouge Tribunal.
