More troops on Thai-Cambodian border

PREAH VIHEAR, Cambodia (AP) — The military standoff between Cambodia and Thailand entered its fifth day Saturday as both sides continued to reinforce their troops ahead of scheduled talks over a disputed border area near an 11th century temple.
Some 300 more Cambodian soldiers and 100 Thais were seen arriving near the Preah Vihear temple late Friday, although commanders declined to confirm those numbers.

Earlier, Cambodian Brig. Gen. Chea Keo said Cambodia had about 800 troops as against 400 Thai soldiers in the area.

The countries are to meet Monday in an attempt to defuse the conflict over territory surrounding the ancient temple, which escalated when UNESCO recently approved Cambodia's application to have the complex named a World Heritage Site. Thai activists fear the new status will undermine Thailand's claim to nearby land since the border has never been demarcated.

Chea Keo said troops from the opposing forces were on the brink of a shoot-out Thursday night when Cambodian monks gathered to celebrate Buddhist lent at a pagoda about 220 yards from the ancient temple.

The incident occurred when Thai troops tried to evict about 50 Cambodian soldiers from the compound of the Buddhist pagoda, where they sought to camp for the night to provide security for the monks. The two sides raised their rifles at each other, but the standoff ended with the Cambodians eventually pulling back, Chea Keo said Friday.

A Thai army spokeswoman said she was not aware of any brinksmanship taking place.

Thai soldiers entered the Preah Vihear area Tuesday, staking out positions at a Buddhist temple compound. However, some resident Cambodian monks remained and Cambodian soldiers have continued to visit them.

"The premier is very concerned about the tension," Thai Lt. Gen. Surapon Puenaiyakarn said after a meeting between Prime Minister Samak Sundaravej and Thai armed forces commanders Friday. "But he is optimistic that the meeting Monday will provide a positive and peaceful solution."

Cambodian Prime Minister Hun Sen wrote a letter to Samak on Thursday saying relations had been "worsening" since Thai troops "encroached on our territory," and asked Samak to pull them back.

In an effort to contain the tension, the Cambodian interior ministry issued a statement instructing authorities in provinces along the border with Thailand to maintain "good working relations" and avoid "confrontation or violence" with their Thai counterparts.

The dispute has taken a toll on tourism in the area, with the Thai side closed to visitors and the U.S. Embassy recommending Friday that American citizens "defer travel to this area until the situation has been resolved."

It also is starting to hurt economic relations between the two neighbors. On Friday, about 200 Thai construction workers returned home from Cambodia, said Capt. Supab Srisuk, an immigration policewoman.

"They wanted to return, fearing for their safety," she said. "They said they would go back to work when the situation returns to normal."

A king behind the coup d'etat that sent a an elected PM into exile is not exactly a charismatic and respected king. Maybe to the thais but not to the outside world.

The PADs are trying to overthrow the thai gvt through ultra nationalist violence. Coup d'etat becomes stale if repeated.
I don't hear the king calming the situation.

Cambodia becomes a scapegoat in this affair. Cambodia should be patient and let Samak get some breathing space.

To the last 2 commenters, i fought and shed my blood against the khmer rouge - now you will say that i am a sold-out to the vietnamese!? Well you may be surprised but there r many soldiers/officers in the cambodian army who also support the opposition (but cannot do it openly) and some of my friends were deployed at the border with vietnam 2 years ago and did they best to defend the villagers in a land dispute case despite the hierarchy confused orders. The fact is that we do our best among us despite being divided and under equiped and I am still proud not to be an extremist and be able to respect others, even if they are in the opposite side! we will have less trouble if we are united under a charismatic leader. Listen to yourself, what the fuck r you proposing to wait and see and have this empty talk critisizing everyone. must be some of this aneakchon who completely lost reallity of what is going on in Cambodia!

The Preah Vihear Conflict: What Is The Solution?

“First, Cambodia should invite the foreign diplomatic and international press corps to visit the conflict zone in order to win international opinion to its crusade. Secondly, Cambodia should use the upcoming talks with Thailand to press for a total Thai withdrawal from the conflict zone. Thirdly, if that fails, Cambodia can take this matter to the Association of South East Asian Nations’ (ASEAN) Forum, which both Cambodia and Thailand are members. The ASEAN Charter has a policy of non-interference and non-aggression between member states. Fourthly, if ASEAN fails to mediate a satisfactory outcome, Cambodia can take the next step which is referring this conflict to the UN Security Council to mediate. And fifthly and finally, if all else fail, Cambodia can take Thailand to the International Court of Justice like in 1962.”


Thailand’s invasion and occupation of the so-called “overlapping area” in the Preah Vihear precinct has entered its fifth day and there is no sign of it ending very soon. On the contrary, the situation is worsening by the day and both sides, Cambodia and Thailand, are dangerously reinforcing and building up their troops numbers to boost up their bargaining powers at the upcoming talks on the conflict which will be held in Thailand’s Sakeo province on Monday. I can confidently predict that the Monday meeting will not produce any results. The meeting will be a chance of finger-pointing, accusations and counter-accusations. The Cambodian side will demand a total Thai withdrawal and likewise, the Thai side will demand a total Cambodian troop withdrawal, including the evacuation of villagers who settled in the zone for years, before Thailand will agree to any withdrawal. At the end, the meeting will be an impasse, unless one side makes a concession, which is likely to be the Cambodian side. (Full details on the Thai incursion at Preah Vihear).

The Thai occupation of the Preah Vihear precinct at this time is reminiscent of the 1950s’ Thai occupation of the Preah Vihear temple, which ended with the decision of the International Court of Justice (ICJ) that adjudicated to give the ownership of the temple to Cambodia in 1962. At that time, like now, the pretext for the Thai occupation of the temple was, after reviewing the maps, Thailand assumed that the temple was situated on Thai soil.

Cambodia and Thailand had only one border treaty, which is the 1907 treaty. The documents and maps of the 1907 treaty showed clearly that the Preah Vihear temple and its surrounding areas fall under Cambodia’s sovereignty. On top of this, the International Court of Justice in The Hague adjudged to give the whole Preah Vihear precinct to Cambodia in 1962. So, the ownership of the Preah Vihear temple and its precinct is unquestionably Cambodian.

Now, what is the solution to end the present Thai occupation of the Preah Vihear precinct?

Cambodia, beside military prowess, has all the advantages over Thailand, under international laws and conventions, to prove the ownership of this so-called “overlapping area” under the 1907 treaty and the ICJ‘s decision in 1962. With this in mind, Cambodia must embark on a crusade of international diplomacy for a peaceful resolution to this Thai-made crisis. Cambodia could use the scenario below in which to go about resolving this crisis peacefully.

First, Cambodia should invite the foreign diplomatic and international press corps to visit the conflict zone in order to win international opinion to its crusade. Secondly, Cambodia should use the upcoming talks with Thailand to press for a total Thai withdrawal from the conflict zone. Thirdly, if that fails, Cambodia can take this matter to the Association of South East Asian Nations’ (ASEAN) Forum, which both Cambodia and Thailand are members. My predicted outcome to a peaceful ending of this conflict, that is acceptable to Thailand, would be a two pronged resolution. Thailand, without a doubt, would want to claim total sovereignty over this area and will never accept anything less than half of the 4.6 square kilometres “disputed zone”. So, the first solution for Cambodia is, if it wants a peaceful co-existence with Thailand in the future, it has to agree to a partition of this parcel of the lands. But Cambodia, as a proud and sovereign nation, would be a fool to accept this solution. The second solution would be the judgement of the International Court of Justice, like the 1962 case.

Thailand had never gotten over its wounded pride with the loss of Preah Vihear in 1962. One would not expect Thailand to allow this case to go to that court one more time that can make them lose face and territories further. Many Cambodians believe that, if the 1907 treaty was to be re-examined, Cambodia would see that its territories would have been encroached significantly by Thailand. A re-examination of the 1907 treaty by the International Court of Justice would see Thailand losing more territories.

Finally, I, and I would like to think that many of my Cambodian compatriots, would hope to see a peaceful ending to this conflict, preferably ending with an irreversible and binding decision of the International Court of Justice like the 1962 court case, so that this saga is resolved once and for all.//

For my own idea, i think if Thai choice the peaceful solution, they have to deal with negotiation, not use the army and then if no solution the both country must be complain to UN (United Nation) or ICJ(International Court For Justice) by international law. At the finally, the both Country must be respect the ICJ decision, not abuse an international law by soldier. Now it's 21th century, please respect the law!!! And UN must be deal this tension immediately by send the UN's force example KFOR in Serbia, UN Force in Estern Timor, or African Union Force in Sodan and so on. if UN lately to deal this problem, it mean UN don't care for civil people and soldier life of the both country who died during the war.

Thai will be ashamed with international if this country didn't take back the army from the cambodia border while they recognized the intertional law and a member of UN!! Now the time is not late for Thai Government for taking back the army from the Cambodia border.

Allow common sense to decide Preah Vihear Temple issue

Common sense alone should decide the issue of Preah Vihear, unless it becomes politicised.

Cambodia has officially occupied the Hindu temple for 46 years. Before the application to list it as a World Heritage site, nobody doubted the temple was under Cambodia's sovereignty.

In its judgement on the merits of the case, the International Court of Justice (ICJ) in 1962, by nine votes to three, found that the temple of Preah Vihear was "situated in territory under the sovereignty of Cambodia".

The wording seemed to be clear that the temple was under the sovereignty of Cambodia, but many people raised legal questions about whether Cambodia's sovereignty covers only the ruins or includes its base and surrounding area.

Sovereignty is the burning issue for the case since the opposition has alleged that allowing Cambodia's application to take the temple's base and surrounding area into the World Heritage site could be deemed a loss of Thai sovereignty to Cambodia.

To learn about the rationale behind the argument, it is necessary to go back to 1962 when the Thai government interpreted the ICJ's ruling.

By consequence of the ruling, Thailand was under an obligation to withdraw any military or police forces, or other guards or keepers, stationed by the Kingdom at the temple or its vicinity on Cambodian territory.

In practice, the Cabinet in 1962 ordered the withdrawal of troops from the temple and its vicinity and drew a new line to determine the boundary for the temple.

Some academics and opposition Democrat Party members argue that the then foreign minister Thanat Khoman sent a note to the then acting secretary-general of the United Nations, U Thant, to express his government's disagreement and reserve the right, if any, to resume its sovereignty over the temple.

"His Majesty's government desires to make an express reservation regarding whatever rights Thailand has, or may have in future, to recover the Temple of Pra Viharn by having resource to any existing or subsequently applicable legal process, and to register a protest against the decision of the International Court of Justice awarding to the Temple of Phra Viharn to Cambodia," Thanat said in his letter.

Thanat did not refer to any legal principle to back up his reservation. Unfortunately, a map annexed with his note to U Thant said clearly: "The map representing the area where the Temple of Pra Viharn is situated, over which Thailand has 'relinquished' her sovereignty."

The Foreign Ministry's Treaties and Legal Affairs Department and the military's Survey Department since then have regarded the 1962 Cabinet's resolution and the annexed map as their guideline. They deemed that Thailand had given up her sovereignty over the temple, its base and 250,000 square metres of surrounding area to Cambodia.

Another legal question: is the inherent right and the reservation made by Thanat still valid? Some legal experts say Thailand has the right and the reservation exists permanently in accordance with Article 60 of the statute of the ICJ.

However, the interpretation of Article 60 by some academics is misleading, since it only says the judgement is final and without appeal. In the event of a dispute as to the meaning or scope of the judgement, the court shall construe it upon the request of any party.

There is not a single word mentioning the inherent right and its prescription.

In fact, the parties in the dispute have the right to revise the court's ruling but Article 61 of the ICJ's statute suggests that any application for revision may be made after the lapse of 10 years from the date of the judgement.

De facto, Thailand retreated from the temple 46 years ago. The right to resume Thai sovereignty has no solid legal grounds to back it up.

During King Sihanouk's era, there was no this so-called "white zone" or the disputed area around Cambodia at all. In fact legally and internationally on paper documen, the disputed area is inside CAMBODIA. So ah Nan Chao Siems are the ones who NEED to back off, I say. I don't know why Hun Sen administration of Cambodia create all these "white zone" areas within the territory of Cambodia itself with the countries of Vietnam, Laos, and Thailand???? Now it is coming back to haunt not just Hun Sen but the very Khmer people themselves. The Khmer must use the international law to reclaim back all the disputed territories with the neighbors.

I have seen along that most of our leaders are not real nationalists. Nationalists/patriots will think first about their national interests, but our leaders don't; they think big about their own. If each of them is a patriot, NO neighboring countries would dare to touch Cambodia the slightest, because Cambodian soldiers are fully and well equippes with the most modern weapons in the world. Do I favor war? No, not at all. Is our government too poor to afford that? No, not at all? Therefore our country be as strong as Israel. And why that tiny country is strong? Because its leader's nationalism.
Why can any of our leaders be that strong? Open your eyes and look at their personalities and qualities. None of them should be deemed trustworthy enough to be a real resolute leader.

PAD fooling the people
I cannot believe the lunatics at the PAD have actually got the Thai people and the Puea Pandin party fooled over the Preah Vihear temple.



The line was drawn by the French in 1904, the International Court of Justice ruled on it in 1962,

“and the new line agreed by the Thai and Cambodian government actually brings more land into Thailand than the old map.

If the Cambodian government is happy to concede some land to the Thais while retaining the temple that is, and has always been, on Cambodian soil, then it is a win for the Thai government.”



This is just another example of the PAD stirring up issues trying to validate its existence. The fact that Puea Pandin party has weighed into it is disappointing; you would expect them to know better.

As for the Democrats, I hope they find the same demise the Australian Democrats recently have. Throwing stones at the government is good fun, but if you are never going to get a chance to run the country then it's a choice you can make without fear of having to prove you can do a better job.

The last Australian Democrats were voted out in November from the Senate and, as of July 1, the Democrats will be dead in Australia. Hopefully, the Thai Democrats will become history in the near future.

Cambodia you better watch out the Siam government is trying by all means possible to make us admit that the area around the temple it the so-called disputed zone.

The Siam must withdraw their troop without any conditions, because they are the one that break the ICJ verdict.

If they don't agree, just call for the UN.

It's a waiting game for Thai and Cambodian troops locked in stalemate at the 900-year-old Hindu temple at the centre of a border row.

The latest confrontation erupted after the detention of three Thai activists who tried to plant their national flag on the disputed site.

Feelings in some quarters are running high.

SOUNDBITE: Kong Salak, Cambodian soldier, saying (Khmer):

"As I get more angry I want to shoot them but my commander has told me to be patient."

The temple site on their joint border has been a source of tension since the International Court of Justice ruled in 1962 that it belonged to Cambodia.

Thai sensitivities have been heightened by the temple's listing as a World Heritage site.

Both sides say they are willing to negotiate to settle the latest crisis.

Neither is pulling back any troops as they prepare for top-level talks on Monday.

Dear My Khmer brothers,
I still see the dividing between the khmer people here...I am not against some guys opposing the govt, because we live in democratic society but please support our troops that standing guard our land and try to bring something that is positive about us here..Something that full of evidences not the baseless stuffs..

I would criticise the govt. if they are wrong, and I will support them if they are right..My view is the same for the opposition. Now it is time to unite and fight a common enemy. I think now the Govt. has done sth positive for the benefit of the Khmer people. But I agree that it is not good that Govt. had not included the dispute land into the WH list.

But it doesn't mean govt. give up the land, as you can see in join communique. The land will be solved soon through legal procedure.

Now the govt. are working on that..

1. Govt. already flew the foreign diplomats to the disputed land.

2. Foreign Minister is in New York to complain the UN that Thai soldier is invading our land.

3. I agree that, there is no such a white zone in the map. But if we go and mark the border, do u think those stupid siam allows us to do peacefully? They will send the troop there as usual and we still have to solve problem as we are doing now.

4. The thai are trying to show up their military just because they want us to bargain in the negotiation table. THey have no legal base to claim those land, so they expect our Govt. to soften our stand. I think if our Govt. agrees to sign to join management on those land with the Thai, then we can call our PM to step down coz he can't serve the interest of our people.

5. I am doubt about the MOU in 2000 claimed in the note of thai PM. It might be the one that signed illegally by a Director of Ministry of Tourism of Cambodia. This MOU was later widrew by the Govt of Cambodia and the Director was dismissed from his post. So it is not in effective. Even It is not that one, we can still widraw it back, as the Thai widraw the join communique on Preah Vihear. The law expert should know that the Treaty is bigger than the MOU. So the Franco-Siam 1907 is still in effect. The Verdict of ICJ in 1962 give more support to legality of that treaty.

So please try to post any positive view here...

I would like to add more. I agree that this govt. is corrupted, some of the military officers are also corrupted and involved in some brutal case. But now, do u think who can represent us to solve this problem? The opposition?

If Sam Rainsy goes to UN, will he be allowed to sit in the security council?..Now we have this govt., and since they work (I agree to some extend that for the popularity of the upcoming election) to defend our country now, why not we support them?

So keep aside the negative view..and let support them...

Latest news is that cambodia has appealed to the UN for help in resolving the conflict.

No amount of thai national postering will help against international law and they know it.

Not only have they been humiliated by PV being listed as a world heritage site, now they will be condemned as thieving liars.

No government will give in to thai demands. hun sen is condemned to win.

9:50PM. Hun Sen and Thailand already made a deal to do the business together, Hun Sen gave Khmer land 4.6KM to Thailand.

This standoff is only a show to fool both Khmer people and Thai PAD's neo-Nazis.

Hun Sen is knonw of giving away Khmer land, and that 4.6KM belongs to Khmers (see map from ICJ).

Hun Sen gave eastern region to Vietnamese and this 4.6KM to Thailand.

Latest news: after the visit from china and vietnam military attaches. The thai troops have withdrawn from the pagoda and taken position in the jungle but still blocking access to PV.

We are pusing them back inch by inch with military and diplomatic tactics.

Mr. Chhun was arrested and detained on October 15, 2005
Mr Rong Chhun, president of the Cambodian Independent Teachers’ Association, was arrested on October 15 and charged by the Phnom Penh Municipal Court of defamation and incitement of others to commit a crime without that crime being committed. He was arrested in Banteay Meanchey province while trying to cross into Thailand to seek asylum.

The arrest was in response to a public statement, issued on October 11 by the Cambodia Watchdog Council and signed by Rong Chhun, alongside three other Council members. The statement criticized the border agreement between Vietnam and Cambodia which Prime Minister Hun Sen signed during his visit to Vietnam earlier that week.
