The listing of the Preah Vihear temple on the World Heritage List has vindicated Cambodia’s undeniable right of ownership of the temple. The decision of the World Heritage Committee to list the Preah Vihear temple has given Cambodia one more time justice and victory over Thailand, after the International Court of Justice adjudicated to give ownership of the temple to Cambodia in 1962. These repeated victories should send a clear message to Thailand that its fight with Cambodia over Preah Vihear is futile and that, for the sake of good camaraderie with Cambodia, it should give up its claims to the temple. Cambodians of all political persuasions should celebrate this victory in a grand scale but with cautious optimism, as the wrangling over Preah Vihear is not yet over. While we Cambodians should be happy and proud of this victory, we must not be oblivious to the fact that the battle over the 4.6 square kilometres claimed by Thailand as a disputed area is yet to begin and it will be as fierce a battle as the one fought over the application to list the temple itself.
The one and the only treaty that Cambodia ever signed with Thailand was the 1908 treaty. That treaty had clearly given Cambodia the Preah Vihear temple and the surrounding areas, including the 4.6 square kilometres claimed by Thailand. (See map here).
When Cambodia took Thailand to the International Court of Justice in 1962 it was over the issue of Thailand violating Cambodia’s territorial integrity and, when the court adjudicated in favour of Cambodia’s claims, it means that the court adjudicated to give full sovereignty and territorial integrity of the Preah Vihear temple and its surrounding territorial claims to Cambodia. Therefore, Cambodia must fight with all its resources to put these lands under its sovereignty.
The anticipated fierce battle over the 4.6 square kilometres should be fought with the same veracity as the one fought in the 1962 court case and the one fought over the application to list the Preah Vihear temple. If need be, should diplomacy fails to achieve a satisfactory result, Cambodia should not vacillate in taking Thailand to the International Court Justice one more time.
My worry, and my only concern, is that Cambodia might lose these parts of the lands to Thailand in future border agreements. I foresee that, at best, Cambodia might only secure 2.3 square kilometres of these lands. If my prediction is right, then it would be a tragic ending to the battle so promising that had begun in 1962.

Preah Vihear always deserves the UNESCO status.

Le Cambodge invité à coopérer avec la Thaïlande pour inscrire la totalité du site de Preah Vihear

Le Comité du patrimoine mondial a bien officiellement inscrit le temple de Preah Vihear sur sa liste universelle mais sa décision est assortie d'un appel au Cambodge à collaborer avec la Thaïlande en vue d'une nouvelle "inscription transfrontalière" de la zone, destinée à assurer la conservation de la totalité de ce site "d'une valeur exceptionnelle".
Reconnaissant "que la Thaïlande a exprimé à plusieurs reprises le souhait de participer à une proposition d'inscription conjointe du temple de Preah Vihear et de ses abords immédiats", les membres du Comité soulignent dans leur décision "que le bien proposé pour inscription [par le Cambodge] est réduit et comprend uniquement le temple de Preah Vihear et non l'ensemble du promontoire avec ses falaises et ses grottes".
Le même document laisse entendre que tout nouveau classement du site dans son ensemble, bien que souhaitable, ne serait désormais envisageable qu'avec l'accord des deux Etats voisins. "Des recherches archéologiques [...] en cours, qui pourraient se traduire par de nouvelles et importantes découvertes, [permettent] d'envisager l'éventualité d'une nouvelle proposition d'inscription transfrontalière, qui nécessiterait le consentement tout à la fois du Cambodge et de la Thaïlande."
Dans le même esprit, le Comité "encourage le Cambodge à collaborer avec la Thaïlande à la sauvegarde de la valeur du bien sachant que les populations de la région avoisinante sont attachées depuis longtemps au Temple de Preah Vihear, et s'accorde sur le fait qu'il serait souhaitable à l'avenir de refléter ses valeurs intégrales et son contexte paysager grâce à une nouvelle inscription possible sur la Liste du patrimoine mondial". "Les attributs du site sont constitués par l'ensemble du temple ; l'intégrité du bien est compromise, dans une certaine mesure, par l'absence d'une partie du promontoire dans le périmètre du bien", ajoutent encore les auteurs du texte.
Dans sa décision datée du 7 juillet, le Comité précise qu'il n'a pas pris en compte le soutien initial de la Thaïlande au dossier cambodgien, formulé dans "un communiqué commun signé le 18 juin" par les deux gouvernements, mais que la partie thaïlandaise avait finalement décidé de suspendre quelques jours avant l'ouverture de la session à Québec (Canada) à la suite d'une ordonnance du Tribunal administratif.
Le litige opposant les deux Etats voisins concernant les abords immédiats du temple de Preah Vihear est donc loin d'être réglé.
Il n'en reste pas moins que le temple lui-même est enfin reconnu mondialement comme étant "un chef-d'oeuvre remarquable de l'architecture khmère". "Il est très 'pur' dans sa configuration comme dans la finesse de ses décors", est-il précisé.
L'Etat cambodgien doit désormais réunir un Comité de coordination international pour la sauvegarde et le développement du temple de Preah Vihear avant le mois de février 2009... "en invitant le gouvernement thaïlandais à y prendre part", ainsi que sept autres partenaires.

give it up already and permanently, thailand; it's not even yours and never will be. cambodia upholds the 1904 - 1907 agreement between the two gov't of then your king chulalongkorn and france which, of course, represented cambodia, and the 1962 icj verdict. that is all that matters. you people can cry and disagree all you want, it's not going to change anything as cambodia is protected by the international laws. plus, your appeal to the 1962 icj verdict had long expired and your country and your people do not have any right beyond those expired date given by icj. enough is enough.
in reality, you people should appreciate the fact that france drew the present boundaries between all the indochinese countries on mainland southeast asia because without this political boundary, i'm sure cambodia would reclaim all our old khmer provinces from not only thailand, but laos and vietnam as well as our great khmer empire during the pinnacle era of angkor was way larger that what is left of cambodia today. so, it is really a blessing in disguise for your country and people because of this international law that the european power of those days helped to put into place today. so, stop complaining, whining and bitching or whatever or do it until you are all dead from heart attack or whatever; it's really is your right and choice, but just don't try to touch cambodia. that's all. god bless cambodia and all our beautiful khmer people.

I agree that this is a second time that we win this contest with Thailand. The first time was the 1962 World court decision, this second time is the UN UNESCO reaffirmation that Preah Vihear is Khmer. It is about time that Thailand, especially those lunetic Democrat Party and the PAD stop dreaming about taking Preah Vihear back.

9:53 AM, I think what Khmerization meant was that the victory was over Thai opposition to the listing of Preah Vihear. If Unesco rejected the application to list the temple then it would be a failure.It is very true that Preah Vihear belong to Cambodia and that Thailand has no right and say in the affair of Preah Vihear. But people must remember that Thailand had successfully blocked the listing of Preah Vihear in 2007, even though the surrounding areas included in the application belong to Cambodia. I think what he meant was the victory over Thai opposition to the listing, victory because Unesco sided with Cambodia, unlike in 2007 when Unesco sided with Thailand and rejected the application.

Do not call this a victory, just call it a Just and Correct Decision made by the UNESCO.
