Cambodia needs a neutral police force

Hong Kong, China — Cambodia’s national police commissioner, Gen. Hok Lundy, was killed in a helicopter crash on Nov. 9, Cambodia’s National Day. Hok was a member of both the Central Committee and Standing Committee of the ruling Cambodian People’s Party and a close ally and senior advisor to Prime Minister Hun Sen, whose son is married to Hok’s daughter.

Commenting on Hok’s death, Cheam Yeap, a senior party official and parliamentarian, said, “The CPP and all Cambodians have suffered a huge loss.”

However, Hok’s death has brought relief to many, considering his record on human rights. Under his 14-year tenure, Hok was accused of failing to resolve many serious human rights violations implicating the rich and powerful. This failure has since developed into a culture of impunity in Cambodia.

Hok was also accused of violent acts such as the March 1997 grenade attacks on a peaceful anti-government demonstration, which killed 20 people and injured hundreds, as well as the extrajudicial killing of some 40 members of a rival party in a July 1997 coup.

Under Hok’s leadership, the Cambodian police showed little respect for human rights. They banned peaceful public demonstrations and protests, took part in forced evictions and used brutal force against demonstrators, recalcitrant evictees, suspects and ordinary people.

The ruling party has selected Neth Savoeun, Hok’s deputy, to replace him. However, Hun Sen had the final say in the selection of the three-star general, who is married to his niece, according to parliamentarian Cheam Yeap.

Neth’s appointment has been received with mixed feelings. Some welcome it and see better prospects for human rights in Cambodia. Others do not share this optimism, saying he will not be able to resolve cases of human rights violations inherited from his predecessor and that the police force will continue to be politicized, with the prime minister exercising personal control over it.

The Cambodian police are already politicized, as loyal members of the ruling party staff all positions of responsibility. Officers are slow in investigating crimes of a political nature that affect the opposition or government critics, but they act fast and more effectively if they affect senior party members or their families.

The appointment of the new national police commissioner can, however, create a break from the department’s poor record. It has opened up a good opportunity to move forward in policing. The new police commissioner, the Ministry of the Interior and the government should work to reform the police to improve performance, curb human rights violations, win public trust and meet the country’s international human rights obligations.

In order to attain these goals, the Cambodian police should not pledge loyalty to any political party or group. They should become a truly national police force, not a police force for the ruling party, as they currently are. They should strictly adhere to the U.N. Code of Conduct for Law Enforcement Officials, which is incorporated into Cambodia’s criminal law, but has so far been overlooked. And, most of all, they should “respect and protect human dignity and maintain and uphold the human rights of all persons,” as stipulated in the code.

By law, the Cambodian police should treat all persons equally. Citizens are entitled to protection without discrimination, as called for in the Universal Declaration of Human Rights, to which Cambodia has explicitly agreed. The police need to be impartial and respect the rights of all individuals, regardless of their origin, social status or political, religious or philosophical convictions.

This will require the Cambodian police to be politically independent and neutral, without affiliation to any political party. The national police commissioner should be placed directly under the authority of the minister of the interior, as he is supposed to be, and not under the prime minister. The police should be answerable to Parliament, through the minister of the interior and the prime minister.

Good conduct, political independence and neutrality of the police, as well as accountability to the Ministry of the Interior, should be explicitly incorporated into the police law that is currently being drafted. The same law should have penalties for any misconduct or breach of political independence and neutrality, and also create an independent institution to deal with complaints from the public against the police.

Again your ideology and theory is good in theory. I truly support a government that is truly democratic and where public servants are neutral. However, the theory is it is: a theory.

In Cambodia, one cannot implement the theory in full, because the situation is different and it warrants a different modified approach. Things in Cambodia are the way they are because that has been what it has been for the last couple of decades, and to expect it to change overnight is foolish.

It is wrong to expect that one size fits all. Look at Thailand. They implement western ideologies of democracy but it won't work because the situation is not the same as in the West. Hence it is in vain to force your way through when the door is already shut.

I acknowledge Cambodia is not good right now, but it is the least bad it has ever been. Your suggestion that Neth Saveou or the Police chief for that matter should not be a member of party is a dream. It is good if it is that way, but it is something that you know cannot be achieved.

What we can do and hope to happen is that the Police Chief will start to gradually take his work seriously, and to gradually realize that his work can be successful if people cooperate, not impede. I think Hun Sen realize this, and we can see that he actually tried to develop the country in recent years after years of consolidating his power and his wealth. I can see that he actually cared about the state of Cambodia, and take responsibility for its fate. He is attached to it, and now that his status as strongman is established, his next goal is to build his country. The same attitude could trickle down to his police chief, and other servants, and this process will take time, but eventually it will get better. That's the best we can hope for.

Mr Lao Hay, you have written quite extensively. But you always acted like a full-grown foreigner who does not understand the unique situation in Cambodia and how to weave your policy around it to make it work. You have exhibited a trait of ignorant person who would attack the government for reasons that reasonable Cambodians would be able to tolerate and understand. I easily place you in the category among the ignorant, blind political activist who long for your time to come back to what you have tasted during your stint at power in Cambodia. Remember CMAC, and how much kickbacks you recevied? That's what I am talking about. So don't talk from a moral high-ground 'cos you aint much better than those you criticized. You just happens to be outside the government, so you attack it at all costs.

Dr. Lao or MAHA BANDITH (according to rfa) just wanted to show he knows how it should work, but it does not mean he CAN do it. It is very easy to say I know, I know ... but "I can do" is not easy.

Cambodia needs stability so that new generations have time to learn how to behave and treat people in a democratic society correctly. If assumed that those old leaders won't stay any more longer, good generations are needed. Do we have them? Do not lie yourself.

I believe that SRS is a good democratic leader, but he needs to change his strategies. He needs to be a person who can make decisions and bring his decisions to the ground. It could be a good example for new generations. His work at the Min. of Finance has left many good memories and working examples among his staff. Even if he can not make his party win, he still can teach people how to work. Change your strategies, lose today, but win tomorrow.

Here are some observations for Mr. Sam Rainsy (and SRP supporters):

1) Instead of devoting most of your times to criticizing CPP, use your times to improve your political platform and strategy. It does not make you a better political party if all you do is blaming CPP. It makes you sound like an annoying loser or whiner.

2) You needs to think and act as a political leader not as a social activist. A social activist tends to believe in idealism, whereas a political leader believes in pragmatism and compromises. The majority of our population understand that idealism is noble, but unattainable, and pragmatism is the only way to achieve stability and prosperity.

3) You need to have a real boss that can provide you and your leading supporters sanctuary, not just moral support, in the time of crisis. In the world you and I are living, no political party can survive on its own. Find out which one is the most reliable or suitable boss for you – USA, China or France.

4) As an individual and a leader, you need to open up to other people ideas. Don’t be afraid of intellectual and educated people, but trust their strength and patriotic conviction to move your party and country forward. You need to attract qualified people to build a solid and credible team. There are lots of Khmers at home and abroad with the right credential for your party. Unfortunately, it is commonly known that you are not receptive to people with high credential. Stop thinking of your family aristocratic background, and learn to accept and work with other intellectuals.

6) You need to show to USA, China or France that you and your team are a political party worth helping. To do that you need to have a right team, and clear strategy how to get there. Don’t just go to them and say you will eliminate corruption and make healthcare free to the population. They will kick you out of their embassy before you even finish your sentence.

7) Finally, you need to know (and possibly learn from) your opponent better. PM Hun Sen is an aggressive chess player, is he not? If you really know that, you should know half of his game plans already. If you don’t know that, you have a looooooooooong catching up work to do.

My view is rude on you nonetheless, it reflects your and your party situation. You can chose to ignore it or do something about it. It’s all up to you and your supoorters….

Obviously, there are two schools of thought in this forum – one which tries to bring Khmer people together and the other that never seems to be able to get rid of the old Khmer propensity. The “R...” scares the shit out of me. Last time we had a revolution, I lost a father and a few dozens of close relatives. The whole country lost over two million people. So please think twice before using this word. Most of you guys out there will disagree with me but let me tell you this. No one will be more than happy than Youn and Siam leaders to see Hun Sen go. Why? Because, right now as we speak, there no Khmer leader who is strong enough to control the whole county. There will be so many factions and warlords fighting each other for powers and self interests – just what the Youns and Siams want. Stability is best the solution at the moment…

It is too early to say that SRP party can not win the election.

From many events, I believe that SRS himself is much prone to the CPP, but just because he takes a mcuh moderate opposition.

CPP knows that will keep the country united, and CPP too, they need to have an opposition. But Funcipix and Khmer Rough are not the right candidate, because their extremist and hostile attitude toward VN. CPP need also a balance between opposition and stability, and SRP just the right one. Thereby KR and funcinpix be disvolved. And also that was under the consent or help of the King Sihanouk.

In the view of the CPP, they need to keep the country in good relationship with the neighboring countries, and that a way to keep stability in our home. And there most be a prior agreement between CPP and SRP to achieve their common goal. SRP will be exist and CPP too but they will transform themselves into another position when the time is right.

You still want somebody else to be the Khmer boss......I say why can't we be our own boss that decide our own destiny. Would the US, China, or France care at all about Cambodia's interests? We can dream on.

You might as well go straight to the point that all the oppositions should just join with Hun Sen and ignore what he does and they'll have decent housing just for themselves but not for the common ordinary supporters. Ratify formally the fraternal friendship with Vietnam.

The fact is the Khmer people are not united against dictator, we condone it and it will flourish while the poor Khmer keep crying for help.....from whom?

To the guy who said we need stability, it is contrary to what you think. The only person who always warns us about instability is the one who creates instability because he wants to cling on to power forever! So, any challenge would be viewed as potential instability!

Look around, how many leaderships have changed in the big patron neighbor's country? Did Pham Van Dong, Le Duc Tho, or Le Duan stay on to power until now. Only the stooges in Cambodia would shamelessly deny their country's younger generation the opportunity to grow. Not just they deny any fresh, different kind of leadership, but within their own political party, they still deny the opportunity to their younger members to get into leadership. These bunch of old power mongers are too much into themselves. Even in nature, the old gives way to the young to continue the life and growth

You have a very a good point. You and I belong to a new generation that wants to bring in new ideas and innovations for the better of the country. But we got to be careful how we do it. We can’t simply remove the old structure and start every thing from scratch. Change has to be gradual and we need to remain calm and consistent. Stability provides us a productive environment to work out our ideas and to gradually improve the foundation of our society.

In this forum, a lot of people want a quick change while some of them even want a regime change or a revolution. Saddly, they are walking in the dark. None of them have any idea what would hold for the country. They want to replace the current system, yet they have nothing in place that can orderly take over the current system.

Take for example the One and only Sam Rainsy.
When he was the minister of finance, how many
peoples have finance him to be become Khouy.
Khouys are polices that supposed to check
the products enter and out of Cambodia.
Don't you know how much monies did Rainsy had made?
And how about Sam Rainsy cronies and relatives?
How many of relatives and cronies of Sam Rainsy
work in the ministry of finance?
It's always easy accusing Cham Prasidh
or Keat Chhon. Sam Rainsy should look in mirror,
ask himself, if he's better than these 2?

And right now, it's seem Sam Rainsy has been sold.
And you know who did paid him before he was
going to assist on the first day of the 4th MP's swearing.
Monies can be easily hide in some bank's transaction...
