Situation in the disputed borders near Preah Vihear on 26th November, 2008

The military situation in the Preah Vihear areas has been on high alert, despite calm, because of occasional accidental gun fires.

A Khmer military officer from Intervention Force of Division 12 said on 26th November that the situation until now remain calm but on high alert and a few days ago the Cambodian troops have warned the Thai troops when they were drunk and fired shots (into the air), but the Thai side explained that the gun fires were accidental.

The officer said: “Today, there is no change. The night before yesterday, 20 of us slept on the mountain. They got drunk and they fired shots, but they explained that the gun shots were accidental. We warned them. Both sides are on high alert but we still talk to each other.”

Members of parliament have urged the government to resolve the border disputes as soon as possible in order to save defence budget.

Mr Son Chhay said: “We cannot delay this dispute because we will lose in two fronts. First, the longer the dispute is delayed, the more rights the Thai have the claims to our territories. Secondly, we have to spend more time and money to defend the areas that can drain our military budget.”

Mr. Son Chhay said that he has requested the government to put the Khmer-Thai disputes on the agenda of the ASEAN Meeting in Chiangmai in December. And on Tuesday he has written to a letter requesting PM Hun Sen to explain to the parliament of the reasons why the government refused to lodge a complaint to the United Nations regarding Cambodian border disputes with Thailand.

Mr. Khieu Kanharith, spokesman for the government, said that the government has made great efforts to resolve the disputes and he has dismissed the ideas that urged the government to lodge a complaint to the United Nations.

Mr. Kanharith said: “If they want to help solving the disputes, just tell us how we can do it? We have made numerous complaints to them (the UN) and they just told us to be patient by trying to resolve the disputes bilaterally. If we ask them to come to lecture us, we already knew the answers. So why should we ask them? The persons who said like this (urge to lodge a complaint) does not understand foreign affairs and don’t know anything.”

Please note that the meeting held between Cambodian and Thai foreign ministers in Siem Reap on the 12th of November did not yield any substantial results because of the Thai insistence on the use of the word “Phra Viharn” to call the temple name and due to the Thai side refusing to commit to a troop withdrawal because they have to wait for an approval from the Thai parliament.//

Sorry I do not have much understanding of the legal stuffs. Can anyone help answer why the government does not bring the case to the International Court of Justice again?

I think what Son Chhay is trying to do is not wrong but I don't like the feedback from the government in this respect. Bong rith also doesn't know about Foreign Affairs - he is not Hor Nam Hong, how can he said that then?

I don't understand either why the govt. didn't bring the matter to the court. I suspected that the govt. leaders have some secret business deals with the Thai leaders. Other things, I read that Thailand has withdrawn from membership of the International Court of Justice after it lost the Preah Vihear case in 1962. As a result Thailand is not obliged to abide by the court's verdict after it withdrawn its membership from the court. I believe that, presently, the govt. has not done enough regarding the border disputes with Thailand. I think the govt. must engage the international community as much as it can to pressure Thailand on the diplomatic front and legal channels to negotiate sincerely and seriously with Cambodia. At the moment Thailand just come to the negotiating table because it does not want the international community to see that Thailand is not the aggressor, but the peacemaker.

A lot of people here believe that UN/ICJ can solve everything, and/or UN/ICJ will always judge in our favour. Well, life is not that simple, isn’t it? I hope people understand the real world we’re living in better, adjust their expectation and most importantly stop speculating about things that they know little or nothing. At some points, people have to trust the government. Of course the government made mistakes, but it has been on the job over twenty years. I am sure it has learnt something. No human being is that stupid.

2:01am, you are right. the govt. has been in power for over twenty years and has made many mistakes, but never learned from its mistakes. border issues are difficult, but at this moment, the govt, Kanharit included, has neglected the borders because they are too busy protecting their powers. there are many channels to go but at the end hun sen refused all the helps such as from malaysia and indonesia. now he refused to put the khmer and thai boder issues on the agenda of asean summit. we must try with the un, icj, asean or other channels. with the way hun sen go about solving the border issues, i believe that, at the end, cambodia will lose everything or most things. mark my words for it.

I appreciate your comments. It doesn’t matter that we have different views on the issues. The important thing is that we present our arguments and have a healthy debate. Phra Viharn is not up for debate among monkeys in Cambodia. It belongs to Khmer in Thailand and there is no argument about it.
