CPP senator to file suit over 44 'stolen' hectares on Koh Pich
CPP Senator Peou Sithik has announced plans to sue Phnom Penh Governor Kep Chuktema and Pung Kheav Se, president of Canadia Bank and head of the Overseas Cambodia Investment Corp (OCIC), for US$100 million over 44 hectares of land on Koh Pich that Peou Sithik claims the pair stole from him.
Peou Sithik said that he and his wife had owned 44 hectares of land on Koh Pich from 1994 to 2005, when Kep Chuktema issued a decree that voided all official land titles. According to Peou Sithik, Kep Chuktema proceeded to lease the land to the OCIC for 99 years at a price of $47.5 million.
"If he had done that in other countries, he would already be in prison," said Peou Sithik. "He robbed my land from me and sold it."
Peou Sithik said he filed complaints to various embassies, the Asian Development Bank and the World Bank to discourage foreign investors from buying land at Koh Pich.
Rein Sambath, the manager of OCIC, told the Post on Tuesday that this matter had already been resolved by Peou Sithik's brother-in-law, Suor Pheng, who negotiated the terms of the agreement with Kep Chuktema.
"It is an internal family dispute," Rein Sambath said. "Kep Chuktema did not rob the land. He cleared the decision with Suor Pheng, and compensation was paid. Peou Sithik simply did not accept the money that was distributed to family members."
He added that the lawsuit will not affect the Koh Pich development project unless the court issues a warrant.
A relative of Suor Pheng who wished to remain anonymous claimed that the land was owned by Suor Srun Enterprises, and each family member was offered US$700,000 when the land was declared government property.
Charles Vann, deputy general manager for Canadia Bank, declined to comment on the dispute, while Phnom Penh Governor Kep Chuktema was in France and was unable to be reached for comment Tuesday.

I assume that Koh Pich is somewhere off Cambodia's coast? If so, how can a governor of another territory do such a deal inside someone else's territory?
I shouldn't probably ask these questions, because it is a fact that they all are a bunch of lawless, crooked officials whose main aim is to suck blood from other people.
Sue is a good thing for Cambodia. It force people to be fair to each other or face suing. This is the place where you present all your facts. But the court system must be fair and independent from the ruling government.
I remembered one time I was in the courtroom for mother's court hearing for a piece of land she allowed a family to live in. Before the court procession, there was a swearing process under the bayan tree. Then the court would begin their procession I assumed, but there wasn't one; only the quiet verdict and the defendants of a husband and a wife quiet sneaked out. To my surprise how the verdict was come about when there wasn't anything at going just a quiet verdict. Everyone of our families were mad of how it was so quiet and quick... Later we found out the family connected to some high ranking officials. The case went on for years... before mother settled for a less land. That because we are also powerful otherwise... This is how Cambodia court system is like... total corrupt, connected and so unprofessional.
I can't blame people for criticizing the ruling government for their indifference.
All these corrupted people steal from the poors and from Cambodia/ Cambodians. The land belongs to all Cambodians but the corrupted politicians rich people took it for themselves and let the weak and poor in destitute/poverty. After, the Khmer Rouge nobody had any land left. i think sometimes, suing is a good thing to get people higher up in the echolon to mind implement changes or reforms the way they do thing that considered injustice or corrupted. although, like many things in cambodia which seems unprecedented or unheard of in the history of cambodia, cambodia must introduce new ways of thinking in order to help to improve the way some people in the leadership position are doing. the ability to sue is one of those good forces to demand changes or reforms. there should not be any more excuses for the way official doing businesses in cambodia. god bless cambodia.
depending on where you came from, it is not such a bad idea to sue someone for wrong doing like injustice, fraud, corruption, etc... hopefully, that will teach people to think twice about doing injustice or doing something against the law. it will take a strong group of lawyers to do just that. cambodia must strengthen the law system, and this is one way to do just that; however, not the only way, though! god bless.
the way i see it, in cambodia, it is usually the lack of idea or place to turn to that discourages people from taking action. add to that was the fear of prosecution, etc... well, now there are helps as the country is slowly changing for the better, hopefully!

Cambodian people have been always suffered from man made sufferings. They have stole their people their lands and their properties. Cambodian have two groups.
1-Smart group who have made their wealth from exploitations and stealing.
2-Idiot group who have suffered by others and wouldn't dare to stand up.
They should learn from Maorie People who their ancestors have sold their lands at a very cheap price since 1800 now they called for Lands claims by claiming that all European settlers have used alcohol and other methode to exploite their ancestors to take their lands. Now they wanted those Europeans people to repay back the new price. New Zealand government have to settle with them with billions of dollars to keep Maorie People happy. Cambodia is no different when Hun Sen took their land in 1979 for collective regime. But in reality, all his men and women have taken people land without paying a pennies. When the deals are involved in multimillion of dollars neither nepotism nor party-mate can be compromised. I pretty much enjoy to see that show in the matter of interest of the nation and those who hate curruption.
