Sam Rainsy fined by French court, must pay 1 euro in damage compensation to Hor Nam Hong

The Paris tribunal sentenced the Cambodian opposition leader for public defamation against Hor Nam Hong, the minister of Foreign Affairs.

The sentence was handed down on Tuesday 27 January. Sam Rainsy was found guilty by the French court of publicly defaming Hor Nam Hong in his autobiography “Rooted in the stone,” which was published in France by Calmann-Levy in May 2008.

In this book, Sam Rainsy implied that Hor Nam Hong was a Khmer Rouge collaborator, and he caused the death of several people. Because of this, Jean-Etienne Cohen-Seat, the book editor, and Sam Rainsy must pay a 1,000-euro in fine each. They must both pay to Hor Nam Hong, the plaintiff in the legal case, a symbolic sum on 1 euro for damage compensation, as well as 4,500-euro based on the stipulation of Article 475-1 of the penal code.

In case the book is re-printed, the court also orders the removal from page 209 of the book the following sentence: “A few years later, the minister of Foreign Affairs would become a collaborator of the Khmer Rouge regime, and he was suspected of causing the death of several people, including members of the royal family.” Thus, the court is finding that Calmann-Levy, the book publisher, is responsible for this portion.

On the other hand, the Paris tribunal rejected all other complaints raised by Hor Nam Hong. The guilty party must pay the cost to publish a legal communiqué stating this sentence in two newspapers to be selected by Hor Nam Hong’s party.

Even HorNamHong only suit for 1 euro, the French court mandate thousands of times more. That is how guilty Ah Scam Rainxy was.

Now wait until our court turns. I would be surprised if he will not get the MAX.

One euro a day plus 4,500.00 euros and removal of a paragraph from the biographical memoir is clearly a victory for Hor Nam Hong. Sam Rainsy words have been tested by a COMPETENT COURT OF LAW in France, and the results were not in his favor.This should strike in heart of his credibility as a politician. What else in Sam Raisy's words that we could not trust? I know one thing for sure he likes to incite riots and mass demonstrations on something that has no basis in the law. The results are factories being closed down, continuing illegal settlements on lands that belong to someone else who has been there much longer with proper land title. One other thing that always borders me when he started the party of which I was a member. He promised that he would surround himselves with knowledgeable and educated people. Now 14 years later, people who populate his party ranks are high school/college dropouts with serious attitude problems. Most of them from France are taxi drivers (not the highly educated Cambodian-French that we expected them to be), and those from the US cannot spell any English words correctly (regardless of what educational backgound they claim). His and his wife are always exhibiting a repulsive attitude that no Khmer members of his party can exceed their intellectual prowess. His party's inner workings are in such tatters due to mismanagement. One has to wonder why people risked death to joint his party in the first place just to defect to the opposing party a decade later? Why couldn’t they stay on?
My answer is: his words cannot be trusted and appointments to important posts are mostly done for his feel-good allies who clearly lack merits. As a result you have a fragile inner workings, and defection would continue despite his repeated claim of "democratic reform at the grassroots level". Had he honestly and genuinely followed on with his words to reform his party, NO ONE would defect to the CPP. And I repeat NO ONE would defect to the CPP. I speak of this issue from experience of having been a member of the party for almost a decade and a half.

Sam Rainsy's creditability is certainly eroding after this ruling. We all must respect the rule of law and please stop bickering especially those in the capacity as leaders. Cambodian leaders must change for themselves and for the country. Sam Rainsy must change his way of fighting the ruling government. He must be consistent and connecting with the people in addition to keeping this creditability clean and clear. He is the underdog therefore he must work harder to win.

in the USA, if one are found wronged or convicted in wrongdoing, that person's employment, credit, etc will be in ruined. i hope they will apply the same law in cambodia so unruly or careless leaders will lose their chance or deemed unqualified to run for public office due to their court records. that will teach them to respect the laws, others, and set good example for the nation. until that is in place, there can never be a true justice for cambodian people. please think about it! god bless cambodia.
