THE Cambodian Bar Association will decide this week whether to suspend or disbar Sam Rainsy Party lawyer Kong Sam Onn, accused of violating the organisation's professional code of ethics, the Bar's president said Sunday.
Kong Sam Onn, who is representing opposition lawmaker Mu Sochua in her defamation lawsuit against Prime Minister Hun Sen, was himself accused of defamation by one of Hun Sen's lawyers after making comments about the case at a press conference April 23.
Bar Association President Chiv Song Hak said a special inspection team would convene today to investigate the allegations against Kong Sam Onn.
At that point, the panel would send its report to the Bar and then the organisation would call its 19 council members to meet before making a decision on the case, which has been criticised by legal experts who say it is an example of government interference in the courts.
When contacted Sunday, Kong Sam Onn said that the inspection team has not yet contacted him for questioning. But he argued that the complaint against him is groundless.
"In general, the inspection team is independent, but I am concerned about the individuals involved in the case," he said.
"According to the law, I committed no misconduct with the code of ethics and there is no specific accusation."

I hope that Cambodian Law association President would weight the integrity and the value of the Association hightly rather working a shoemate for any politician. This case is interesting. Hun Sen should know that Ky Tech is clever and taking advantage from the case. While Hun Sen is being blamed of abusing power and putting pressure on a supposed-to-be-independent body, Ky Tech loses nothing but gains much. He knows that in Cambodia no gods are above Hun Sen and that no one is so extraordinarily brave to stand by Kong Sam Onn. He's proving that he's the most powerful man in the Bar, not monsieur Chiv Song Hak. Ky Tech is just like Lee Kuan Yew of Singapore, noting that most members of the Bar Council are Ky Tech's affiliates.
As a lawyer, I find it unfortunate that lawyers are not strengthening their institution and not in harmony; but instead they most are allowing themselves to be affected (or even controlled) by the government. The Bar is in fact under Sok An already. Sok An is smart enough to create the Council of Jurists and appoint some lawyers (most of them, if not all, are holding key positions in the Bar) as COJ members carrying with them the title of "Ek Oudam". The law does not allow this, as it is "inconsistency" and when a lawyer is appointed to a "public function" position his Bar membership must be suspended.
Plus, I also find it unfortunate for the nation that the Bar is very corrupt. A legal practitioner who wishes to be admitted to the Bar must spend around $15K. If one doesn't pay, then forget about hoping to be an attorney. A saying goes "lawyers are engineers of the society", and when lawyers themselves are ignorant, corrupt, and not independent then how can the society hope?
Can someone estimate how much are Ky Tech's houses, cars and other properties?
Will he lose the case? No way!
No need inspection, just do whatsoever they (Ky Tech and his gangs) wanted to do.

the CBA and it lawyers are controlled by cpp. If anything, you are less likely to have a favorable opinion of the cambodian lawyers because they themselves do not stay neutral regarding the laws. Had these lawyers had conscience of the law profession, they would practice and interpret the law so as to provide the accused and defendant a fair due process of the law..In Cambodia, the rule of gun comes first, and the rule of law comes second. Compounded with corruption, it's easy for ky tech and other cambodian lawyers to find loopholes in the law and to take advantage of system. You wouldn't be surprised to find that most of these lawyers did not meet basic standards and charactersitics that are required to enter the legal profession in the first place.
Regarding their given title, Ek Oudom, I am sure they are flattered by being called "Ek Oudom". This title would be highly frown upon if anyone were to address a lawyer by that title in the US.
The khmer legal system is in needs of improvements. When those lawyers raise their hands and take the oath of office, they must commit themselves to serving the people to provide justice all citizen regardless of their class and socio-economic background.
from reading here, i see there are a lot of angry people. no wonder we don't get along politically. maybe some of us need an education on sociology, psychology and all the social sciences branch; this way we can learn to get along with one another. why so much hate toward one another? sometimes, the tone of voice can really create conflict. perhaps we some of us need a good psychotherapist or something. god bless.
