Cambodia: Political Pressure Undermining Tribunal


Independent, Prompt Decision Needed on Additional Prosecutions

Hun Sen has no role in this court, yet he keeps trying to use his hold over its Cambodian personnel to interfere. The UN and international donors need to put their foot down so that the court can get on with its work in an independent and impartial manner.

(New York) - Pronouncements by Cambodian Prime Minister Hun Sen that the UN-backed tribunal on Khmer Rouge atrocities should not prosecute additional suspects call into question the court's independence, Human Rights Watch said today.

In the latest in a series of similar statements, Hun Sen told President Nicolas Sarkozy of France last week that the tribunal should not threaten the peace in Cambodia, which "means only prosecuting these five people," according to a senior Cambodian aide present at their meeting. "Hun Sen has no role in this court, yet he keeps trying to use his hold over its Cambodian personnel to interfere," said Brad Adams, Asia director at Human Rights Watch. "The UN and international donors need to put their foot down so that the court can get on with its work in an independent and impartial manner." In a public speech in March, Hun Sen said he would rather see the tribunal fail than have war return to Cambodia as a result of additional trials. "I would pray for this court to run out of money and for the foreign judges and prosecutors to walk out," Hun Sen said. After the speech, Judge Silvia Cartwright, the most senior international judge at the tribunal, said, "Countries where the rule of law is respected and where their citizens can be sure of a fair trial are those in which the independence of the courts and judges is guaranteed. ... Comments, politically motivated or otherwise, which appear to be an attempt to interfere with that independence are therefore to be deplored." Based in Phnom Penh, the UN-backed tribunal, known as the Extraordinary Chambers in the Court of Cambodia (ECCC), is prosecuting Khmer Rouge leaders for crimes against humanity in the deaths of up to 2 million people in the late 1970s. Five senior Khmer Rouge officials are in custody: Kaing Khek Iev (Duch), the former chief of Tuol Sleng prison; Nuon Chea, who was the deputy to the Khmer Rouge leader, Pol Pot; the Khmer Rouge foreign minister, Ieng Sary; social affairs minister, Ieng Thirith; and head of state, Khieu Samphan. Human Rights Watch called for the tribunal's pre-trial chamber, scheduled to meet next week in Phnom Penh, to make a prompt, transparent, and independent decision about the scope of the prosecutions to thwart growing perceptions that court decisions are directed by the government. The issue has been referred to the pre-trial chamber following a dispute between the Cambodian and international co-prosecutors on the referral of additional cases. In January 2009, the Cambodian co-prosecutor, Chea Leang, rejected the submission of an additional six suspects (one of whom has since died) by the international co-prosecutor, Robert Petit, who asserted that the additional prosecutions fall within the court's mandate and "would lead to a more comprehensive accounting of the crimes that were committed." While not contesting the strength of the evidence in the individual cases, Chea Leang defended her decision by citing considerations about "Cambodia's past instability and the continued need for national reconciliation." She asserted that the tribunal's mandate - to try senior Khmer Rouge leaders and those most responsible for crimes committed during their four-year rule - can be fulfilled by prosecuting the five people already detained.

The pre-trial chamber, consisting of three Cambodian and two international judges, was designed to resolve disagreements between co-prosecutors and between co-investigating judges. Its decisions are made by a "super majority" of four of these five judges. Four judges would have to agree with the Cambodian co-prosecutor in order to stop the prosecutions from going ahead.

"It is specious for the Cambodian prosecutor to assert that prosecuting five people for the deaths of as many as 2 million people is sufficient," said Adams. "The court has the capacity to take on additional cases. Each decision to prosecute an individual should be based on evidence, not politics."

The Cambodian Judiciary is notoriously corrupt and subject to political interference. Rather than a fully international tribunal as initially proposed by UN experts, at Hun Sen's insistence the ECCC was established as a Cambodian tribunal with UN involvement. A majority of Cambodian judges sit alongside a minority of international judges, with international and Cambodian co-prosecutors. Human Rights Watch said that attempts to politically influence the tribunal's proceedings violate Cambodia's agreement with the UN in 2004 establishing the tribunal, in which Cambodia agreed to abide by "international standards of justice, fairness, and due process of law." Ten years in the making and more than three years in operation, the US$100 million tribunal has been plagued by credible reports of corruption and political interference, as well as difficulty raising funds. "Declarations by Hun Sen and other Cambodian officials that peace would be threatened by more prosecutions are a red herring," said Adams. "The Khmer Rouge no longer exists and, particularly with Hun Sen's authoritarian grip on the country, no group has the capacity to cause unrest over this." End.

Answer: NO and Never. Because the KRT is in Cambodia and Cambodia is fully controlled by Hun Sen. Hun Sen has his court and his army to shoot anyone who oppose him.
Sihanouk has no power or voice anymore even he is willing to testify. China will not let him. The genocide in Cambodia involved China and Vietnam.

--No and No. The UN cannot go back and control Cambodia. The UN already failed Cambodia in 1993. It failed to disarm CPP. It could be some corruption inside UN, because some members of UN took a bribe from Vietnam. Vietnam keeps Hun Sen until her goal meets (land and economy). There are two major parties (US and China may be Russia) can make a deal to remove Hun Sen, but it will cost Khmers a highest Price.

Cambodia issue is not that simple as every who enjoys cursing and insulting in KI every day. It drags from way back since before French came to Cambodia. Vietnam and Thailand determine to eliminate Cambodia and it is not going to stop. You get to believe it.

Why on earth you made these statement? Have you every tried to study about Cambodia and her neighboring countries like Thailand and Vietnam from the ancient times to present?
And don't forget that these peasants were proletarians declared by Communist Mao.

When Cambodia disconnected herself from outside world like North Korea what does anyone expect that this kind of killing would had not happened?

To me, Cambodia joined Communist either for temporary to survive from Ho Chi Minh and Mao's aggressiveness I applaud for that, but to starve people to death like in North Korea was dead wrong.

If in fact King Sihanouk and his country men wanted to becoming North Korea to possess such powerful weapon etc., still have to feed the people. And another thing, Vietnamese who're in Cambodia for centuries with Khmers and declared themselves Khmers would not allow Cambodia to becoming North Korea, and Never happen. Vietnamese will do everything they can to divide and destroy Cambodia as they have been doing.

King Sihanouk game politics was too dangerous, but it could be rewarded if he made it. He wanted to make his country to becoming a self independent a strong nation against the Thai and Viets who abused Cambodia for centuries.

If he got his way like Kim Il Sung his god-father, this world cannot afford to have twin North Korea.

Vietnam was not only rewarded by the west she destroyed Cambodia's ambitions, she is now a confidence customer to the US.

These killings by peasants were the results of fear and distrust between two factions: Vietnmese Rouge faction and Chinese faction.

I watched the documentary of inside North Korea (hidden camera by a group of humanitarian) I saw King Sihanouk and Kim, the dear leader sit side by side and King Sihanouk's expression reminded me of his great ambitions to make Cambodia a powerful nuclear nation just like N. Korea.
It'd be a great threat to his neighboring countries, that's why the killings rose to the melting point, because of inside conflictions.
Vietnam did not just defeat Cambodia through invasion but defeated her through internal conflictions and made Pol Pot to responsible, a greatest monster ever live, though Viets were with Pol Pot also.

Those people whom you see in Cambodia are many Vietnamese who're trained to be Khmers since they are in Vietnam. One man in Global witness is Vietnamese who said he is Khmer and maried to Khmer general's daughter.

With the climate changes and Vietnam may soon be submerged into the sea, million Viets entering Cambodia surprise no one, and you shouldn't either.

PPU and his friends in KI are Vietnamese, and so Hok Lungdy who was killed on plane owned by Hun Sen's son. The west don't know much about Cambodia and her aggressive neighbors, but they claimed they do, because they are White who see themselves superior to the rest of the world. End of the story.

Dear All,
After my long investigation to why Hun Sen is so rude and so arrogant, I found that the problem was not about him. It was about NEC problem. As a democratic country, each citizen is equal in front of the law and in front the court. But when we interview a person for a job, we offer him or her a job contract with his salary, his entilement. But when we elect Hun Sen as Prime Minister we didn't offer his this job contract al all. we have only told him that his term is 5 years but we didn't tell him about his mandate, his entilement, therefore he has used all his full power to everything even controling singer girl. That is not is fault. It is a fault of all Cambodian !!! Areak Prey

I watched that Video from hidden camera of Nepali Dr. and his humanitarian group in N. Korea, and I saw King Sihanouk was there during missile parade in N. Korea.

I think the time was short and Khmer leaders didn't have enough time to prepare, after just freed from France, but Vietnamese glued themselves in Cambodia and wait for the right time.

I can almost bet that Thais and Viets may have made a deal to smash Cambodia before Khmers pick up "Juche ideology" of Kim Il Sung.
Those million mines surrounding Cambodia could be shipped from N. Korea and China and some bought from German business men.

Vietnamese beated Khmers from inside and outside and then they installed Hun Sen who now practices Juche ideology. Is it not?
Look at him and how he does. He is trong only his own people, where as Kim is strong both in and out.

It depends on what was stipulated in the contract, and whether or not the contract can be abrogated. However, in this case, my assumption is that the UN contract accord does not have credibility or integrity, since both these qualities have been egregiously tarnished--so does the UN's reputation.

We shouldn't blame them but find ways to help them. Do you know almost half of the country were Vietnamese? All the records were burned since day one, so Youn were coming in after they were prepared and well trained to be Khmers.

I said before that Cambodia issues are not simple, it drags to way back long before French came. The King and all Khmers were all born in the time Youn're already inside the country. What do you want the King or any leader do when parasite Youn're all over in Cambodia?

Cambodia has been poor since the collapse of Khmer empire. The King alone cannot help unless we all help. Every move, the King or Khmer leaders try, Youn knew ahead and block it and even killed us. Because Youn have spies are among Khmers or Khmers are working as Youn spies for cash.

When the boat is about to be sinking surrounding by sharks, you don't have time to curse, calm your damn mouth and stop blaming the King.

Those who have made commentsm mostly concerned about our country and our people. failure of having khmers killed in 1975-79 was a disaster. There were three factions in the period, and that is the past.Only lesson learnt to prevent the disaster happened again.

What we urge that strenghtening ourselve in term of human resources and real law enforcements so that interferences of viets become less effective.
