Rally for Mrs. Mu Sochua

Mrs. Mu Sochua, for her personal fame and dignity and the advocate for the rule of laws as well as the fearless and open society, after she received support from her lawyer, Kong Sam Ann, she filed a lawsuit against Hun Sen. But the defamer didn't accept the reality or send apologize letter to the public, the defamer countersuited Mrs. Mu Sochua. As the prime minister of Cambodia whose influence is omnipresent, the bar association disbarred lawyer Kong Sam Ann and the municipal court dismissed Mrs.Sochua's lawsuit but remained Hun Sen's.

Next 8 hours, the court of Cambodia will list one of its darkest records in the history of Cambodia judiciary system. It will try Mrs. Mu Sochua who bravely walks into the court without having legal defender. She has thrived to seek defender, but no one dare to be her defender because of the pressure and intimidation.

At Kampot public facility inauguration presided over by Prime Minister Hun Sen, he blasted out with scary tone and directly referred to a female parliamentary member of opposition party that everyone has perceived well that she is Mrs. Mu Sochua. The speech was televised entire the nation and the Cambodian people are the witness to this speech loudly ranted out from a mouth of a powerful prime minister.

Mrs. Mu Sochua, for her personal fame and dignity and the advocate for the rule of laws as well as the fearless society, after she received support from her lawyer, Kong Sam Ann, she filed a lawsuit against Hun Sen. Current situation, Mrs. Sochua couldn't find any lawyer who dare to defend her. The radiation of powerful Prime Minister is really omnipotent and omnipresent in Cambodia.

Prime Minister of Cambodia is the controller of executive branch, judiciary branch and the assembly branch. The national constitution that guarantees the independence of these three branches is under the seat of Cambodian prime minister.

Mrs. Mu Sochua is taking risk of her personal life to seek for justice and the respect of Cambodian national constitution for the sake of Cambodian people.

With this prestigious attitude, how could Cambodian people close their eyes, how could the international communities neglect this countersuit issue, how could the donors hide their tax-payers money to fund the government that oppress their own people?

We are the Cambodian people living in both Cambodia and outside Cambodia are keeping close eyes, chant and pray for the good heart and deed of Hun Sen, the justice and the respect of Cambodia national constitution in order to bring the progress to Cambodia especially for the bravery struggle of Mrs. Mu Sochua.

Mrs Mu Sochua has left with no alternative but faces trial on her own in phnom penh couet.

This proves that justice system has been grinded down by unjustified power exercises.
Ultimately this mentality needs changes in our society.

Intervention should be made by our king according to our constitution.
Failing to do so, it is proving that our constitution is being abused by so many levels inour society.

I urge our compatriots to observe the articles 8 and 9, not only article 7 for which has steered us from important roles of our king.

I understand she risks her personal life for the sake of justice to our society. It is time that courage for changes not from citizen but from the top one.

There is no fair trial in Cambodia.

Executive branch, judiciary branch and the assembly branch are Hun Sen or CPP branches (DICTATOR).

No body dare to conter (contre)Hun She will lose this trial.

However, later on she will be helped from ITERNATIONAL.

Is this brutal man a power grabber Hun Sen who abuses power wants to put a woman, a member of MP in jail because he harassed her and she defends herself, then the foreign donors still close their eyes, we need to have the anti-King Sihanbouk be checked. Because they are too busy cursing the King like Tmats.

The ones who are quiet but busy encroaching into Cambodia are the ones can be successful people.

Yes,this is the result of internal abuses tearing fabric of socity and led to less focus in external affairs.

We are not cursing the king or king father, but we pledge them to pay attention to our cambodian society where cambodian rights are neglected.We do need shade of kingdom but each of us required to fulfill our obligation.

That what we are asking for,real peace in living and the mind of cambodians.

What is really happening is that she sued and had no basis under law for it under UNTAC defamation law.
She made comments which the other side considered untrue as it relates to the other side, so she was sued.
It's not some kind of persecution, it goes out of her own conduct, and if she violated the law of defamation then she will receive a fine since the PM decriminalized defamation last year to his credit.
Using the courts to bring up one's grievances is certainly better than solving it through physical means so that's progress. The fact that she can't find a Khmer attorney to act as her defense attorney
is a statement however that Khmer lawyers are afraid of being retaliated against via the Khmer Bar.
The Investigating judge can ask the bar to appoint counsel however.

Only you and the court who blamed that Sochua's lawsuit is groundless.

Of course, Hun Sen's lawsuit is groundless.

In Western country as well as other democratic countries, people have freedom of speech and you can make remarks whatever you like if your remark is not defamed or insulted to anyone by name. As for PM Hun Sen said in Kompot province last April, even though, his remark seems to refer to digrace Mu Sochua, but he didn't mention her name at all. After heard PM Hun Sen's remark, disgrace Mu Sochua has sent a letter to Hun Sen to clarify his remark, but PM Hun Sen is smart by not clarify his remark back to Mu Sochua. If disgrace Mu Sochua is smart and mature enough in politics, she should use unclarification of Hun Sen to mocking back to him, but unfortunately, she chose sueing Hun Sen as her tool to promote her political stunt. Her miscalculation got back fire and she's in the pump now. I think 18 months jail time will teach her a bitter lesson and can cool her temper off.

You told us that Hun Sen sued Sam Rainsy of defamation. Do you remember, in that time Sam Rainsy didn't mention Hun Sen's name at all. He just use the analogy word like Hun Sen.

You think you are smart, but I accept that you are smart among Cambodian people who receive only one-sided media again and again inside Cambodia. But you are dump who tries to lie through this open source/society of internet. No body believe you.

Actually, educated people won't brand any person as an animal but it becomes an obvious for SRP and its supporters, they are so good in invented the stories, created the rumours, using bad languages against other people and so on...

I am fully aware when PM Hun Sen sued Mr. Sam Rainsy for defamation and I do remember very clear that, it was Sam Rainsy who ran away from the trial and later on has sent a letter to "Apology" to PM Hun Sen. If he's brave and thought that he's innocent, why he has to APOLOGY to Hun Sen for???

Ohho, do you think that I am living in Cambodia?? Come on man, don't using Assumption as your tool.

I live in the US, we believe in rule of law. When we accused some body of wrong doing, we must have evidences to support our claimed, or we will faced lawsuit or jailed.
And in Cambodia, the opposition parties to CCP party always accused Hun Sen of wrong doing, but never have any real evidence to supported them, if these Parties are in the US, they all probably in courts or in Jails for wrongfull accusation. And for Mrs. Mu Sachua, I think she should serve time for her crimed. I think by accused the Party that run the Country of wrong doing and asking the donor countries to side on the oppositions is slowing down in Cambodia progress in every aspect and especially economic progress. I think, the accusation such as Cambodia for sale is totally wrong, because without foreign investment in Cambodia, how are we going to have any economic progress,since we have no money to invest in our own. Event in the US, we have alot of investment from other countries. Especially from China and Japan.I believe, we need more foreign investment not less in order for country to be strong. Everyone knows well that court in Cambodia is biased. Sam Rainsy knew well that though he was right, the court will sentence to jail him. So, it was good for him to escape first.

Sam Rainsy's apology doesn't mean he accepts the fault. It means he chose the way of national reconciliation and the renewal of his work to fight against dictator and injustice court.

Do you have ears and eyes? Did you hear Hun Sen's speech at Kompot televised through TV?

All those are evident for Mrs.Sochua to ask for clarification from Hun Sen. But because of Hun Sen's omnipotent power, the court dismissed Mrs.Sochua's case and speed up Hun Sen's countersuit case. This is very injustice for Mrs.Socha, for Cambodian people, and for the rule of laws in Cambodia.

If you want to talk about a coward person, you should discuss with your master Sam Rainsy and asking him for advice. Having said that you should know that whenever Cambodia's Parliement has lift his parliementary immunity, he always ran away to overseas. Then, sent letter to APOLOGY to Hun Sen for forgiveness.

Sam Rainsy's APOLOGY doesn't mean he accepts his fault is a coward act. By using the word, he chose the way of national reconciliation is just his pretext to cover up his coward. Since 1998, Cambodia has been regarded as peaceful country, why Sam Rainsy needs for national reconciliation for???

Coward or not coward is not the issue for Sam Rainsy, but what makes Sam Rainsy unique is his brave to confront with the biased court and cruel leadership of Hun Sen.

When he knew that the court will charge and find him guilty, why he should waste time to confront that biased court?

Apology is the best tool to develop unity. Sam Rainsy had done the right thing. Cambodia since 1998 has no peace at all because the three national institutions such as the executive, the assembly and the court are not independent.

What peace do you define?

Actually, the country has been stable and has prospered- it takes time to develop institutions, laws.
It's not perfect by it's far from a repressive government- corruption is part of the system of trickle down economics in Cambodia, but is just a prevalent in it's neighboring countries including big brother China.

This case is much to do about nothing, however, perhaps the public will be educated as to just what constitutes "defamation." The United Nations Transitional Authority" (UNTAC) was written be foreign european lawyers and adopted by the National Assembly. Unfortunately, it was written as a crime and therefore anyone accused of it, went to jail immediately. The PM changed it from a crime to a civil wrong with a small fine if adjudged guilty.
The words of the PM would not constitute defamation in any country so for this to be cast as some kind of persecution is wrongheaded in my opinion.
