Cambodia MP to fight defamation verdict

A Cambodian politician sued for defamation by Prime Minister Hun Sen says she will appeal against a verdict in his favour.

Opposition MP Mu Sochua, a former women's affairs minister, acknowledges she has little chance of winning the appeal.

But she says she will persevere with her case to shine a light on Cambodia's justice system.

Justice

"I want to put justice on trial. It looks very dark for me to win the appeal, but nevertheless I want to take one layer - layer by layer layer - of what the justice system in Cambodia is all about," she said in an interview with Radio Australia's Asia Pacific.

Prime Minister Hun Sen sued Mu Sochua after she brought a defamation case against him earlier in the year.

Her case was thrown out of court several months ago, but the Prime Minister's case proceeded.

Some observers say the case is part of a government crackdown on its critics.

Mu Sochua's last lawyer quit the case due to intense political pressure.

Penalty

As part of its ruling, the court ordered Mu Sochua to pay a fine of $US4,000, about half of which will go to the Prime Minister.

In the past Mu Sochua has said she would sooner go to jail than pay the fine.

Asked about her position on the fine, Mu Sochua said she would follow through with the appeal before making a final decison.

"I was not served justice today," she said.

"My stands remain the same. I will continue to pursue justice. I have one more month to appeal, which is the next step. I will consider that step in the next few weeks."

Dear Ms Mu Sok Hour,

Hey do not be so long tail by doing such bad thing. Our proverb says "Antung Veng Chhnang Veng".

I think in this situation you must apologise and ask back your immunity and contionue to work in the Assembly to cash your 2000USD for your benefit and serve people. You said about Kangaroo Court why you still want to go there? Do not waste your golden time because we will die sooner or later.

Please think deeper about my opinion and thank you for your kind consideration.

All the best of us as Khmers.

I'd say the same thing.
Mu Sochua should stop the fight but she should apologise to Hun Senand ask her position MP back, so she can serve the country.
Sometime we have to have a thick face to get something done.

After the judge rendered the verdict, this person appeared to utterly ignored, disregard, and disrespect the country's judicial system. The opposition leader’s duty and responsibility is to obey and respect the law of the country -- this is a direct contravention of the law –- and, it is critically imperative, however, the opposition leaders must know and understand the rules of leadership as well as the rules of the law. The recent episode has demonstrated that the opposition has no respect for the rules of law. Moreover, since this person was not exculpated of the crime in which she has perpetrated—this person is no longer innocent. Again, the verdict must be respected.

The verdict is out; the guilty one must respect the court's decision whether this person likes it or not -- it's the law -- and the court has found this person guilty. Therefore, if this person does not accept the court verdict, since this person is one of the lawmakers, this person should be excused from the position.

Again, it is very important to understand that the judge was merely and judicially interpreted the law--not legislating from the bench. Therefore, it is not ignominiously for the guilty one to acknowledge the guilt, since the culprit one was the one who perpetrated this act, and therefore should acknowledge and accept the consequences. Furthermore, if the guilty one does not agree to the verdict, which was rendered by the court, this person is entitled to the appellate process.

Having said that, let me say this: now, it is the perfect time for this person to serve time behind bars for behavior modification prior to reintegrating this person into civil society so this person does not imperil to the society.

There is no fucking rules of law in cambodia. It's so corrupted that rules of law does not apply to HUN SEN. Rules of law are only there for a reference; however, making a sound judgment or giving a fair trial basing on "rules of law" in cambodia is unlikely to be followed.

Mrs. Mu Sochua is a brave woman and knows that she will not win in her appeal. She would otherwise better to serve the country if she decided to ask for forgiveness from the Almighty Hun Sen but sooner or later someone will have to take on this role to challenge his Almighty.

Mrs Mu Sochua is in a critical situation politically and judicially; However, she will shed some lights on the country's corrupted judicial system so that the international communities/donor countries have better understanding to what relationship the ruling party CPP and the outcome of the trial. This is not the first case his Almighty have brought upon the oppositions.

There is no rule of law in Cambodia. There is no rule of law in Asia. That is what is Thai and Khmer conflict is all about. Thai is learning from Sadam ajo hun sen of lawlessness in Cambodia. That is why Thai want to take Khmer land because Thai know Sadam ajo hun sen won't dare to go to the U.N for help.

i have a suggestion for higher education in cambodia. it would be good to encourage students at universities and colleges across cambodia to debate and talk about the code of ethics or code of conduct, especially its limit and boundary. what constitute a good ethics and what is the limit or boundary to freedom of speech. i don't think cambodia is trying to suppress people with their freedom of speech, however, the question is the limit or boundary of it considering appropriateness of time and place and the people who committed such heineous act. schools should be encourage to talk about it in ethical studies, etc... i think this is one way to build a brighter future of educated and good society in cambodia by learn and talking about good ethical conducts. the subject is much broader than this as it cover logical think, critical thinking, analytical skill, people skill, social skill, etc, etc... khmer students should learn them all before they can earn the degree from colleges and university. it's called being responsible for your own action, you know.

Thanks for your opinion and I do agree with you. Education in Cambodia as well as in other countries always teach to all students as you mentioned above, but we can't control people in doing stupid things. Indeed, if we want to talk about ethical conducts, it has never existed in SRP and its supporters. You can see in this forum.

Cheers

11:58AM.

Not many educated students or elite students who support SRP ENTER KI, but if there are some educated and rational people in KI, they don't curse or use vulgar languages. You may read some who do the curse a lot in here, but I am not sure they are that educated people or they really understand what is rational means. To me these people are more like Hun Sen who behaves like gangsters and some are from old schools.

Just because some of these posters we cannot see them, wrote their vulgar langauges cursing Hun Sen does not mean they realy are SRP's supporters. They can be anybody or can be CPP or SRP or Youn's propaganda as usual. You cannot accuse SRP because of these posters write. I don't fall into Youn's propaganday easily. Khmers in CPP learned everything from Youn and it is the fact.
