Culture of Compromise Seen Hurting Courts

Legal action, compromise and asking for pardon to end disputes have become an integral part of Cambodian politics, effectively and commonly used in past several years.

Since 2005, the nation’s courts have seen 17 cases that monitors label political in nature, stemming from border issues, corruption, defamation, disinformation and incitement. The cases have ranged from local politicians and rights activists to the prime minister and senior-level opposition leaders.

The new trend has met with mixed reaction. There are those who say such cases are an improvement over the use of weapons to solve disputes. But there are others who would prefer the courts are not involved in politics, or legal issues used as a pretext to intimidate critics of the government.

Kem Sokha, president of the Human Rights Party, an opposition party with three seats in the National Assembly, was once imprisoned briefly as the head of the Cambodian Center for Human Rights; he was charged with defamation of the government for hanging up a banner for 2005’s Human Rights Day.

“My release at the time was the result of political compromise, with intervention from Cambodians inside and outside the country, as well as international intervention,” Kem Sokha told VOA Khmer by phone last week. “I see this as not a practice that we want. We want to use a legal system where everybody is under the law, as a democratic principle with no one above it.”

Rong Chhun, president of the Cambodian Independent Teachers Association, who was once involved in a court case similar to Kem Sokha’s, said the court’s lack of independence and its service to the ruling Cambodian People’s Party force compromises the other side usually doesn’t want.

“The culture of begging for pardon, and after the pardoning one turning to support or follow a powerful individual is not a good practice,” he said. “But it is understandable, based on dependency and injustice in our legal system.”

The practice has filtered all the way to Cambodia’s remote areas. In Ratanakkiri province, Pen Bona, an investigator for the rights group Adhoc, was removed from his position, via pressure from the court.

“The culture of compromise and begging for pardon is not right,” he said from Phnom Penh, where he now works in the group’s home office. “It is unlawful, and we absolutely don’t want this. Those who are wrong must be punished. However, we can only do that in a system where there is real justice.”

The prevailing system has also affected the highest reaches of politics, when, for example, Sam Rainsy Party lawmaker Mu Sochua was fined for defamation of Prime Minister Hun Sen last month.

Mu Sochua, who is also the party’s deputy secretary-general, was fined more than $4,000 by Phnom Penh Municipal Court, in court fines and in compensation to Hun Sen. She has vowed to appeal but does not rule out the option of a compromise.

“Compromising is an option if it gives dignity to both sides,” she said. “But if the compromise is to make one party, especially the victim, lose its dignity, as in writing a letter to apologize, this is not a compromise. Without a compromise that gives honor to both sides, the court is a better option.”

The case draws lots of condemnation both nationally and internationally expressing concern that the country might plunge into dictatorship.

Hun Sen, meanwhile, has lashed out of critics of the case, which he brought against Mu Sochua after she sued him for defamation, for allegedly degrading remarks made in a speech in April.

“Those of you who would like to issue a statement, both Khmer and foreigners, I would call you stupid, dumb and ignorant of the law,” Hun Sen said in a speech last week, lambasting critics. “You only recognize rights of the opposition not lawful rights of those in power.”

There are other cases. Twenty-two military officials are suing another SRP lawmaker. One opposition journalist has been jailed for defamation while another editor promised to shutter his paper to avoid the same fate.

“In a case where someone says sorry and admits his mistake, it is enough,” Phay Siphan, spokesman for the Council of Ministers, told VOA Khmer. “Firstly, the government’s stance is to show what is right and wrong. Secondly, those who pass judgment are not the executive or legislative bodies. It is the judiciary body.”

Phay Siphan denied government influence over the courts, despite critics who note that the opposition rarely wins cases that appear political to begin with.

“I have never received [government] pressure in more than 10 years on the job,” Mong Monychakriya, a Supreme Court judge, said. “I solve a case based on my own merit, as the law permits.”

Some legal professionals, meanwhile, say politicians should leave the judicial system alone, to ensure its independence.

“We must follow the law and its procedure, once lawmakers give power to the court and the court is independent of political influence,” said Hong Kimsuon, an attorney for the Cambodian Defenders Project. “This is a decision that would benefit the whole population. If it’s a penal case, and [both sides] compromise and withdraw based on compromise and fear of influence, this is not a good practice.”

"On December 5, 1999, Tat Marina, age 16, was severely disfigured in an acid attack in Phnom Penh. The attack was allegedly committed by Khun Sophal, the wife of a senior government official, Svay Sitha, because she was angry her husband had a sexual relationship with Tat Marina. Neither Khun Sophal nor those suspected of being her accomplices in the attack were brought to justice. Intense media publicity compelled the Phnom Penh Municipal Court to issue an arrest warrant for Khun Sophal for attempted murder, but the police claimed that they could not locate her, although journalists reported that she was living at home as usual."

TORTURE AND MURDER ON PRAK SITHA WHILE IN CUSTODY BY MISNISTRY OF INTERIOR OFFICIAL
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed torture and murder.
"On the night of January 16, 2003, a street youth named Prak Sitha was beaten to death at the Ministry of Interior (MOI) headquarters after he was arrested and detained by off-duty MOI officers on suspicion of theft. His body - bearing numerous injuries to the head, torso, arms, and legs - was dumped at a Phnom Penh pagoda the following morning by ministry officers, in violation of police regulations regarding deaths in custody. No criminal charges were filed in connection with this death. In December 2004, the case was cited by the UN secretary-general's special representative for human rights in Cambodia - who stated that Prak Sitha died at the ministry "following beatings by a known police officer" - as an example of a "consistent and continuing pattern of impunity" in Cambodia."

"On September 4, 2008, Mean Sokchea, a RCAF major working in Brigade 70, shot dead 21-year-old waitress Put Samphors at a restaurant in Kandal province. Mean Sokchea, in a drunken stupor, fired his gun and apparently mistakenly hit Put Samphors in the stomach. She was taken to a hospital but later died of her wounds. Mean Sokchea was detained by the police overnight but was then released, allegedly after intervention by Hing Bun Heang. Put Samphor's family received US$2,700 from Mean Sokchea, and the police told them that their daughter was shot while authorities were chasing robbers."

Disgrace Mu Sochua’s problem all along, is that she is trying to be a politician. She's not, never has been and quite obviously, never will be. She should have just been herself, provide alternative policies and show Khmer people what a great alternative MP opposition she would be. Instead, her foray into being a politician has been a disaster. She comes across as pretending to be something she's not. Now, her political career is on the line and herself also in the hot water.

While the nation is facing complex economic, social and environmental issues disgrace Mu Sochua tried to promote her political stunt, aimed to get media attention. If this wasn’t such a clear demonstration of her selfish pursuit of personal ambition it would be laughable. There is no doubt that Mu Sochua has no real regard for the best interest of the nation. She is driven solely by a desire to become a “Champion of Women or new Aung San Suu Kyi” by any means available to her, even if that has the potential to destabilize the country. Even worse she now says that she will appeal her case against Prime Minister Hun Sen to the Appeal court following the announcement of her guilty verdict by the Phnom Penh municipal court.

People of integrity admit their faults, make amends and are judged fairly...Disgrace Mu Sochua is lacking in integrity and common sense and tries to change Cambodia into her own world. As long as Cambodia’s Court doesn’t issue any verdict which is fitted for her political stunt, she will scream for the justice all day long.

Well, what I am saying is Cambodia's Court. You can brand the Court in Cambodia whatever you want, but please reminds yourself that this Court is a legitimate institution in Cambodia. Like it or not, whoever living in Cambodia has to respect its decision.

Actually, the Cambodia's Court as well as other Courts in this world, they won't issue any verdict to please any Human Right group, UN or any country as you mentioned, but they issue and will issue any verdict according to their own laws and the evidences which presented to them.

Oh, you said Cambodia's Court is motivated by the dictator leader? Please tell me which dictator leader ever allowed the opposition exist in his country, let alone tolerate with a MP of opposition sued him in the Court??

The SRP and The royalist party are they able to escape and go out victoriously of the traps stretched by the Chinese strategists?

Hahaha, you said that in modern world, they are not using the totalitarian or dictator. Who told you about that or just what you thinking? If you ever studied at any American college, you won't make that such a remark at all. Well, I give you examples about the country which is running by dictator to refresh your low educated brain. North Korea is running by a dictator and during Sadam Hussein's regime, Iraq was also running by dictator.

Some Khmer in overseas including you, despite they are so low of education and never graduated from any University let alone be able to writing English properly, but they try to pretend themsleves that they know everything in Cambodia and shameless in making stupid remarks about politics.
