(Regarding the Freedom of Expression in Cambodia)

(Regarding the Freedom of Expression in Cambodia)
The Royal Embassy of Cambodia wishes to draw the public’s attention to the following facts related to the general situation of human rights and freedom of expression in Cambodia:
1- Cambodia is a pluralistic democratic society, where democracy and human rights are fully guaranteed by its 1993 Constitution. The Cambodian Constitution recognizes the freedom of expression and other fundamental rights. Since 1993, Cambodia’s state of democracy and the overall human rights situation have continuously made significant progress.
2- At present, Cambodia has thousands of civil society organizations, as well as free press and trade unions which have been operating in the country. Out of that number, Cambodia has at least eleven foreign human rights organizations, including the National Democratic Institute (NDI) and the International Republican Institute (IRI), that are working mainly on human rights-related issues. Cambodia also has the Office of the UN High Commissioner for Human Rights and the regular visits by the UN Special Rapporteur on Human Rights.
3- Moreover, with regard to freedom of the press, Cambodia has almost 600 newspapers, journals and magazines, 40 radio stations, and seven television channels. If this is not enough, the people of Cambodia also have unobstructed access to all kinds of foreign media, such as the Voice of America (VOA) and Radio Free Asia, Cable News Network (CNN), just to name a few. Local media supporting or leaning to the opposition party are allowed a complete freedom to publish and thrive in the country. Some of the media have been critical of the government on a daily basis. The people of Cambodia, therefore, enjoy freedom of the press and freedom of expression.
4- With respect to the recent court verdicts regarding defamations and disinformation are in compliances with the law established by UNTAC, as provided in Article 61 on “Incitement to Discrimination,” Article 62 on “Disinformation,” and Article 63 on “Defamation and Libel.” The sentences handed down by the court are aimed at protecting the individual rights, as well as the security and stability of the country. Like any democratic country in the world, Cambodia cannot let the proliferation of voluntary public defamation and disinformation intended to create social disorder, which is detrimental to the well-being of the society and the dignity of all citizens.
5- In any democratic society, the rule of law is fundamental, particularly in ensuring that people’s dignity and honor are well respected and protected. Freedom of expression is not absolute and does not allow one person to defame another person. It also does not permit a campaign of disinformation to take place repeatedly.
6- In the face of this growing defamation and disinformation campaign to smear the reputation of the leaders, the Royal Government of Cambodia—like any other democratic governments—has the right to resort to justice and due process of law, such as in the cases of Mme. Mu Sochua’s defamation against Prime Minister Samdech Hun Sen and Hang Chakra’s engagement in the campaign of disinformation.
7- The recent verdicts by the Cambodian Court on both cases are in compliance with the existing laws in relation to those offences. The prevailing laws and regulations concerning defamation and disinformation exist worldwide, particularly in developed countries, in order to protect and guarantee the right to dignity and honor of everyone alike.
8- Therefore, democracy, respect for human rights and freedom of expression must be in compliance with the rule of law.
9- All of the facts above are a clear demonstration of Cambodia’s full commitment to the promotion, development and protection of human rights and other fundamental freedoms in the country.
10- With respect to land problems, Cambodia has a land law since 2001 aimed at determining the regime of ownership for immovable properties (land) and guaranteeing the rights of ownership of the land.
- The National Authority for the Resolution of Land Disputes (NARLD) was established in 2006 for the settlement of the land disputes.
- The RGC has put in place a “Social land concession policy” to provide to the landless and the poor people plots of land. Presently, approximatively 4000 hectares of land in Kratie province, 870 hectares in Kampong Cham province and 3017 hectares in Kampong Thom province have been provided to them for housing and family farming.
- But in Cambodia, there are people who occupied the side-work [KI-Media note: sidewalk?] and used some part of the street as a market place and illegally occupied public and private properties. There are also professional squatters who take illegal possession of state or private land, and then demand compensation before moving to occupy another public or private land.
- Here also, the RGC, on the one hand, has the obligation to secure social order, and, on the other hand, to provide land for people who are in genuine need.

Illegal logging and clearing out the Rainforest in Cambodia isn't SMART to do. Building hydroelectric dams isn't a good idea 'cause the government isn't willing to take care of the citizens that are being displaced by infrastructures. Pumping sand into a lake isn't a SMART idea either, but I can't expect much from the CPP 'cause EDUCATION CREDENTIALS ARE VERY BOGUS.
A little knowledge is a DANGEROUS thing. What has the CPP been doing with DONORS' money that was supposed to improve the infrastructures of Khmer Society? I am talking about a Billion Dollar annually in the last 20 years given to CPP government.
Clean water, electricity, health, education, and et al ought to be improve by today's standard. But, I am there in Cambodia -- 1/1000th of 1% does get to the general public in Cambodia. The massive and chronic flooding ought to be solve by now if the government were to use the funding for the citizens. AND DON'T TELL ME THE CPPs ARE MAKING THE DIFFERENT FOR KHMER PEOPLE. The Tourism Sector, especially the Siem Reab Province, the revenue generated are in the 300-600 million dollar annually. So much income generated, ironically Siem Reab Khmer people are very poor, neglected, abandoned, undereducated in DPI (dept. public instruction).
What progress can you tell the world that Hun Sen Regime actually or potentially advance Khmer Society into the 21st Century?

How hypocritical is that to have your own drink polluted water and poison by the toxins, while the CPPs have way to access clean water.

ACID ATTACK ON TAT MARINA
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed acid attack.
"On December 5, 1999, Tat Marina, age 16, was severely disfigured in an acid attack in Phnom Penh. The attack was allegedly committed by Khun Sophal, the wife of a senior government official, Svay Sitha, because she was angry her husband had a sexual relationship with Tat Marina. Neither Khun Sophal nor those suspected of being her accomplices in the attack were brought to justice. Intense media publicity compelled the Phnom Penh Municipal Court to issue an arrest warrant for Khun Sophal for attempted murder, but the police claimed that they could not locate her, although journalists reported that she was living at home as usual."

TORTURE AND MURDER ON PRAK SITHA WHILE IN CUSTODY BY MISNISTRY OF INTERIOR OFFICIAL
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed torture and murder.
"On the night of January 16, 2003, a street youth named Prak Sitha was beaten to death at the Ministry of Interior (MOI) headquarters after he was arrested and detained by off-duty MOI officers on suspicion of theft. His body - bearing numerous injuries to the head, torso, arms, and legs - was dumped at a Phnom Penh pagoda the following morning by ministry officers, in violation of police regulations regarding deaths in custody. No criminal charges were filed in connection with this death. In December 2004, the case was cited by the UN secretary-general's special representative for human rights in Cambodia - who stated that Prak Sitha died at the ministry "following beatings by a known police officer" - as an example of a "consistent and continuing pattern of impunity" in Cambodia."

Hun Sen's personal Bodyguards Unit (Brigade 70) is a terrorist organization.
Hing Bunheang is a March 30, 1997 Grenade Attack suspect identified by the FBI.
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed murder, again.
"On September 4, 2008, Mean Sokchea, a RCAF major working in Brigade 70, shot dead 21-year-old waitress Put Samphors at a restaurant in Kandal province. Mean Sokchea, in a drunken stupor, fired his gun and apparently mistakenly hit Put Samphors in the stomach. She was taken to a hospital but later died of her wounds. Mean Sokchea was detained by the police overnight but was then released, allegedly after intervention by Hing Bun Heang. Put Samphor's family received US$2,700 from Mean Sokchea, and the police told them that their daughter was shot while authorities were chasing robbers."

If they did, they must resign from their public post for other to continue to serve the public. Even police, military leaders are needing to stay neutral. Let politicians to fight each other in the parlaiment and to exchange their views freely so that the public can observe which party is good and which party is bad. As I have said before again and again, in peace time, Prime Minister cannot order police or military at all. Only their minister can order them to serve the public and not for tehir own party.

Why are so racism towards Khmers who own two nationalities? Mu who went to the US for human rights improvement in Cambodia is better than Hun Sen and you who are going to Vietnam for dominating Cambodia.

I am so impressed with your response to the Tom Lantos Human Rights Commission Hearing in the US.
Again, all your description, if it was true, it is the outcome from the Paris Peace Accord, not from the Vietnamese occupation. But frankly, I do accept the truth that Vietnamese occupation has given you and Hun Sen the power and wealth today not the nation and Cambodian people. For general Cambodians, they has just escaped from the crocodile (KR) but slip into the mouth of tiger (Vietnam). Paris Peace Accord on 23 October 1993 has given second life for all Cambodians.
However, the outcome of Paris Peace Accord has been badly evaluated by many scholars and observers under the leadership of current Cambodian administration. Scholars and observers have cordially described the backwardness of democracy development, rampant corruption, human rights violation, limited freedom of expression, and killing perpetrators are still free of trial (impunity).
Mr.Hem, your long description is just the excuse, or I can say it is really unproductive excuse. Your statement has created only more conflicts among our Cambodian people. You should use your own intelligence to surpass other CPP's idea on how to rebut criticism in a productive way.
You merely said there thousand NGOs spread entire Cambodia, but you didn't elaborate how hurtful those NGOs are struggling inside Cambodia in working with the dominate political party. You said there is peace and security in Cambodia, but you didn't elaborate that this peace and security is not having principle of democracy and the rule of law. So it is different only from the Khmer Rouge regime. Or your task as well as CPP's task is to develop something better than KR regime only. I am really curious with this concept regarding CPP's intelligence.
You said in this world especially in developed countries, the powerful men (or leaders) sued their people or others with the verdict of defamation, and again, your statement is absolutely wrong and unproductive. You have never assured to having our leaders practice tolerance, but you supported the intolerance of the leaders. As I know, and many more evidences, your statement is not right. In developed countries, the leaders have never merely sued their people because of speech and expression. Journalists badly criticized their public leaders, only a few cases relating personal and social security needed clarification and correction from those journalists.
The court in those countries have never taken seriously into any verdict of expression if it doesn't physically injure. Among those schemes, the ongoing dispute of Preah Vihea temple with Thailand and the legal verdict of those 23 soldiers with opposition MP and journalists are good cause to exceed Vietnamization over Cambodia.
Mr.Hem, I would like to confirm that your letter is good only for biased media within Cambodia to fool our innocent Cambodian farmers. In short term period, you and your colleages can enjoy wealth, power and fame, but long term period, Cambodia and your children will sadly cry as Cambodia will be totally devastated and dominated by foreigner.
