Cambodia's war crimes tribunal has indicates it might investigate another five or six senior Khmer Rouge leaders for their part in the genocide of the 1970s. Five top officials are currently being prosecuted and the trial for the first, Duch, the chief of the torture prison Tuol Sleng, or S-21 is underway.

KELSALL: I think the short answer is that it's at the start of a longer process, although the international prosecutor has said in the media that he will go ahead with forwarding two introductory missions to the co-investigating judges, which basically will kick-start an investigation. So I think at least there is going to be the start of an investigation by the co-investigating judges. Now whether there is further dispute at that level as to whether the investigation should go forward is yet to be seen.
COCHRANE: And do you know who those two submissions are - who the people possibly to be investigated are?
KELSALL: No, in order to protect the fair trial rights of any new suspects, as well as the integrity of the investigations process, the names of those identified have not been publicly disclosed. There is some media speculation as to who they might be or at least what positions they might hold, with most people speculating that they would be senior government and military people, potentially people who have held positions in those states as late as 2006.
COCHRANE: Has the testimony of Duch, the first person to be tried, has he named anyone outside of the five defendants already on the list?
KELSALL: Oh, during the course of the proceedings, Duch certainly mentioned a number of people predominantly who worked under his authority at S-21 or who he reported to particularly Son Sen. The majority of people however he has named are currently deceased.
COCHRANE: Now, once these, let me ask you, once the list has been, the extra names have been put forward, who makes the final decision on whether they are prosecuted?
KELSALL: Well, the closing order which is tantamount to indictment in the civil law system is issued by the co-investigating judges, so it's really their determination ultimately that will decide whether to go ahead to prosecution. There are a number of issues that can be appealed by the prosecutor of course after that order is issued and prior to that point, any disputes between the national and international side have to be settled by a pre-trial chamber. But the short answer is it will be the co-investigating judges that issue the indictment.
COCHRANE: Just on that tension between the national and international sides of the trial. Is this development something of a compromise between the two views, one wanting to expand and at least one wanting to keep it to those five already named?
KELSALL: Well, I am not sure whether we would characterise it as a compromise at this stage, given the judgement issued by the pre-trial chamber clearly shows an ongoing disagreement between the national and international sides of the judges as to how this issue should be handled. It was clear from the decision that the Cambodian judges did not believe that there was grounds to continue with additional investigations and that their international colleagues disagreed with them. However, under the court's internal rules and the law, the investigation has to go forward if there is a disagreement at this stage. However, at the stage of determining whether the accused persons at that point are guilty or innocent. If there is any dispute and no resolution is reached, it will then mean an acquittal, so...
COCHRANE: Just finally and very briefly, this is a politically sensitive issue I understand. Cambodia's Prime Minister Hun Sen has said that expanding the number of people on the list could destabilise Cambodia. Just how politically sensitive is it within the country?
KELSALL: It really depends on who you speak to on that issue. Obviously, Prime Minister Hun Sen has given statements to the media earlier this year saying that he believes it would cause further political unrest and possibly a return to conflict with former Khmer Rouge cadre. However, people I speak to on the ground say that they don't have any indication of this and they think that any real threat of that nature is completely unfounded.

Yes, Hun Sen was once a commander for the khmer rough, but he defected from them when he found out what the khmer rough wanted to do to the people, he had no parts in the killing of Cambodians people. If you want to put Hun Sen on trials, you should put most Cambodians who borned before 1975 on trial together, becuase most Cambodians who borned before 1975 supported the khmer rough,event the Lon Nol armies supported the khmer rough at that time, becuase at that time everywhere the khmer rough came to attacked the Lon Nol armies just laid down their weapons and let the khmer rough took over. Yes, most of us was victims of the khmer rough, but most of us were supporters of the khmer rough and Hun Sen was in the same boat.

Correction.
Hun Sen DID NOT defected from the Khmer Rouge because "he found out what the Khmer Rouge wanted to do to the people, he had no parts in the killing of Cambodians people."
Hun Sen and many Khmer Rouge military battalions within the Eastern Zone constituency comprised of former Indochina Communist Party members who were trained in Hanoi during 1940s, 50's and 60s. They were not the communists of Pol Pot and the other Cambodian students who studied in Paris.
Also, the Eastern Zone Khmer Rouge failed in their raids east of the border into Vietnam. The main Angka (consisting of Pol Pot, Ieng Sary, etc.) realized those Khmer Rouge in the Eastern Zone were inefficient in following orders and some of them already struck deals with Hanoi even before 1975.
The main Khmer Rouge under Angka's leadership had conflicts of interests with the Eastern Zone Khmer Rouge who's leadership were Hanoi trained. As a result, Angka wanted to purge the Eastern Zone groups. The Eastern Zone, upon hearing of this, got scared, shit their pants and ran away into Vietnam to save their own asses. It just happened that Vietnam found an opportunity to invade Cambodia ("liberating" as a pretext) and use the Eastern Zone Khmer Rouge as newly installed puppets of Hanoi.
So yeah, Hun Sen didn't care about the Cambodian people being tortured, starved and executed. He simply only wanted to save his own ass.
During Pol Pot regime costed more 2 Millions life of Cambodian. I have heard more than 6000 chinesse experts working there at the time, exp. I saw myself 1977 in Kampong Chhnang (new airport). In the research wheher China has involed indirect with this issue, the answer NO. If during Pol Pot regime worked more than 6000 experts like China at the time, then the world say USA has involved with this case. The UN tribunal is doing a good job and go for the right direction. They need to summon the CPP leaderships including Hun Zen, Chea Zim, Heng Zam Rin, Hor 5 Hong, Keat Chorn, Sihanouk, Sor Kheng, and Sok An to stand trial.

Hun Sen broke away from Pol Pot not because he saw Pol Pot as evil or because of his guilt for collaborating with Pol Pot to kill his own people, but to save his skin since he knew Pol Pot was looking at eliminating him as well.
To me, Hun Sen was as guilty as Pol Pot. Pol Pot gave the orders and Hun Sen was the executioner.
As such he should stand trial as did the five KR officials who are in custody now.

I see the situations in Cambodia, and it is going to that direction.
A few old real Khmers with high positions were ordered to new and luxury offices in PP. They were told to take vacations and return to work when they come back.
When they returned from their vacations, they were ordered to retire. Now those new offices are occupied by new faces who speak fluently Khmers and they are young people. That's the facts, and stop fooling yourself, just keep watching. Don't argue with stupid things, I only shared what I knew about.

It is important for rights groups and the world community to stand firm in regard to the KRT and not to cave in to repeated threat of renewed 'civil war'. Firstly, that we are hearing of the threat at all is indicative of the pressure the trail is bringing to bear upon the PP regime (or at least some elements within it), and secondly; in the event the regime opts to carry out the threat, the world and history will cast appropriate judgement based upon the regime's manifest contempt for the judicial prerogatives and obstraction of an independent court, in which case being forced to abandon what could be the trial of the century (in order to avoid a civil war) is preferable, in my view, to delivering half-hearted, half-baked verdict to the Cambodian people.
Despite demonstrated willingness to adapt to social-economic realities, it is evident that the regime has not been inclined to open itself up politically sufficiently enough to integrate non-revolutionary elements into its own ranks, essentially, because of Vietnam's weariness over the re-emergence of Cambodian nationalism, particularly, one that is not aligned to her.
With this consideration and the practical need to fill the political-administrative vacuum created by the sudden collapse of the Pol Pot faction, Hanoi advised and approved the use of patronage-nepotistic recruitment drive by its own hand-picked Khmer communists such as Chea Sim, Hun Sen, and others who have since established personal fiefdoms for themselves. In this sense, it can be said the party views trust and discipline as paramount; over and above its professed Marxist-Leninist ideology which stresses a new fraternity among men and condemns inherently unjust reciprocal undercurrents of feudalism.
It might be wise for the Tribunal to keep the 'Suspects File' open while engaging increased international support aimed at getting the regime to release major suspects for questioning. In any case, if their past is as clean as they claim, suspects should have nothing to fear before an independent tribunal. As for the threat of civil war, this could well materialise in the form of popular discontent given the regime's refusal to address interrelated issues such as the misuse of international aid, mounting economic crisis, leasing large tracts of primary forest to unethical commercial interest. . .

"On December 5, 1999, Tat Marina, age 16, was severely disfigured in an acid attack in Phnom Penh. TORTURE AND MURDER ON PRAK SITHA WHILE IN CUSTODY BY MISNISTRY OF INTERIOR OFFICIAL
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed torture and murder.
"On the night of January 16, 2003, a street youth named Prak Sitha was beaten to death at the Ministry of Interior (MOI) headquarters after he was arrested and detained by off-duty MOI officers on suspicion of theft. His body - bearing numerous injuries to the head, torso, arms, and legs - was dumped at a Phnom Penh pagoda the following morning by ministry officers, in violation of police regulations regarding deaths in custody. No criminal charges were filed in connection with this death. In December 2004, the case was cited by the UN secretary-general's special representative for human rights in Cambodia - who stated that Prak Sitha died at the ministry "following beatings by a known police officer" - as an example of a "consistent and continuing pattern of impunity" in Cambodia."

"On September 4, 2008, Mean Sokchea, a RCAF major working in Brigade 70, shot dead 21-year-old waitress Put Samphors at a restaurant in Kandal province. Mean Sokchea, in a drunken stupor, fired his gun and apparently mistakenly hit Put Samphors in the stomach. She was taken to a hospital but later died of her wounds. Mean Sokchea was detained by the police overnight but was then released, allegedly after intervention by Hing Bun Heang. Put Samphor's family received US$2,700 from Mean Sokchea, and the police told them that their daughter was shot while authorities were chasing robbers."

If your theory were true, then it means that Pol Pot and his gangs who joined the communist party in France, then later in Vietnam, got played by the viet. History tells us that mr pol pot went to france as a student to study to be an engineer, but at some point he quit school and join the communist party in france. at around the same time, he went to vietnam to join communist group. he also traveled to communist china during that time. while i am not a historian, i believe there is some sort of connection between pol pot and the viet communist party in those days.
It was said that mr Son Sen and his whole family was murdered just a few weeks before pol pot's death in 1998? So why did pol pot kill mr son sen? If mr son sen is a viet communist, why did it take mr pol pot so long to realize that he himself got played by the viet? From my pointof view, i think mr pol pot decided to commit suicide in the end because he had realized that he got played by the viet and he didn't want to live to tell khmer people the story.
Where was the Human Right? Where were the UN and US? Where was the World compassion? Where was God? Where were you when we need you during the KR regime? I was there and watched the innocent Cambodian dying. I had only the questions without answers.
